[Resolved]  Co-Operative Housing Society — Maintenance charges

Hi,

I have bought a shop (150sq ft) in saki naka and given on rent. the society is charging me maint charges as 1200 Rs. Please let me know is there any rule for CAP on maintenance charges. It is not a posh society. can i bargain on maint charges, Should the maint charges to be the same for smiliar shop of same size. Can I get refund of these charges paid in past by myself.

Hello All..

I am a resident of Pune, My parents(NRI) own a flat in Mumbai (recently purchased, under a CHS), as i visit to Mumbai once in a 2-3 months I stay there. I have recieved a Maintainence Bill in the name of my Parents (joint) and previous owner of the flat.Following are my queries :-

1) Should the maintainence bill be paid (under the act) being the members are non resident or are supposed to pay at special rates on discussion with the members.
2) we earlier requested them (the society board/committee/some authorised people) that the name should be corrected in their records alas the bill mentions some other name(the previous owner), so can I hold the payment unless they rectify it.
3) Nomination form : is it in the virtue of them (the same meaning) to provide Nomination form to the new members or was it their courtesy to keep spare copies.

Personal — Maintenance charges

Dear Sir, Madam,

Recently I have purchased a new house in mahada colony, and not yet transfer in my name. I have one question, the society is considering me as tenant and taking the maintenance charges as if I am living on rental basis, is this correct or the society is doing injustice to me.
Pls advice, what should I do.

Bought a Flat — Maintenance expenses not transferred by builder

My name is Ashish, I have bought a flat from a builder in July 2009. It was the last flat with the builder, rest all was already sold and people were residing there from around 6-7 months. At the time of registration I have paid the maintenance charges for one year in advance, but afterwards our builder has charged the maintenance charges from me for those 6-7 months when no-body was residing in that flat and hasn’t transferred the excess amount to the society. Please advice what could I do?
I have a proper agreement of July 2009 where the builder has taken the advance maintenance.
in our society we have elected the managing committee but within a week secretary n chairman has resign the post within a week n then committee copt two associate members n appointed as a secretaryand chairman we many members are objected and ask for registrar approval for the post but then too they says the are legal n registrar dos!nt give the letter for approval because they are in legal post
does expansion of size of window require permission from municipal corporation

I wanted to ask that whether the co-op hsg society can accept the cash maintainance as per society bye-laws. If yes, under which law or if no, under which law.

I have a flat in Pune The society is registered, collecting monthly maintence charges regularly.On adhoc basis how much they can collect the charges for additional repairs, Last year they have raised Rs.7000/- This year they are compelling Rs.20000/- towards Lumpsum maintenance apart from regular monthly Rs.1000/- Is it as per rules or we should put complaint to Registrar of Co-Housing Society.Please advise me in the matter.

If members of society not paying the maintaince charges, from 8-10 months can we disconnect his water supply, as water from muncipal carporation comes in the main tank, from there it is been pumped to the overhead tank & the pump electricity charges is been paid thru maintaince charges.

Dear sir, i have 570 sq ft flat at ground floor and i pay RS.285/- maintenance per month, the secretary and chairman has told us extra others expenses i.e.painting, plaster, tank cleaning, drainage, pipe line repairing etc. will be beared equally by all flats, we have 19 Flats in our apartment. please give me suggestion there will be acceptable or Not also they put the sign on register please give me suggestion
i have purchased a shop paid stamp duty got deed registered, paid transfer & other charges to society. Before my name get transfered in share certificate society was taken over by adminisrator.
If i want to carry out water proofing & colour work in my shop can I do ?

The CHS/seceretory of the building does not co operate with other members of the society. There has been chronic water shortage since 3 months, she does not care and most of the time shes not at home.she does not repair the the pipes to check the problem.The members of the society want to take legal action against this, also they want to repair the pipe on their own expense NOW.
Can a member of the society or all the members of the societies come together and pay for the repairs NOW...and GET CREDIT later for the same from the CHS?
I am an Hon. secretary of Co-op. Housing Society, one of the member who is the owner of the Flat, but now he had made a Gift deed in which he has gifted flat to his wife. So i would like to know whether Transfer fees is to be taken from the member (normally Transfer fees charged by us is Rs.20000.00), If not what is the reason. Further Will share Certificate be transferred in the name of his wife. Awaiting for your reply
Just want to know how much does the society chrges for water comsumption in Naiguam dist thane.I gave my house on rent now the society is charging above 1000/-month.What are the water charges.I have never face this problem before now the new secretary is come and he is charging more.why.? can any one give me the right answer.
In my society, visitors parking not allowed, but rickshaws, private car, other vehicles also come inside in our colony
the society charge in my maintenance bill for rs. 150/- for my father in law has brought the car inside the colony.
my father in law staying another place and he came to give diwali gifts for my children. whithin 10 minutes he went out, but secretary saying that you park the car inside the colony so you have to pay penalty of Rs. 150/-
I ask him whether you have mentioned in managing committee that the charge will be 150/- or whether you have taken this topic in annual general meeting then give me copy.
he said that i am not giving you have to pay that charge. Ok you give me in writing that I am unable to give the xerox copy to you. He said that I am not giving you do whatever you want but you have to pay that penalty.

We are CHS in Thane having 16 flats of equal size plus two terrace flats of the same size with attached private terrace of the same size as flat area. There is also a common terrace. The Society in the year 1989 started with a monthly charge of Rs., 250 for all flats, . Additonally small levy of Rs.50 was charged for private terrace flat for the water usage as these people had at that time done a lot of private gardening and society was facing water problem.
After 22 years we are paying a monthly contribution of Rs.900. But the terrace flats continue to pay only Rs.50/- as terrace charges. In addition the two private terrace flats have constructed illegal rooms on the terrace. I am in the society only from 2002. Recently the Society carried out major work of repairs and painting, electrical rewiring, water pipes replacements etc. and incurred over Rs, .10 lakhs. They even repaired the private terrace, parapet walls etc. How is this expense to be apportioned. The terrace flat owners are not willing to pay anything anything extra for their flats than other normal flats. What is the remedy.
Can the builder charge maintenance charge to the flat owners, if the civil work is not completed and amenities are not yet ready and not got any safety approval etc..
I have a flat with adjacent private terrace, it is whose responsibilit to repair the private terrace.
