[Resolved]  Ferrous Infrastructure Pvt. ltd. — Cheating & Fraud

I have a booked 3 BHK Flat in Faridabad sector- 89 with M/s ferrous Infrastrcuture Pvt. Ltd.1 st floor , Block -B, Vatika Tower , Golf Course Road, Sector-54, gurgaon.
I just say that this builder is failed on all aspect to earn investors confidence by manupulating the thing with poor management thing. This builder is trying to collect money by chaning demand letter and manupulating the things are as under :-

1) Collect fourth installment in advance. After seven months I have visited the site construction is not competed as per plan.
2) Collect Rs. 48112.00 extra in one installment by sending wrong demand letter to LIC Housing Finance without my consent , which is a Fraud. This shows that builder is in collusion with LIC -HF. I am requesting other department to check about the relationship of Ferrous with LIC HF.
3) Forcing me to pay for 5 KVA instead of 3 KVA (Generator Backup Chgs) as mentioned in the agreement min. 3 KVA Max 10 KVA. Other builder Like RPS , Piyush in faridabad taking 1.5 to 2 KVA for 3 bed room Flat. This Shows the intention of builder to collect extra money from investors.
4) Forcing to take Clum Membership as I have purchased a Flat not a club.
5) EDC & IDC is also high as compared to other builders of same area.
6) Send several Letter to the Builder but no reply received . This shows deficiency in service and poor management .

This is my big mistake to invest in M/s Ferrous Infrastrcuture Pvt Ltd. Investors Who have facing same problems kindly joint hands to recovery the undisclosed demands by the builders.

Copy of Letter written to Ferrous Infrastructure, till date no reply received are as under :-

Kindly refer to your revised demand letter dated 05Oct09 for Rs. 273,260/-, we understand from your office that LIC Housing Finance Ltd had released payment of Rs. 321,372/-, meaning excess payment of Rs. 48,112/-. Surprisingly, no receipt has come from your office for this installment payment.

Now, we received another demand letter dated 10/11/09 for Rs. 1,03,906/- thereby adjusting the excess payment in interest and open car parking changed to covered car parking without our consent. On informing this mistake to your office, they have revised the demand once again and sent new demand letter dated 20/11/2009 for Rs 66,406/- and changing the interest charges to Rs. 15,678/-.

I protest to pay the interest amount on the grounds that from last three installment payments, your demand letter shows incorrect amount and we have to persue with your office for corrections, which normally takes long time as your staff always claim that they have to take your permission and you seems to be always busy. For example, the latest demand letter dated 10/11/09 was wrong and it took 10 days to correct the same. The revised demand letter was dated 20/11/09 received on 26/11/09. So, most of time is wasted in getting the demand letters rectified.

Moreover, it is also seen that the demand letters are manipulated as per your convenience and interest. For instance, the latest demand letter shows covered car parking whereas the earlier demand letter was showing open car parking. Moreover, you have charged interest of Rs. 15,678/- without giving valid reasons and calculations for the same. I protest to pay the interest as the due date for payment should be extended likewise if there is mistake in your demand letter and it takes several days to get them corrected from your office every time.

Moreover, you have collected the installment cheque directly from LIC Housing Finance office without our consent and have not informed about excess payment received. We expected transparency from your office at least to inform about excess payment before depositing the cheque. Secondly, the interest should also be provided to us, on excess amount paid by LIC likewise.

In this regard please also refer to our earlier letters dated 16/07/09 & 01/08/2009, our installment payments are aligned with construction at the site, especially L tower. You have also collected installments beforehand on several occasions like 4th installment collected 7 months in advance.

We have also refused to accept club membership and power back up of 5KVA. Power back up of 3KVA is sufficient and we purchased a flat from you but not club membership and we should not be forced for the same. We have not received any reply from your side on mentioned complaints.

In view of above, I request you to urgently send revised demand letter with following amendments:-

1/ Remove Club membership
2/ Reduce power backup to 3KVA max.
3/ Reverse interest claimed in error
4/ Open Car parking instead of covered.

