Co-operative Housing Society - Non-Payment of Maintenance dues by Members

I am a resident of a co-operative housing society of Andheri Mumbai. There are few members in my society who have not paid their dues which sum upto amount of over Rs 3, 00, 000.00. Neither the secretary seems instrested in taking any necessary action, nor any other members have raised any concerns. Can you guide me through the process of registering complaints against these defaulters as well as the secretary who fails to take any action.

Forced to pay Society Dues - My Housing society

My father bought a society flat in a dwarka ... I couldn't shift there due to some personal reasons ...It was lying vacant for 10 years ... Now We want to shift but the Society Management is asking us to pay society dues for 10years ..It doesn't matter we stayed in the flat or not .. We used society facilities or not .. We have to pay the dues ... They are asking for the amount of 1 lakh rupees ... Other wise they wont give NOC to the flat ... And we can not install electricity and water meter in the Flat ..
Is the justified ... ?We never stayed in that flat ... never used society facilities ... then Why we are forced to pay society dues ... How can we get the NOC for our flat ?

if i have given a letter to co-operative housing society secretary he did not give any reply to my letter with in 15 days any action taken on him.

i have came to know that if the secretary did not give any rply with in 15 days he has to pay 1000/- per day to the applicant.

is it correct can u give the details of that ammendement.

NON-MAINTENANCE OF MY HOUSING BUILDING - HOUSING FLAT

Dear sir/madam,
I have purchased new residential flat in Feb'08 from one of the builder of Virar, Dist-Thane which is in Mumbai suburban. I got posession in Feb'09. Before handing over flat to me, he took entire pending amount for it. After spending 2-3 months in flat i foung problems in tiles and walls. I repetedly complained same to the builder, but he only given assurance nothing else. Nw suggest me what should i do?
 

maintenance bill - society building

hi
im a student stayin on rent in Viman Pride, Viman Nagar,Pune.
after 2 years of staying in the flat for 2 years we are being asked to pay the society maintenance bill for 2 years. The broker did not mention this clause when we signed the deal. Are we supposed to pay the maintenance bill now?

Non-maintenance charges - Hsg Soc

Is the society entitled to charge interest on non-maintenance charges such as non-occupancy, an ad hoc collection, parking charges etc.
 

CO-OP HSG SOC SECRETARY CAN CONTINUE MORE THAN 5 YEAR - MEMBER OF CO-OP SOCIETY

One of the hsg sec told me that every 5 year co-op hsg soc need to change the secratary position, is that correct, would you pls confirm by-law
 
I am a resident of a co-operative housing society of Dadar (East) Mumbai. There is one member in my society who have not paid his dues which sum upto amount of over Rs 1, 00, 000/-. Society raised the bill with interest as per bylaws but defaulter is not giving any reponse. Can you guide me through the process of registering complaints against this defaulter
 
One of the member in our society is not staying in his Flat since last 15 years and maintance is due since then. Soceity does not have his contact details and there are no claimentaint.

Please advice.
 
Your have to follow the procedure for recovery of dues by filling the complaint with registrar of co operative society u/s 101 of maharashtra co op society act
 
In our society the owner of the flat give the POWER OF ATTORNEY to his releative
to live in his flat and owner is living at another place. We have charges more MAINTENCE CHARGES to the owner who has given his flat on RENTAL BASIS.
In above case can we charge more money (as per flat on rent) to that relative of that OWNER who is staying insted of owner by showing the POWER OF ATTORNEY to the Society

i am a resident of malad mumbai, one of our society member has sold his flat nearly before 20 years but the flat has not been transfer on the name of purchaser, purchaser is using the flat for his stock of catering business, purchaser is not paying a maintenance from last 10-15 years amount has crossed to 314000 Rs, society want to take some action against them, can society cut there water supply
please sugges
 
My father died a year ago and we(me, my mom and sis) were all dependant on him. we live in a co-operative society in Borivali and the maintenance due has reached over 50, 000/- and the society is threatening that they will remove us from the flat (owned by us). we are all scared and don't know what to do. please help.

Sub:- Majority Society Member’s objection on accepting Mr. Mario C Fortes issue

As you are aware, you’re appointed administrator Mr. D P Dohale have not come to our society office from last more than 20 days, so we are force to write to you.

