I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. This is not the misleading by BPTP, your dealer did not tell you the truth. Even it seems that you did go through the terms & conditions as well payment plan before making booking. In application form, It is clearly mentioned that you have to pay 25% of BSP before allotment. (2 lakhs as booking token and 25% - 2 lakh in first installment).As per your post you have already paid booking amount and first installmentSo there is not point for worry.Now BPTP will demand next installment after allotment only and before this allotment they will be granted by all required approval from state government. Once allotment will come to you, all major financial institutions will try die hard to attain maximum number of customers. So this is my advise not to inquire anything about loan before time.Everything will be ok and as per your plan.
Now next installment will be demanded in Oct and allotment will be done by sep end.It may possible that you will not get much time for loan approval process because of last date barrier for your second installment. To avoid this problem all banks like PNB and LIC are preparing themselve well in advance.

In application form, nothing is like that they will allot it after paying 25% of BSP. And till now they did not received any approval on this project & they are going to demand for payment after 150 Days
I think both Nikhil & naveen are partially correct & partially wrong.First 2 instalments are O.K. But third installment is construction linked. that they should not demand. secondly it was never told that floors will be overbooked & will be given by lottery. according to them whoever has booked will get the flat. Draw will be only for Floors choice.
Thirdly at the time of booking it was told it will be ready by 2011. but now they are saying 2012. This is not at all fair. we should fight for it.

BPTP has really put us in trouble.Their project is not approved yet and they are giving the excuse of Elections in Haryana to the customers.Where were they from last 4-5 months when elections were not there? I have paid 2 installments and now the 3rd installment is sitting on my head beofore 23rd Oct.and none of the bank is finacing this project.Heard from LIC guys that their sanction letter are getting cancelled so even they are not funding anymore on this one.Last option is to check PNB, lets see .

The complaint against bptp is very genuine. By raising second demand notice without allotment/agreement they have proved that they are fraudester and indulged in unethical and mal practice. they are not a genuine company. Their credentials are at stake. They must cancell this demand notice and raised only after signing of agreement. Collection of money without agreement is also in violation of supreme court directives in a case title of which will be circulated in the group. So, they also legally wrong. They are posing as the application form which we have signed is only binding on us even if it is contrary to law. They must come up with a solution if they care about credibility in the market. NOW THEY ARE VOIDING THEIR WORDS AND ASKING FOR ANOTHER DEMAND OF 10% BY 23RD OCT.. IF ANY ONE OF YOU HAVE SAME, LOOK IN TO THAT DEMAND LETTER CAREFUULY ITS WRITTEN THAT UNIT WILL BE ALLOTTED TO WHOM, WHO WILL APY 35% OF PAYMENT. BUT AT THE TIME OF BOOKING THEY WERE SAYING THAT AFTER 25% OF PAYMNAT THEY WIL DO FLAT BUYER AGGREMNT.

I had words with nitesh and pawan. BPTP is really a third class builder. I have also booked a floor, first they changed my floor without intimating me, . they just called me and said that if you are willing to continure then change the location to premium and they charged more.
now they are cheating with their third demand for earlier bookings. they have done more than 5000 bookings for 900 flats and their executives are saying same in very honorable manner.
So my suggestion is to be on same page and file a case in high court against BPTP. as same unitech did and when bookins team filed case they gave them money or flat option with interest.

I ahve also booked a floor in park Elote and after reading these all comments I had words with one of my frd having flat in PArk Grendura of BPTP. there they are not doing TPA, which is mandatory for bank loan. So in this case, even we will pay third installment too, we may face some problem. I feel nikhil's information is correct. We should try to contact HUDA faridabad. or have to rush for POLICE.
