[Resolved]  BPTP Park Elite Floors Faridabad — FRAUD BY BPTP

I HAVE BOOKED ONE FLOOR IN BPTP PARK ELITE FLOORS, NEHAR PAR AREA, FARIDABAD, HARYANA AT A COST OF RS.16.08 LAKHS WHICH IS TO BE PAID IN INSTALLMENTS. THIS IS A CONSTRUCTION LINKED PAYMENT PLAN. I WAS TOLD BY THE DEALER THAT I JUST HAVE TO PAY THE BOOKING AMOUNT (RS.2 LAKHS, NON REFUNDABLE) AND THAT REST OF THE AMOUNT IS TO BE PAID IN INSTALLMENTS WHICH WILL BE EASILY FINANCED BY BANKS. NOW THE PROBLEM IS THAT NONE OF THE BANKS OR FINANCIAL INSTITUTIONS ARE GOING TO ADVANCE ANY HOME LOAN ON THE PROJECT BCOZ THE PROJECT HAS NOT BEEN APPROVED BY THE HARYANA GOVT. THE COMPANY HAS OVERSUBSCRIBED ITS BOOKING BY ABOUT 10-20 TIMES, A ROUGH ESTIMATE IS THAT FOR ONLY 800 ODD FLATS, THE COMPANY HAS BOOKED ABOUT 4000+ APPLICATIONS AND IS ASKING FOR PAYMENTS AS SCHEDULED. EVEN I HAVE PAID THE 1ST INSTALLMENT OF RS.2.02 LAKHS FROM MY OWN POCKET. NOW THE BANKS ARE NOT FINANCING THIS PROJECT AS IT IS NOT APPROVED. THE COMPANY DOES NOT HAVE THE LICENCE FOR ITS CONSTRUCTION. IF I DON'T PAY THE NEXT INSTALLMENT WHICH WILL BE DUE IN ANOTHER 60 DAYS. THE COMPANY WILL CANCEL MY BOOKING AND WILL GIVE ME BACK THE AMOUNT OF ISNTALMENT PAID MINUS THE BOOKING AMOUNT. IS IT POSSIBLE TO TAKE THE COMPANY TO THE CONSUMER COURT AND GET MY MONEY BACK. i have alsobooked a ground floor in BPTP park elite- sector 85 in the begining of the project launched by BPTP.
some how i was able to manage the 35% payment to BPTP. yeterday i talked to BPTP customer care, they ensured the allotment in last week of novemeber-09 anywhere in park land sectors not in in sec-85.

I have also booked the flat and while booking my knowledgeable friends warn me of booking a flat on pre launch basis. At that time, I did not pay much attention and always thought that it is the right time to purchase the property at such a reasonable price. Fortunately I did not rely on the home loan to purchase this property but also sympathies with people who would have envisaged to purchased the property through loan. This is clear fraud case, and government should do something so that builders can not make fool to the public at large. I still believe that we all will get the flats. We have to think positive and let the rest leave to the god.

Can any one tell me the final status of allotement and which nabk going to finance? I have already paid 35% of BSP.. DON'T KNOW WHAT WILL HAPPEN...

One more thing...can I get refund from BPTP? if yes, what is the procedure? Please halp me..

Why do u want to get refund? In another few days you would get allotment.
is there any update. whether we will get our dream house. Had spoken with one of the broker according to him if we sell it today we will not get any premium even the discount given by the broker will also be absorb. the broker was also telling that some of the flats would be alloted too far from the proposed location which can even make the flat go on discount. Dont konw what to do have already invested 35% and dreamt about the house, looking like we have been cheated let us see whether they stand with their promise of alloting in November which looks to me highly unlikely
This project till not get approved by authority but BPTP said it will done by this week.

Just hope and believe miracle do happen. it seems they will not be able to process the file this week also. Wait is getting longer my dear it is just that the file has not be process then allotment will take place, where we will get the flat that is also not sure and then it will be that what kind of interior are being put is also matter of curiosity. All in all we are being taken as granted and left on us to curse the day when we would have invested in this property. it is better to invest in a build up property then investing in construction linked property.
Any updates? Did anybody talk to BPTP customer care or higher authority for this regards?

I asked BPTP yesterday. Status is same. They are saying they will alot after getting approval from HUDA about their scheme.
Are they telling why there has been a delay in getting the sanction from HUDA. BPTP is not a small time builder and at least in Faridabad it is the best. If this is the way the best builder treat its customers, then I have my serious doubts how others builders are managing. We all are on the mercy of BPTP and I lost some investment opportunity. The wait is getting longer and I am feeling cheated. Not sure what will happen at a later stage, but hoping against the hope. There was a news that BPTP is coming out with IPO so they can not take a risk of not completing the construcgtion since it will not augur well for them at the time of IPO. So hope they go for IPO and complete the costruction.
can't we take a action? Atleast BPTP can tell us the clear picture. Now they don't even talk about Elite floors. Really we lost some investment opportunity.
I suppose BPTP has made bookings much more than actual number of floors, so it is finding ways to get out of this mess.
The same thing happend incase of JP Greens AMAN, noida project. But in that case, JP returned all amount (i.e. booking amt) along with 12% interest.
Please try to fetch real picture abt the delay.
Atleast they can provide PROVISIONAL allotment letter, if not original.

I have also booked 250 Sqyrds in BPTP. Still no infromation about the allotment of this. I called them today. they said it would be done in Nov end. so let see till 30th Nov. same statement they have given earlier as well. that this monath.. and so and so.. but nothing to say untill we will not get that allotment in our hand. As communicated earlier, this month there wont be any allotment since tomarrow is the last day of November. I was watching today a programme in the CNBC, and they were talking about the defaulting builders and remedy available with the consumers.One of the prominent lawyer was suggesting that if the builder does not give the possession on time or dont allot the property on time a action may be taken against them under conumer protection act. He was also citing a recent judement under which the consumer was not only paid the amount paid to the builder but was compensated on the basis of the market rate. This at least shows ray of hope in case things does not work out. I will wait until December and take a decision on going about to consumer court and will fight till i get the justice. Before that to complete the documens we should also write to customer care at BPTP to ensure that they give us in writing the day of allotment which we can produce before the court in case their is no time limit given in the agreement for the allotment. However, I peronally feel that we should give some time to BPTP since we may be nearing getting the allotment and the builder can redeem hiself by delivering the promise. BPTP is not a night flying builder and at least in Faridabad is number one. They would not like to harm their image moreover they have 1500 acres of land in the park land and this is the intial stages of the development which will ensure that at a later stage when the development take place the propoerty prices shoots up on account of increase in the infrastructure and basic amenities. So more than us, BPTP would like to complete the project to ensure that they dont have the bad name in the market and they can cash on the current development at a later stage. So all in all, I still belive that the constructin would take place and BPTP would deliver its promise.

Just today I got chance to talk to BPTP Customer care (Phone - [protected] extn 3020/3011/3006). They are telling that they are working on allotment process only and in next few days they will send allotment letter before raising the next demand. DON’T KNOW WHAT IS TRUTH???
Guys What we can do is file an RTI to HUDA asking the status of BPTP Elite Premium..what is the status of project in there records, has it been authorised or not or what stage is it in. HUDA has to reply it's a govt. body.

One more thing The conecitivity to BPTP bridge is as top speed especially BY Pass road, seems like they are serious.