On 20th March 2010 evening, Mr. Mario C Fortes (shop no -5) our society defaulter who have not paid his society maintenance for over last 2 yrs, called Mr. Thomas (one of our society member), informing water leakage in this shop, . In spite which Mr. Thomas visited his shop to make sure and informed Mario to call the appointed administrator (Dohale)

We majority society members undersigned, would like to oppose on any hearing given or society funds used for Mr. Mario C Fortes - shop No-5 (our society defaulter) by Dohale prior to clearing all his last 2 years society maintenances unconditionally.

We are also still awaiting your response//action on our 13th March 2010 letter.

Dear Mr. Mhaske

It’s been more than 17 days and there has been no action from your side on our letter dated 13/3/10. We sincerely fail to understand your ineffectiveness toward taking action on illegal act taken place during your administrator term; post your action in dissolving our committee and bringing in your administrator on basis of a society defaulter’s complaint.

The members of Chembur Neelkanth Apt. Cooperative Housing Society Ltd would like to know what penalty and action you have taken against Mr. Mario C Fortes (Shop – no 5) & Shop no – 12, who have entered in to unlawful activities during your administrator term & Mr. Dohale for the misuse of govt. power & authority.

Following are the illegal acts during your administrator tenure:-

1) Your action against Mario C Fortes (defaulter) for opening & renting his shop during administrator term:- As you are aware Mr. Mario is a society defaulter for not paying his society maintenance fees from last 2 yrs, and during our committee tenure we have resisted to rent his premises without clearing the society due’s. But during your administrator possession of our society, Mr. Mario (defaulter) has taken an opportunity to open and rent his shop to one of our society member shop no -12, which is a serious offense and a work of illegal act between Shop No 5, 12 & Dohale (administrator).

2) Your action against Dohale & Shop No – 12, for conspiracy and element of the illegal act: - During your administrator’s term - A defaulter is allowed to open and rent his shop which is against the law and Mr. Dohale has broken the law by misusing his govt. power & authority (vis- a vis A administrator job is to protect & make sure the society law is adheres) and also Shop No -12 owner, who intentionally entered in to an rental agreement with the society defaulter Mr. Mario’s (Shop No-5), which too being a factor of illegal act.

3) Your action against your administrator Mr Dohale for misusing society fund: - In spite of majority member’s disagreement Dohale has misused his power and solely, deceitfully released the society fund of Rs 19000/- towards the shop owner’s toilet grill (which was not required at all), which actually should have cost Rs. 7000 only. We would like you to instruct Mr. Dohale to payback the society fund from his personal money and compensate the same ASAP along with the bills of Rs. 19000/- which is not yet submitted to the society office by him.

4) Your action against administrators fees for conducting society election: - As you are aware, it’s been almost 4 months and the election process has not yet been started, for which primarily Mr. Dohale has been appointed, we would like you to instruct your administrator to immediately start the election and finish, which is a 30/45 days process and for which we will pay accordingly (I.e. for 30/45 days services only).

We were one of the most peaceful, happily operational, law abiding societies; post you’re appointed administrator, his act and encouragement of unlawful activities along with our society offender member’s - our society has become dreadful for living and we have lost faith in the department’s operation.

We request for your immediate action against owners of Shop No 5, 12 & Mr Dohale (administrator), failing which we will be forced to take these matters to the higher the system (As an e.g. How illegal activities are done and encouraged by the government department in the name of society law).

Interest on unpaid society dues - n/a

Is interest payable on society maintenance charges that are in arrears. And can the society charge compound interest on arrears. Thanks.

In my soc. there are two members have not paid amount more than 4, 00, 000INR. society already filed case, In my knowledge case in court is about 4 to 5 yrs. so far or more than that.advocate who is defending case for society is also society member, almost evry year society is paying him 25, 000INR. per year( this amount I am not sure, I heard), & now may be within 1 or 2 yrs of span society is deciding to develop tower .members who are not paying to society are living lavishly, developing there property on other premises, they have money to buy car, scoter.
can some body guide me to help my society( & to my society's advocate who is only asking dates from court for one & another reason.) to make them pay all dues. If somebody is there to help me I will provide more specific details about them( that two members & advocate also)
