Construction without setback

UNDER BBMP LIMIT, MY NEIGHBOUR HAVING B-KHATA IS CONSTRUCTING HIS COMMERCIAL APARTMENTS ALONGWITH SOME SHOPS IN THE GROUND FLOOR. HE CONSTRUCTED STAIRCASE PLATFORM IN SUCH A WAY THAT NO SETBACK IS LEFT. I APPREHEND THAT WHEN I SHALL CONSTRUCT MY HOUSE I WILL NOT GET ANY VENTILATION DESPITE LEAVING STANDARD SETBACK AS PER BBMP NORM. HE DOES NOT HAVE APPROVED PLAN FROM BBMP AS THIS IS B-KHATA PROPERTY. I AM VERY MUCH WORRIED.. PLEASE SUGGEST.
