[Resolved]  Andheri Panchvati Co-operative Housing Society Ltd. — Mental torture, harassment, abusing language, insults in General Body Meeting of the society

This is a complaint against an illegal managing committee of a co-operative housing society at Andheri West , K West Ward..

I am a senior citizen, a social worker and a RTI & CHS Activist. I am the ex.Hon.Secretary of Andheri Panchvati Co-operative Housing Society Ltd, C.D.Barfiwala Marg (Juhu Lane), Andheri (West), Mumbai - 400 058. The Managing Committee consisting of the following members are constantly subjecting me to the mental torture, agony, harassment, insults and are using abusing language even during General Body meetings of the society:

1) Shri Vijay Dalal, Chairman (flat no.B1 / 41)
2) Shri Kekin Shah, Secretary (associate member), (flat no.B1 /15)
3) Shri Apoorva Tolat, treasurer (flat no.B2 / 31)
4) Shri Kader M.Sahib, M.C. Member (flat no.B2 / 61)
5) Shri Kirat Patwa, M.C. Member (flat no.B1 / 61)
6) Ms.Namrata Parikh, M.C. Member (associate member), (flat no.B1 / 23)
7) Shri Nandu Muthuswamy, M.C. Member (associate member), (flat no.B1 / 03),

I have already lodged many complaints at Juhu Police Station but without any positive result. I have even complained to the Deputy Registrar K West Ward who has very promptly initiated action against the committee. The Managing Committee which is illegal still continues to harass me. The Secretary Shri Kekin Shah boasts about his contacts with higher ups in the police department. If anything untoward happens to me, the above mentioned members of the committee should be held responsible.

Company — abusing language

As a result of my complaints against the irregularities in the working of the society to the Deputy Registrar, K West Ward, the Managing Committee of Andheri Panchvati Co-operative Housing Society Ltd. has been dismissed, the Chairman Shri Vijay Dalal and Secretary Shri Kekin Shah have been disqualified for election or being on managing committee for one term and an Administrator from department has been appointed vide Order Ref.1073 Dated 30.05.2012 U/s.78 of MCS Act, 1960 issued by the Deputy Registrar - K West Ward to whom I am extremely thankful.

Instead of accepting the dismissal and disqualification order gracefully, the dismissed and disqualified members have opted to go for Appeal with Divisional Joint Registrar against the order of the Deputy Registrar (hopefully to continue and offer "honorary services" to the society). File closed and final order is awaited.

I have complete faith in the working system of co-operative department.

I am glad to inform that my complaints about the irregularities in the working by the Managing Committee of Andheri Panchvati Co-operative Housing Society Ltd., C.D.Barfiwala Marge (Juhu Lane), Andheri West, Mumbai - 400 058 were well attended by the Deputy Registrar, K - West Ward. After investigation and inspection of the society, the Deputy Registrar dismissed all the managing committee members, disqualified Chairman Shri Vijay Dalal and the Secretary Shri Kekin Shah from contesting election or from being on the managing committee for one term and an administrator from Govt.staff is appointed vide order ref.1073 dated 30.05.2012. I am thankful to the Deputy Registrar and his staff.

Now, the dismissed and disqualified members have opted to file an appeal with the Divisional Joint Registrar against the order of the deputy registrar ("hopefully to continue offering "honorary services" to the society). Let's wait and watch the results.

The dismissed and disqualified committee members of Andheri Panchvati Co-operative Housing Society Ltd., C.D.Barfiwala Marge (Juhu Lane), Andheri West, Mumbai - 400 058 did not hand over Charge of the society to the Administrator appointed by the Deputy Registrar. The Administrator also did not pursue taking Charge or could not take Charge for the reasons best known to him, in spite of having appointment order in hand. In the mean time, The dismissed and disqualified committee members opted to file an appeal U/s.152 of MCS Act, 1960 with the Honourable Divisional Joint Registrar against the Order of the Deputy Registrar passed U/s.78 of MCS Act, 1960, who gave Status Quo in the matter. The dismissed and disqualified committee members are continuing as usual.

I am glad to inform that justice prevails and the order of the Deputy Registrar has been upheld and the Appeal filed by the dismissed and disqualified committee members has been rejected by the Honourable Divisional Joint Registrar, Mumbai after hearing the aggrieved parties. The Administrator has been changed by the Deputy Registrar. The new Administrator appointed in place of the old Administrator is also trying to take Charge for the past two days. The dismissed and disqualified committee members are still continuing as usual. Let's wait and watch and see if the dismissed and disqualified committee members are handing over the Charge to Administrator or again...! (hopefully to continue to force / offer "honorary services" to the society). It is obvious that "honorary workers", if dismissed and again Appeal being rejected, should gracefully handover the Charge, instead of wasting money, time and energy for forcing "honorary services" on the society and members.

