[Resolved]  Poddar Developers Limited — improper feedback and delay in possession of Flats

Hi,
I had bought a flat in Poddar Developers Ltd SAMRUDHHI EVERGREEN”, project in Badlapur East, Mumbai in Dec 2011. The time when I booked , Foundation Plinth work was going on and lastly on I had paid Poddar developers amt Rs 60539/- on commencement of Plaster work on 03rd Sep 2012. Now its almost 7 months passed and still there is no sign of giving possession of flat from Poddar. I don’t understand the reasons for delay.

I had called to their sales representative but he was avoiding my calls as he was busy with new prospective customers. Request your help in escalating the matter so that these things are taken more seriously by the developers in future and they also compensate customers for the financial loss suffered by them. I am paying Pre- EMI for last 1 years which is again adding up to the cost of Flat .

I am expecting the developer to compensate me for the same.

Poddar team is cheat. Their president OM is like big liar and does talk professionally. They have cheated me too.
They are a big Liar.
I booked 3 flats in pahse -2. While booking they promised balcony and now at time of possession there is no balcony. No body is commenting on that. Their President Om is saying that it was free and thats why removed. I told him that during booking balcony was highlight of your project and how come you have removed with informing the customer. he didnot replied and just moved away saying that he has other meeting as well. He is al level of President but he behaves like a peon... no respect for others. More over that they fined me for late payment. I have taken flat on Loan from SBI. Always during time of installment disbursement, Poddar never submits the document to Bank like Architect Certificate, last payment receipt and so payment from Bank is late and now they are imposing fine on me for that.
They are fining me for their mistake.
Om says that It is my duty to check with bank and delay payment and part payment. How come is my duty when Poddar is submitting the document late. Also they never mention that the status of payment even when I called them every month.
Dear all,
first all of the people who cheated by poddar developers adding his personal mobile number there(here) and contact each others or make a groups on whats app or others electronic media as a Interest FRAUD By PODDAR. After conversation by electronic media or by call select a one place and meet all those and make a strong unity. After making a unity of 10 to 15 people file a FIR in near by police station of his site of poddar evergreen badlapur. wait 3 to 4 days of police to take a action against this frauder developers or his president mr OM MAITHE( because always they have a sating with near by police station). If the police cant take a action we have a two ways...1) we go to media to give a hot news. 2) we all select a one comfortable day and meet at near thane railway station and give this issue to thane POLICE COMMISIONER. he direct meet to common people after 3 o'clock after taking a appointment on morning 11am. he defiantly help us. i sure 90 present of buyer are effected by interest fraud issue. the interest system only and only started by poddar new president mr OM. he is a main person to take a FIR against them.

So many buyer i believe they received interest latter after giving all the possession amount so this a completely fraud because if we all are delay in giving payment why poddar people are not inform to us and see in demand latter some time cant mention due date and interest percentage. the send a plaster works or others demand latter in 2013 and they done plaster in aug-14 after giving payment . they promise to give a possession in dec-13 and they still not give a possession so they want to give a interest to us.
so please cant pay any interest or extra, adding there own contact number, contact each other by call or electronic media discourse the issue, make a one strong UNITY and file a FIR.

Ask company to Remove all terms and condition before registration.

I have also received interest letter for the late payment which is done by their home first finance as per the letter. But when we confirmed from their home first finance that they has been timely disbursed. Then also We have done all the payment on timely then also they are not releasing our keys. We have met personally in their head office but no one can ready to listen anything and also not ready for help to sort out the all these things.

Just to alert to all don't buy or refer the flats from Poddar Developers if you don't want to loose your valuable money.

This is completely fraud so don't think to buy any flat from them.

We have to do something otherwise they will make a fool to other people.

Hi Everyone,

I purchased flat costing Rs: 20, 58, 720/- out of which Rs:3, 70, 000/- is been made by myself as down payment. Balance money was financed through ICICI Bank LTD payable on demand.

After payment of final demand Rs. 2, 70, 931 paid on 20-Dec-2015, I received letter a from developer stating additional payment of Rs.48, 082/- as penal due to delay in demand payment. I made all my payment on time, there is only single delay in payment from ICICI Bank, on my investigation I discovered that payment delayed by ICICI Bank was due to incomplete construction, as per banks policy developer was not completely liable for the mentioned amount. There are many errors and discrepancies in the calculation provided by the developer, when I insisted for clarification I was denied for the same. When I requested them to waive the penal levied in absence of satisfactory calculation, they offered me a discount of Rs.10, 000/- and insisted me to pay balance Rs.38082/-
There are too many loopholes and flaws in the calculation provided, I would like to mention few instances.

1.) My property got registered on 16th December, 2013, where as I got my demand letter stating my first installment is due on 25th November, 2013. How can demand is due before registration of the property. I called the sales executive Mr Dheeraj and asked him regarding the demand date correction, he assured me that nothing will happen and they will correct the demand date in their future records.

2.) My second demand letter I received on 05th February, 2014 but there is no due date mentioned on the demand letter. How will I or Bank come to know till what date disbursement need to be done ?. Whereas in the calculation provided by developer they have charged the penal interest from 28th December 2013.

3.) Developer has collected additional charges for “Fabricated safety Grill” for windows but as per agreement I am not suppose to pay these charges, all these charges where inclusive at the time of agreement. Agreement does not states anything about “Window Grill” charges.


I had already made all the payment on time from my side, if there is some delay in disbursement from bank side on account of incomplete construction, then how I am at fault ? Why I should bear this additional charges of Rs.48082/- ?

they have not taken proper permission in terms of compliance OC, CC is missing for the bhivpuri samruddhi complex
Poddar developer is not reliable builder, he hasn't taken legal permission etc, construction quality also bad, every monsoon ourselves facing leakage & seepage problems, no proper road to reach home, no permanent water supply provision, We samruddhi complex peoples file FIR on Poddar developer under MOFA & consumer court, Also he tries to build another project nearby, & our authorized administration not taking action against him.