I assure you that on receipt of corrected demand letter, if any payment is due from our side, we will arrange for payment within 30days of receipt of such demand letter. Till then, I am unable to remit any further payment due to wrong demand from your side and in no way liable for any interest there upon for delay in replying from your side, which may please be noted.

Please revert urgently.

I booked a 200 sq yrd villa with Ferrous in Jan 2008 and paid 13 lacs. Till date I have received 3 different allotment letters since 2008 every time changing the site plan & villa location. In the mean time Ferrous have diverted the land of villa for Beverly Floors. So instead of 200sq yrd villa now floors are getting constructed because floors are more profitable to company now.

On my recent inquiry with Ferrous abut villa, they say they have no idea if 200 sq yrd villa would be constructed or not and where. When I ask them for money and interest they directly say they are not going to return money.

Dear Mr Manocha, you may be a lucky one satisfied with builder but we are all duped by this very builder. SO IF YOU DONOT KNOW ABUT THE BUILDER PL DONOT CANVASS FOR HIM - IT MAY TRAP OTHER UNSUSPECTING ONES.

Anyway option left for me to approach Court of Law and to file a complaint with Economic Offence Wing for the fraud

they seems to have deviated from their path. I have also started receiving letters for interest in late payment in 2009 that too was from LIC. So no idea what they are upto, nobody explains anything and seems unaware, one day one person will say that it was sent by mistake and the very other day the next person will say its delay in payment. totally ridiculous and nonsense. Guys will suggest you to for a group as their construction speek is also very slow and I doubt if they will be able to deliver by december 2012 forget 2011.

If you invested in Ferrous project but is not part of 'FerrousInfrastructure' Group in groups.yahoo.com, is requested to join that big group as well. This will help us to increase our strength and fight us for our common causes.
I visited Ferrous today and found work is going on though at a slow pace..But yes in 2 BHK they may start their possesion in next 1 qtr..They have completed few 2 BHK floor with all required things, viz, Tiles, Doors, paint etc..
I can upload those pics in Yahoo...

All is now just wait from HUDA end to develope that area, rest other things can be taken control..

With reference to your demands for the above flat from time to time, please note as following:

PAYMENTS MADE TILL DATE:

A sum of Rs. 2249404/- has been made till date, against a BSP of Rs.1897728.00 plus Rs. 589240.00 as additional charges & EDC/IDC, totaling to Rs. 2486968.00, less the following:

CLUB MEMBERSHIP:

In my previous communications to you, it has been prevailed upon you that the same has not been opted for, but till date a sum of Rs. 50000.00 is being shown as outstanding.

POWER BACKUP:

Power backup of 3 Kva has been asked for instead of 5 Kva offered by you.
A sum of Rs 50000.00 @ 25000.00 per Kva is being shown as outstanding in my account.

SERVICE TAX:

Provision for the same has been made in all payments made till date.
In the last payment of Rs Three Lacs, vide cheque no. 991462, dt 30.08.2011, a provision of RS. 30000.00 against Service Tax was made, as was duly informed to Sh. Pradeep Singh ([protected]).
The liability to deposit the same lies with you & the allottee cannot be penalized by way of interest or penalty on the same.

CAR PARKING:

In view of the judjement of the Hon’ble Supreme Court, delivered by Justices R M Lodha & A K Patnaik in November 2010, car parking charges cannot be levied by builders/promoters since these spaces are part of the “common areas” in flat complexes and not “salable independently as a flat or along with a flat”.
Cost of Rs. 75000.00 paid liable to be refunded immediately.

PENALTY CLAUSE:

As per clause 14, page 8 of the Flat Buyers Agreement, a penalty of Rs. 5.00 is liable to be paid by the builders in case possession is not handed over to the allottee beyond a period of 36 months from the start of construction.
Since the construction was started in January 2007, a late fee of Rs. 7060.00 per month is liable to be paid for a period of over & above 36 months from January 2007, (20 mths till date).

Sir, it is requested of your office to kindly look into the above & do the needful.

I have also booked 2 BHK flat in Ferrous City, Sector 89, Faridabad. & till date paid 21 lacs to the builder. my possession was due in last year june'11.

