[Resolved]  builder Flat — Cheating and fraud

Subject: COMPLAINT/SOLUTION AGAINST BUILDER-S.K.JAIPURIA



Dear sir,

I am the poor resident/suferer of JAIPURIA SUNRISE GREENS-INDIRAPURAM,
GHAZIABAD, built by S.K.JAIPURIA of PEPSI & RAYMOND groups.

I booked 2BHK FLAT in 2004 and got possession in DEC 2007.

I was forced to take possession of semi-finished flats after getting threatening letters from the builder that the booking will be cancelled.

This project is still incomplete. There are 1100 flats.

I have paid 100% amount to the builder.

Builder is not providing basic amenities as promised, which are:

1. TWO LIFTS IN EACH BLOCK
There are 16 blocks and total 1100 flats in the society.Most of the times lifts are out of order. It's a 18 storey’s building society. Only one lift is installed in each block.

2. D.G.SETS FOR POWER BACK-UP.
Though, he has collected huge money, he is not in a mood to installed D.G.Sets of desired capacities. He is having 500 KVA D.G.SET (hired) which is underrated to meet peak load demand.

3. NO THREE TIER SECURITY
Builder has promised and charged money for three tire security but there is no security at all.

4. NO PARKING ALLOTMENT
Parking space is there but it is full of garbage, building material and no ventilation.

5. NO CLUB HOUSE, SWIMMING POOL, RESTAURANT, BANQUET, ETC.

6. NO FIRE FIGHTING SYSTEM IN OPERATION.

7. NO L.P.G.SYSTEM IN OPERATIONAL.

8. SAFETY & SECURITY ARE THE BIGGEST THREAT TO THE RESIDENTS.

Builder has collected huge money for D.G.SETS, FIRE FIGHTING, L.P.G.
PIPE LINES, VIEDO CONFERENCING SYSTEM AND OUT SIDE ELECTRIFICATION
@Rs 168/-sq ft, in addition to the cost of the flat.CAR PARKING CHARGES
@ I.F.M.S. are extra.

He has also collected SERVICE TAX (APR.Rs.75, 000/-from me), which is illegal.

We approached local Govt. administration & G.D.A. but failed of no avail.

Now, I would like to have your kind opinion on the above mentioned points.

For your kind information, we have registered RWA in our society. In the absence of basic amenities, we are not paying CAM (COMMON AREA MAINTENANCE CHARGES) as per the instruction of RWA.

At the time of booking, we agreed to pay CAM charges @ Rs 1/-sq. ft. Now he is sending bills @ Rs 2.42/-sq ft + S.[protected]@10.[protected]@

What should I do now? Builder not refunding SERVICE TAX and no action about any problem. I will die at any moment in the lift, or in the society premises from the goons of the builder.

Your sincere action/advice in the matter will be highly appreciated.

same problem is with all 1100 flat in the society
