[Resolved]  BPTP Park Elite Floor — BPTP Cheating the Customer

I am also a victim of BPTP Park Elite floor. They have increased the area of 180 Sq yards unit from 876 sqft to 1047 sqft and increased the BSP by 171*2425= Rs 414675 and send a demand. I have asked them the justification of new area and new floor plan, layout approved as per HUDA norms. They simply refused to provide them ans said u have signed addendum in which it is mentioned what are the things included in super builtup area. But there should be a maximum limit, a proportion to built up area. This 20% increase in area is excessive and they charged this area with current market rate i.e. Rs2425/- ( not that rate Rs 1835 at which we booked our unit in june2009).Generally builder increase the price upto 5-10% only at the time of possession.

BPTP has planned to charge extra on the basis of increased area(which is not in actual)because of the premium on the project.BPTP wants to encash all the premium from their innocent customer to bring the project at par with market rate. I am sending them legal notice as discussed with a lawyer and filing a case in consumer court if no reply is received from BPTP. I would request all o[censored] to unite together and not to make any payment against the unjustified demand of BPTP. BPTP did the same thing in their Freedom Park colony at Gurgoan but exposed by allottee through media(AAJTAK) and RTI Act. See video clipping on you tube. We can also follow the same route if no proper reply is received from BPTP.

Please visit www.myfaridabad.in forum under topic "BPTP cheating the customer" for more detail about the cheating done by BPTP. No authority is taking any action against the builder.
First of all, I congratulate for creating hype and now on Google, "BPTP Cheating" has become buzzword and also, some Internet portals like FaridabadMetro have already covered BPTP Cheating.

For legal case, I have read each and every clause of BPTP agreement in detail (I was planning to buy BPTP elite floors/BPTP elite premium in 2009, but after reading agreement, I decided to stop payment on my cheque paid to BPTP !). I believe BPTP agreement is the harshest buyers' agreement that I have ever seen (I have studied 10-15 buyers' agreement) and gives full independece to BPTP for doing anything they want. So, I think it will be extremely difficult to win legal battle against them.

So, what I think is that ONLY way of stopping BPTP for going ahead with cheating is to impact their sales of new and existing projects by giving them bad name in market. You have already done this on Internet. Impact them physically also and that is most important. It may be done by :

1. Going on weekends with hundreds of cars and roaming around their new and existing projects with big banners like "BPTP is Cheat. Don't buy anything" posted on back of car. May be some cars can be stationed on both the bridges connecting Neharpar

2. Sit on hunger strike in turns in front of DC office on all weekdays. That will give coverage in print and TV media and that in turn will pressurize DC to do something.

Once BPTP has raised the demand on account of increase in area, the customer has every right at ask for justification of increase, which bptp is not providing.Another surprising thing is that at the time of signing the addeddunwe have paid upto completion of all the structural work and only instalment left at that time was
(1) Completion of brick work
(2) Completion of flooring.
(3) At the time of possession.
and still no indication of increase in area has been given at that time also.
I am also the victim of this undue demand raised by BPTP.

This is the greatest cheating. I thing this is equally important to make a strict law as now a days is the demand of LOKPAL.All the conditions and prices should be written in the agreement at the time of signing and builders should not be allowed to increase rate after initial agreement.

request ANNA HAZARE ji to include this point in LOKPAL to save the community against the terrorism of builders.

I agree that BPTP demand is not justified and the Super area increase at this stage is unjustified as how can the area increase now when the structure has been constructed some 9 months back.

I am in agreement with you that they are unjustified in their demand. My apprehension is how will we prove that the area increase is not justified. I have received reply to my query that they have verified the area increase from HUDA approved validator.

I am also a victim of BPTP Park Elite floor. They have increased the area of 180 Sq yards unit, from 876 sqft to 1061 sqft and increased the BSP by 185*2425= Rs 448625 and sent a demand letter. we should unite unite together make a forum and should move to the court against the one sided decision of the company.
BPTP has clearly emerged as a ruthless, unfair entity, cheating customers intentionally.
The increase in area is a pre-mediated step, taken to cheat customers. Here's what they've done:
Taken more than 35% of the BSP from customers
Then made customers wait for 3 years with no update on the allotment
Cunningly increased area by almost 20% and are demanding increased rates for this increased area

The consumers are now left with no choice except to pay through their noses for the extra area which they never asked for, after waiting for 3 years to realize their dream of a house.

