[Resolved]  Gini & Jony — Breach of Contract for Franchise

I ( resident of Kanpur) was in search of franchise in retail ind. and came to know about Gini And Jony Ltd, that it is big Co. and they keep their words. So April 08 or so i came in contact with Mr. Vardan Sinha who sees all U.P, Matter was discussed and he told me deal will be final at Gurgaon Office by Mr. Puneet Tripathi (North Head). I went to Gurgaon Office and had a meeting with Mr. Puneet the points were finalized and deal was OK for East End Store, Wave Cinema, Lucknow and for a shop at Patrakarpuram, Gomti Nagar, Lko . So I shifted to Lucknow in July, admitted my son in a school in Indira Nagar and took a house on rent ( own house in Kanpur).
As per the deal the co. would renovate the East End Store and furnish the shop at Gomti Nagar ( the shop shown to me was not yet finalized with the owner) in a months time (which did not happen) IN Sep 08 the dark days( Pitrpaksh) started even the progress of renovation was Very SLOW and the shopowner of Gomti Nagar denied and gave the shop to other co saying Gini & Jony people just talk and are not good in promises.Date of opening was final on 1st Oct 08, cards printed but there carpenter ran away lending money frm me saying co .has not paid me for the shops earlier made by him and only promises made.I myself took over and any how partially completed and opened the shop on 9th Oct 08 . Mr. Vardan Sinha said all money spent for fininshing the shop will be paid by Co.
My first shock was when i got a notice from Wave Cinema Management to pay the Dues or the services provided by them will be cut off. I talked to Mr.Vardan Sinha, he said send the copy to Gurgaon Office and the payments will be clearede by the Co . before last date(25th Oct 08) nothing happened and my Shop's electricity was cut off in peak business days 26th Oct was Dhanteras . called Mr Vardan, he called Gurgaon office from there to head office Mumbai and they showd scaned copies of Cheques to be sent to mall management and electricity was continued next day but the scaned cheques shown never arrived to Lko .
My second shock again electricity was cut off on 11th Nov 08 . My anger was in extreme and i talked to all senior persons in Gurgaon & Mumbai office, part payment was sent and it was said to me to stay calm as this was routine way to put pressure on management to cut off rent rates( which were to be paid by Co.) .I said OK do as u wish but give me the daily expenses occurred by the shop and not profit for the days the sale of shop has to suffer but ther was NO answer for the same along with these problems no money was sent to me for expenses done by me on renovation for which i daily sent mails to Co.
Third and final again electric was cut off on 26th Nov 08 and too my extreme i again called Mr Vardan and he suggested me to give the keys of the shop so that he could give pressure to Co. that the franchise has said first clear all dues and all balance problems to be sort out then only he will take over.( this was preplanned by all ) I came under his words and gave the keys not knowing his intention .
Nothing happened from 1st Dec 08 onwards my staff along with the Co. staff were running the store and my contact with Co was on e-mail ' from which i came to know that MD of Co Mr Prakash Lakhani is arriving to Lko on 2nd Jan 09 to sort out the problems.
The day arrived i was also happy that lastly all problems will vanish and i will run my business peacefully . My Dreams banged as balloon is punctured he arrived in late hours at the time shop shuts down at 10 pm ( This was also planned by Mr Vardan & Mr Puneet) . He was first taken to Kanpur so that he wont have time to talk to me till then they gave a negative feedback of me.
Mr. Prakash Lakhani said to come to the hotel we will talk there ( my staff also wanted to talk to him) . I went to the hotel and the decision was pre-decided . I was told to leave the shop and open another shop where ever you like .
Can anyone tell them i left my hometown Kanpur for this business . Shifting is not Easy
PLZ someone suggest what to do as i am still sitting idle without business. I have all details along with photos against the Co.
