Ansal API Sushant Megapolis, Greater Noida — No agreement given by builder though already submitted 20% of the total amount.

Hello,

I booked a floor in Sushant Megapolis, Adjoining Greater Noida. I have till now given 20% of the amount to the builder. Still they have not given Agreement on stamp Paper.

Also, there was no mention of Free Hold charges during booking. But in the allottment letter, they have written that I have to pay 12.5 of the basic price as FreeHold charges. This is total cheating.

Also in allotment, they have mentioned to give possession in 42 months. But they have not included any penalty clause in case they fail to give possession in time.

Please suggest what can we do.

I am facing the same problem. No such clarity was given when booking. This is fraud.
I have booked a row house, and now they are giving the booking letter after paying a hefty sum, that too with clauses that is in favor of Ansal only.

We had confirmed 'n' number of times before booking if it is a freehold property, they confirmed saying its directly brought from farmers and not from authority, hence a freehold land and thus no problem shall arise, and now when I am seeing the booking letter they are asking for 12.5% for freehold charges lone.
N number of mails, verbal complains etc have been done but no revert has ever come back from Ansal. We feel thoroughly cheated.

I would request all the investors who are facing similar problems to come on a common platform and raise our voices together. It is hard earned money that we have spent ... and we are right to get a justified deal

Moreover the agent I booked from (the one in Ansal Plaza, ground floor office) has called and threatened us of local goons if we dare go against them!

I have been associated with Greater noida authority and many builders in NCR.
I am very much familiar with allotment issues .
Properties in Greater noida is on Lease hold basis.At the time of possession 10 % Lease rent is to be paid If allotted from GNIDA.

Freehold property conversion charges if only 2% excess are to be paid is just negligible but, has many additional advantages.

No need to panic as money invested in Ansal API is safe ( Ask those who have invested in NOIDA EXTENSION).

Agents always help in resale of our property, their offices are always supportive, as builders staff keep on changing .WHEN YOU SPEAK LOUD, YOU HEAR LOUD must have been the reason in your case.

Its not just abt freehold property :
I have not received any documents-sanctioned plan, map, detailed layout, government clearance, overbridge approval, even after asking several number of times. I required the Agreement letter also at the time of signing the Booking document but it was said that it will be given the next time around payment of due date.

At the time of booking I had signed the document agreeing to the fact that the price is fixed and on those terms only I had paid the booking amount. Where was it mentioned at the brochure that we shall be charged extra if the price escalates? And as per norms the above mentioned code holds true only if the party mutually agrees. But I do not agree and accept this term.

The initial stated cost has already been factorised keeping in mind the future inflationary trend in the X no of years till it is handed over to us as per schedule. Then why is the escalation in prices arise at all? It Is absolute betray of trust and agreement if the Escalation clause is included.

Moreover, to our dismay Ansal API has not issued any “Sale Agreement” or for the matter of fact, any agreement at all. Rather they have sent across an “Allottee Arrangement” letter which too is not on their letter head of the firm or judicial stamp paper. The“Allottee Arrangement” letter has rather been computer printed on blank sheets of paper, holding no credibility whatsoever.

The Delivery time is termed as ”Fourgthy Two(42) from the date of the sanction of the plan” in the “Arrangement” sent by Ansal. This period is not clear and needs to be corrected with the correct time period I have to be explained with time lines as to when will I be getting the possession of the property. The date of approval plan should be mentioned specifically so as to we can ascertain the date of possession.

To add Insult to Injury: I made the payment well within the scheduled date on the 27th June but next letter I receive is Rs.740 charged towards Interest fees for the same payment made within time. The reason I got was they did not trace the money which I had transferred the 2nd time around. Repeated mails saw no revert- the mails were done to Mr. Tomar and Mr. Solanki (at the advice of Mr. Dushyant Tomar, but he never responded back to the mail)

1.Queries related to MAP and GOVT.Clearances must have been automatically been resolved if you had applied for Bank Loan (As they do
due-diligence before approving).

2.Please check if price escalation only a part of your arrangement/agreement/application or it is common to all (May be ANSAL is following the same for all, since it might be benefiting him in future if construction cost rises)
** In NOIDA EXTENSION SUPERTECH ECOVILLAGE-II company has returned money to 200 investors as he can not construct in loss.

3.Prices in Noida & Greaternoida Properties have a jump of about 11%. Buy any where.

4.Builders like ANSALS, DLF, OMAXE are trendsetters in Real estate industry.They can be trusted .No need to think too much, as I was about to apply in DDA scheme, But could not apply as I read brochure and got confused.

5.If company employees are not responding to your mails and calls please text us their mail ID and phone numbers .

Builders can not forfeit your hardened money unless their time linked payments are delayed (Or interest exceeds the amount paid).

90 percent builders do not mention date of delivery in their arrangement / agreement .But, as banks shall disburse only in construction linked plan (i.e, No construction no disbursal ) .