But when i have visited the site & found still the construction is pending, & as per the labour who work over there it will take another 2 year in completion.

i have taken loan from the LICHFL, Faridabad. Now to pay EMI & RENT is not possible at my end.

i have written mail to ferrous or try to call Mr. Amit Seth number of times but there was no response from their end.

Can any one tell me any thing about this consumer disputes and redressal forum at Kutub Institutional area.

Dear Sir,

I am a lady teacher and my Husband is a govt employee. Sir I am a victim of a Builder Ferrous Infrastructure Limited Regd Office Block B, 1st Floor, Vatika Tower, Golf Course Sector Road, GURGAON-122002, who with the help of Chawla properties(5R/1, Shop No 8/1, Beside HDFC Bank, NIIT, Faridabad) of Faridabad cheated me. They declared Pre Launch Offer about Ferrous City, Sector 89, Faridabad and shown me that we can get Flat at very less price, and M/S Ravindra Developers(307, I.P.Colony, Sector 30-33, Faridabad) through Chawla Properties promised to pay me 6% of the basic i.e.1550x 1400= Rs 1, 30, 200/- but they have given me only Rs 36850/- till date. Ferrous Infrastructure did not entered into agreement with me and forced me to deposit 2 more installments without sanctioning home loan and I have paid 40% of the total amount before entering into the agreement which was illegal but since at that time my husband was posted outside, I could not do anything, even they allotted my flat only after receiving 40% amount.
Building Plans were sanctioned by Town and Country Planning, Haryana Chandigarh on 29.02.2008 and only after that Builder entered with us in agreement. Builder Got Environmental Clearance on 1st April 2008.
I have paid the same by borrowing from my Father and friends. After that I have got my loan sanctioned from SBI but Ferrous Infrastructure refused to give the Land transfer papers to SBI and in spite of chasing my home loan was disapproved on this ground and Builder left us with no option but to take loan from LIC housing Finance, this institution was also involved in loan regarding purchase of land by Builder so Tie-up. They keep on charging interest for late payment by LIC, which LIC say administration delay. The interest charged by this way is illegal as I have no control over it.
Builder inspite of taking 40% amount from me before signing agreement, he cheated us by writing that He will construct the Group Housing Society in 36 m0nth s from date of start of Tower or date of signing Agreement which ever is later, which was not truth as work was started much early.
Now till date their is no sign of Handing over of Flat in sight for another 1 year, which is delayed for more than 1 year if we take 3 years from the date of agreement i.e. 2/5/2008.
Now builder has demanded enhanced External Development Charges (EDC) @ Rs 142/- per sqft i.e. Rs 200504/- vide HUDA notification no HUDA-CCF-Acctt-2011/17904 dated 25/05/2011 and 2012/8211 dated 05/03/2012. Now sir as per Agreement clause Builder will pay us mere Rs 5/- per Sqft panelty per month beyond 3 years, which means late possesion of flat is purely the fault of Builder as we could have paid the enhanced EDC if it is enhanced within 3 years of Agreement, Thus I am not at fault and not liable to pay this enhanced EDC.
But builder is threatening us to pay us before 26/06/2012 or he will charge interest @ 24 pa.and has send us notice dated 3/06/2012 recieved by me 13/06/2012.
So you are requested to please intervene and direct builder to charge this enhanced EDC from only those flat owners whose Date of Completion still not expires as per Agreement clause. Also please instruct Ravindra Developers/Chawla properties/ Ferrous Infrastructure to give me additional Rs 1, 30, 200/- (promised at the time of booking as incentive) including interest @ 24% pa.
Also Builder papers and site etc should be checked and investigated.

I feel we all should join hands against Ferrous Infrastructure.

No property dealer is interested in working with Ferrous.
They do not have any market value.
Their employees do not reponsd and appear always busy, infact reception has been told to say lies to people.
They are not honoring commitments made by their ex VPs in written.
Most of the builders are now earning a premium on their projects but Ferrous still don't have any market value.
People have put in their hard earned money but they don't even bother to respond to customer complaints.
Project is delay for about 2 years now and they are not talking about the delay penalty.