Let's see. What happens next.

am the members of flat No. B/6 of the CHS. My Mon and dad are senior citizen and are also members of Flat No. B/4 and residing at Flat No. B/4, on ground floor, Amba Darshan Building, Carter Road No.3, Borivali (East), Mumbai 400 066 most respectfully submit my complain regarding Nuisance, annoyance, harrasment and mental disturbance to me and my family members.

I alongwith my mom and dad are members of Amba Darshan CHS and holding 5 shares since 1990.

That in front of my two flats of the halls of the said Flat No. B/4 and B/6, there is sitting arrangement made in the compound of the society.

That since last few months, we are facing lots of difficulties because of the aforesaid three ladies alongwith their children everyday coming down on the ground floor between 6 pm to 9.30 pm. These ladies are deliberately not using rear side sitting arrangement but they are mischievously sitting in front side of the Flat No.B/4 and B/6 and chitchatting loudly and let their children free to play in the open compound. These children are shouting, screaming very loudly at the instance of the aforesaid ladies resulting inconvenience, harassment, disturbance, nuisance and annoyance to me and my family. In my request letter dated 20th December 2013 addressed to the society i have made it crystal clear that the playing of children in the compound of the society cannot be objected but their screams and noise is highly objectionable.

Accordingly i have by my letter dated 20th December 2013 addressed to the secretary of Society requested to abate the said nuisance and annoyance by shifting the said sitting arrangement to the rear side of the compound.

The said society called AGM on 5.1.2014 at 10.00 am, and when the issue of my request letter dated 20th December 2013 was raised, the aforesaid two ladies Smt. Rita Umesh Mistry, Smt. Achlesha Ketan Dalal and Smt. Jigna Virendra Dedia made lots of hues and cry over shifting of the said sitting arrangement from the front side. These ladies threatened that "no one can even touch the said sitting arrangement", forget about shifting of the same to the rear side. This is to inform you that these ladies are not the members of the society. These ladies are daughter-in-law of the members of the society. They were not entitled to attend the AGM and create nuisance in the AGM of the society going in harmony. Because of their wild attitude, the society could not take any decision on my request letter dated 20.12.2013.

After 5th January, 2014, three ladies became more rigid and adamant. Their Nuisance to me and my family members are aggravated. They being ladies, no one dare to warm them and their children. Their Harrassment and nuisance even continues.

we filed a dispute in Co-operative COurt. thereafter they become more violent and started harrasing more and more.

Now want steps further we can take in this matter... please suggest

I have appreciated your effort to fight against injustice . I can understand you better as It is very tough to fight alone and speak out openly against sort of humiliation/torture from those with whom staying together in society for several years.

I am as associated member want to give justice to my father ( now 82 years old and founder member of society) against criminal mindset of Managing committee members indulge in harassing my father . I would like to speak with you on this for your valuable guidance.

My building in which I am staying was constructed in 1990. My mother purchased the flat in year 2003 and was told the registration for the housing society was filed and its proposed by the one of the resident A K Saha who claimed to be the secretary of the building. However years passed but to information on the registration was given and we also did not question it. Since few years now the this person A K Saha had started a school and a cancer patient home in the building without asking other owners in the building. Since the other owners do not stay in the building or have rented the flats, my family protested against him. Since then he has been harassing us by the mean of not giving water in timely manner and has stopped out access to the terrace by locking it. We have complained against him to police. However he abides by it for few days then starts again. He one also used some one else to make complaint against us for harassment to which the case was dismissed as no offense. Even after police giving him warning he still continues to lock the terrace and has asked people not to give us keys.

The other owners of the building are least interested in the issue and hence do not want to come forward. This person A K Saha claims he is the secretary but never produces any kind of record or approval on the same.

My queries are :
1) As a owner on the flat in the building which is not a registered housing society what are my legal rights on the building amenities.
2) What are the legal way that I can approach to get this issue resolved.
3) How can I find the construction year of the building.
4) Since I know the building I stay in is very old, where can I complain for its structure stability.
I do not have any complaint but a suggestion. There should be change in by laws of co operative housing society because all rights are given to managing committee and no support system for single member and even if there is its very lengthy process.
There are many cases in co operative housing society where there are defaulters not because of willing they do not pay but because of their complaints are not listened or solved by committee and as a protest they stopped their maintenance payment.
But because of there is no rule or time line to solve problem or dispute the society charge the member as high as 21% interest that to compound interest. Although member is not in fault still becomes defaulter
There should be a provision that is isuue not solved by msnaging commitee within one year the matter should lisen and solved by government ie registrar and maintainance which is not paid by member as protest will go to government wefare fund .
So that managing committee will also be in hury to solve the issue and even member will anyway has to pay money so willful defaulters will not be able to carry on non payment.
Member who is actually has issue not solved can pay his maintanance to government and will be free to bear interest of 21% and so on
Managing committee will not unnecessary prolong the issue since they want get any extra income at the time of settlement by way of high interest.
I hope my point will be understood and will be applied.