Sale Deed refers to registry which is done on possession after complete payment to builder/authority is made ?? seems some confusion..from your end .
Stamp paper is to be attached only when property is to be mortgaged (Banks requirement).
You were to mention names and phone details of Ansal Api Employees who were not responding you ?

Your visiting card says you are "sales officer" of Ansal Sushant Megapolis, with Ansal's logo printed on it ... Ansal Admin (MR. Vikas Jain) says that it is not his problem if I have doubts as I have booked from an agent ., ... and thus it is no liability of his ...

Sales officer to Ansal ... or no channel partner to the firm (as they are showing me the door when they realized I have booked from an agent - MR. Rakesh Kumar) or are you a Real Estate Agent posing and pretending to be Sales officer of Ansal
You should had told us before .. that you are an agent and your office in Asal Plaza is a sales office

Well as for banks ... It dosent matter what they tell me verbally in writing it says "Project not approved"
you ppl have made a toy out of the investor ...
and if you are writing as Ansal spokesperson and replying on their behalf then pls say so ... why fake id and disguised names ... create an id in name of Ansal and reply boldly ... giving in writing what you mean ...

As per you, MR.Vikas jain showed you the Door, when they realized that you had booked through a channel partner.
( All builders /Companies work with franchisee).
You have also mentioned that Solanki/Tomar were not responding to your mails and calls.


It seems you are not specific in resolving any doubts that you have related to the project etc., but more keen in spreading negative news about Ansals.

It is advisable to go to the company or your channel partners, have a polite sitting with a cup of cold tea . Properties can also be sold in resale by channel partners on profit/Company may also give more better options.
Ms. Kanika u sud cllect all the revent docs frm the Builder ( documents-sanctioned plan, map, detailed layout, government clearance, overbridge approval )etc within 24 hrs.Don't pay a SINGLE PENNY to the builder till thy d'nt dleit the trms that aren't acptabl to u.

Jst keep on askng DOCS & DLTNG unacceptale terms.

I have no personal grudge against ANSAL & Group or you, mr.rakesh kumar ... We booked the property because we liked it ...

But I felt duped that you repeatedly told us that you are a part of Ansal as "Sales Officer" to the firm. You should had made it very clear from the beginning that u r an agent ... As for mails I can't attach screen shots here - u give me a concerned person's name and address I will send print outs of all the mails sent by me and my husband, by registered post to the mentioned address.

I would also love to have a discussion over cold cup of tea with the admin people of Ansal, as that is what me and my husband had gone to do in Ansal's office. He listed to Mr. Vikas Jain that we are not in agreeable terms with the arrangement letter as the arrangement letter is totally one sided and is favoring the developer. .It is astonishing to note that your arrangement letter does not contain any clause showing the date of delivery which is completely unacceptable. By way of providing such one sided arrangement, we wanted a mutually agreeable terms to the investor and the developer. To which he reacted saying we have no other option but to sign the agreement letter provided, else the 20% payment made by us shall be forfeited- which amounts to a good 6, 50, 000/- - and unfortunately it is a BIG sum for us.

I just want justice be done and my money be safe ... y else wud I make all the hue and cry ... and if there are certain terms which are unacceptable to the investor company should work a mid way out!

Thank you sir for your revert and positive response.

I have sent a detailed letter to CREDAI and Ansal's office stating my disagreement with the t&c of arrangement letter sent by them. We are not making any further payments till the issue is resolved but I hope they pay some more attention to resolve it - as these people have sent the arrangement agreement only after the investors have paid 20% of the amount.

Banks too are not agreeing with the loan, terms & conditions are not favorable for the investor ... what does one do in such a case ...? As the developers are saying the entire sum shall be forfeited of agreement letter is not signed and handed over to them
I know that we will finally get our money back. But I wonder if there is a way to punish these people. These builders are making furtune by cheating middle class people. I am also one of the victims caught into ANSAL MEGAPOLIS project. False promises were made at the time of booking and "Agreement" was intentionally delayed until I paid them 2 installments. Thanks for sharing and making people aware. Big corporates like ANSAL are uing their name and taking advantage of good faith and trust a common man has about these companies. They made false promises to me at the time of booking and intentionally delayed the "Agreement" letter. Please refer my complain below-

Ask bulder to put exact Dt. of strt. of yur flat.& Dt.of psion.

Hi Kanika and Arun,

I have also invested in Ansals Daffodils 3 years back and now i am regretting my decision to do so.We were the first set of customers who came to Ansals when they advertised about their project.

Being a brand name i trusted this brand but i have lost all hope from them.The project is not showing any progress till yet :(
I have made around 30% of the payment but now I am thinking of how to get it back from their clutches.The buyers are not coming in their projects and i know why would they the site is not at all a good place to invest :(

Kanika and Arun please do share the plan for taking our hard earned money back from them