Please join hands and teach a lesson to this builder.

Ferrous People do not respond at all.
Reception has been told to tell lies to people.
they do not have send the account ledger statement for the last 4 years and suddendly they started to send the statement with interest.
they do not talk about the 2 years delay on project.
No dealer in the market is working for Ferrous, all other projects are now have big premiums but for Ferrous no market value.

Ferrous people are cheaters

I am one of the initial applicant for the housing project at its pre launch i.e. 19.03.2006 when the company had tied up with Triveni Group and I applied for the flat in its pre launch offer vide my application dated 08.03.2006

I was always in time for paying my dues up to Feb 2009 as per demand letters where as constructions were not as per terms and conditions during my visits to the site

It is also in place to mention here that the company was in habit of making false commitments to the customers as evident from the fact, that I had applied during pre launch offer and told the project will be completed within three years i.e. while applying I was told that the project will be completed by December 2009, whereas Till date I did not see any chances of the project completed in near future i.e. even after lapse of more than 6 years of launch of project

Buyer seller agreement was executed after lapse of nearly three years of my application and after 1 ½ years of allotment of flat and same was got executed after my great persuasions/request to the company.

I requested many a times to the company for furnishing me the documents required by my banker’s in order to get my loan approved/sanctioned from my bank but they failed to provide so and instead I was asked to take loan from LIC housing Finance as the company had some tie up with them.But LIC housing Finanace rejected my loan. so I again requested the company to provide papers immediately in order to get housing loan sanctioned from my own bank as I am also a banker but they did not provided these documents and instead put a condition that they will provide me documents only if I give them PDC for the payment due as per their reply which read as "As discused, we would like to know in how many days your loan will be sanctioned from your bank if provided the required documents, so that you could issue a PDC cheque against your outstanding payment"

It is also in place to mention here that the company without my consent had changed power backup from 3 KV to 5 KV, open car parking to Covered Car parking, Club Membership (not opted by me) that also shows that company is in habit of taking decisions unilaterally without seeking any consentt from its customer.

I had made payment on regular intervals as per demand letter till February 2009 and an amount of Rs. 1164150.00 (Rupees Eleven Lac Sixty four Thousand One Hundred Fifty only) which includes Rs. 9, 61, 170.00 i.e. 60% of BSP and Rs. 2, 02, 980.00 as IDC/EDC was made by me, thereafter I stopped making payments as company was not fulfiling its promises

How I can get my money back from these cheaters/fraudsters and how general public interest can be safeguarded from the clutches of these frauds

Hello I agree with all of you and i am on the same boat... We are in 2012 and still we have no signs when I will get my flat from Ferrous when we have already paid them almost 95 % of the amount... I have not paid them extra EDC charges as applicable as I have told them to adjust the same with the penalty clause while signing the agreement as the project is late infact delayed...

If you have some news please do share with us and I am okay to make consortrium against them

I am having an apartment in the Ferrous city project Naharpar Faridabad sec -89
I have been facing a lot of problems and payment issues with Ferrous Infra.
Firstly we were directed to LIC housing finance for the housing loan with whom they had an exclusive agreement.
We were told to get in touch with LIC …..to cut the long story short after losing our docs twice and a lot of follow ups our loan was sanctioned in about 2 yrs of time.
During this period we were constantly in touch with their marketing person
He assured us that the he will get the late payment interest waived off.
Then I we gave a hand written request for the waiver of interest which the marketing person assured will be put up in front of the management. We had asked him to sort out the matter and we were willing to clear our dues within 10 days.
Since then I have been constantly trying to get in touch with him but initially he avoided our calls and later stopped responding at all.
Presently I have received a demand letter which holds a big amount as interest.
We put in a request with the MD Mr. Ashish Seth thru email that we would like to sort the matter as soon as possible and meet him...but unfortunately the same marketing guy sent us a reply in a very dry reply saying that we either pay up or face allotment cancellation.
After numerous attempts then we had a word with One Mr. Vipin who is the Marketing Head...again the same result, he hardly listened to us.
He told us he cannot entertain verbal assurances..even if they were made by his own marketing people.