We must get together, and reach out to Aaj Tak, and other media channels to expose this
I am thinking of paying the payment of increased area which they have demanded. It is clearly mentioned in the Agreement that any default and allotment will be canceled. If we file a case against them then I think they have a strong point as we have signed the agreement.
I am also victim of BPTP undue demand raised. From the beginning BPTP is start cheating with their buyer.
they asked for CMC without prior info, still possession date is not conform. they change total interior map and reduce the size of room and balcony. Now they are asking for Rs.448625/-. Dreams of Apna Asiyana is shattered by a builder who is highly politically connected.
1.BPTP a Delhi based builder opened booking for Independent floor project named Elite Floor,
Located at sector -85 Faridabad, during recession period of 2009.

2.Initially BPTP had planned few hundred floor to be booked, but due to attractive price, they got over blaming response and overbooked 5 to seven times from initial plan.
There is fundamental question that can BPTP book any project without map or layout approval
From HUDA/DPT, If They had, how was HUDA/DPT approved the project Elite Floor, Which was
Initial Planed for only few hundred floor.

3.After almost 2 year passed, thousand of customer didn’t get their floor.

4.Rest of people got their floor after 6 month of their booking by a draw, process of said draw
Only known to BPTP .

5.They have allotted floors in all sectors which is against the initial plan mentioned in the project
Brochure .

6.After almost one year past they imposed fresh PLC charges which are not mentioned in
Application form and raised nearly 50 to 100 cr.

7.They forced every investor/end users to sign one sided agreement and amendment and affidavit with threatening letter to sign otherwise we will cancel our floor.

8.After almost two year passed, they increased the area of floor without increasing a single
Sq ft in original plan pasted on agreement. Even construction o[censored]nit is not complete. again with threatening letter, pay or otherwise will cancel our floor. As BPTP now realized that reality market condition has improved and want to robbed as much as money from park Elite customer. By this Demand, they can easily robbed as much as 200 to 300 crore. Is BPTP is so strong can loot this 200 to 300 cr with out having govt /or any political pull.

I have some fundamental question.

1.Is any construction company can book or start construction without approval from govt authority, Who is responsible to plan and maintain the said City/town?

2.Is any company denied our fundamental right to protest for injustice?

3.There is no control of public dealing?

4.Can we forced to sign one sided agreement?

5.Can any service provider increased cost of service by 50% as agreed initially?

6.Is reality sector will not be regulate to get rid of this type of mafia?

7.Is not necessary to mention every cost to application form or project brochure?

8.Is flat buyer agreement should not protect both parties?

9.Is there is no way to tackle this type o[censored]nethical and blackmailing business practices?

10.Is there be any accountability of real estate counsultants.

I know some of Park Elite floor customer raised this question with BPTP management and fought for the
Cause. But in the end they have justified their interest only. But this is absolute right that not every person is Anna, why any body fight for others.

I don’t know, how much we will success, but we should do some Dharana Protest in front of BPTP corporate office, because we had forget our fundamental right to protest for injustice but we all are woke up by Anna from a deep sleep. I am ready any day/time.

I am also victim of BPTP after three years he demand me interest while he give allotment letter after three years in the fist term my name was not in the fit allotment, btp senior executive told me that if submit your's loansanctined letter you wil not have to pay any interest then i apply for home loan from lic and providee to them my sanctionedd letter but bptp not able to give me allotment letter then my loan has been cancelled by lic after three years they give me allotment letter i again aply for loan and provide to them loan sanctionedd letter but bptp not able to providee to me tpt agreeement and other papers which i've to providee my banker for disbursement the loan two time cancel my sanctioned loan due to them but know bptp demand interest approx (96000) to me again and again know i want to file my complaint in the consumer court against them, I thing we should unit and i'm als agree with mr. samer agarwal we should do something
