Sold duplicate battery claiming it to be original one

In early November, I had gone to the shop - Delight Telecom asking for HTC Desire V original battery. The shop guy gave me a battery in loose packing. On suspicion, I showed it to the authorized HTC center in Bangalore and their technician confirmed that the battery was duplicate. The shopkeeper sold duplicate battery. He did not take it back even after pointing it out.
Details: Samsung 7562 Battery Rs 1100
Original cost = 1299
Duplicate cost = 1100
The battery was determined as duplicate by personnal from Samsung Outlet.
The shopkeeper was rude and did not accept that it was duplicate and forced to pay the money....