Please suggest how to go about it and sort this matter.

As per Agreement signed on 6.6.2008, it is mentioned at clause 14 that the possession of the flat will be given with in 36 months. In case it is not given, the company will pay Rs.5 per Sq.ft. The possession should have been given up to 5.6.2011 but till this day
it is not complete.

I also booked a 3 BHK Flat in Sector 89, Faridabad with Ferrous Infrastructure Pvt. Ltd. and above grievances are all true and without any exaggeration. <?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" />

I have so far made 92.5% payment and balance 7.5% is payable on possession. Committed possession date was Oct’10 and it is already January, 2015. Ferrous keeps on deferring possession date and now Company is promising possession by March, 2015. Recently Company sent me a letter dated 03.11.14 advising that

“As you are aware, the construction of the Tower, where your unit is situate, was completed long ago, however due to unavoidable force majeure circumstances, we have been unable to hand over the possession of the unit to you.”

And further that
“We have decided that in case you wish to proceed with the fitouts of your unit, then you may take your unit for the purpose of fitouts.”

Since then I have written letters dated 18.11.14 & 16.01.15 sent under Speed Post and also mails dated 25.11.14, 03.12.14, 17.12.14, 23.12.14, 29.12, 14, 05.01.15, 14.01.15 seeking their response on following :-

1. What is meant by ‘Fitouts’ as stated in your above letter.

2. Forced Majeure Circumstances” due to which Ferrous was unable to give possession and resultant period of delay caused by such Circumstances.

3. Whether Club House, Power House, Lift, Parking slots etc. are ready in Ferrous City.

4. Payment of compensation @ Rs.5/- per Sq. ft. w.e.f. Oct’10 till actual possession for the delay in possession as per Builder Buyer Agreement and as confirmed by Ferrous vide its mail dated 23.04.13 that compensation would be paid at the time of possession. Since Flat, as confirmed by Ferrous, is now ready for possession and delayed compensation is more than final installment due, request was made for sending demand notice for final payment after adjusting delayed compensation payable and making payment of the balance amount

Despite above follow-ups and telephonic calls, there is no response from company whatsoever.

It is wastage of time to expect this company to stand upto its commitment and this issue should now be taken up with Consumer Forum as has been done by one of our other friend Mr. Abhishek Vaidya (case numbers 116/2008 and 117/2008 in the Qutub Institutional Consumer Disputes Redressal Forum. - Customer code 2006/SI/36/330 and 2006/SI/36/332.). The court finally found them guilty of misrepresentation and duping us of money and ordered to pay 12% P.A. simple interest to Mr. Vaidya alongwith 1 Lac per party as litigation cost/mental agony.

I appeal to Ferrous management though this Forum to take note of our grievances and take remedial measures immediately failing which we shall be constrained to take matter to Consumer Forum for its logical solution. I urge upon my other friends also who have booked their Flat in Ferrous to get prepared for a legal fight in Consumer Court against Ferrous if the Company refuse to budge.

Dear friends, Ferrous Infrastructure has miserably failed in its committments. Not only the project is delayed they are asking for exorbitant interest rate at 24% with no further committment on delivery. We should take the cheats to courts
same happend in Dharuhera Sector 19 property but there is not post and complaint regarding this. In this era of social networking, why people are not meeting hands and going in court?
I am also the Owner of one of the Flats in Ferrous City 1 and we are also charged 24% interest rate for late payments, which we never did. I have always found the payment letters were delivered on back dates and the date to collect money was always a a max of 1 weeks and if there is a delay of 1-2 days also, they have put the Interest from the Date of the Back Date letter till now.

I really don;t know when we will get possession. I have already paid in the tune of 20 Lac+ Rs and still wondering what are the next steps.

Can we all create a whatsapp group and start meeting/discussing to pursue each of our Interest to get the Flats we had booked and in case we jointly move forward to purse our case in ConsumerCourts.
