[Resolved]  House — NOC from society

I am a resident of Navi Mumbai. My husband and I jointly own another flat in Navi Mumbai. Now we wish to sell it. My husband works abroad, hence he has given me a Notarised Power of Attorney.

For selling the house we need an NOC from the society. But the society has refused our request. They say that the Power of Attorney needs to be registered.

When we argued that a notarised Power of Attorney is more than sufficient, they are now asking for the clause in the law that states this. Even our advocate says that a notarised Power of Attorner is not needed.

Are we wrong on our part? If not, then does anyone state the clause which says so?

Sub.: NOC required from Society for Home loan in bank format

We have purchased a flat in Krishnanagar sector 20, jagdmba hsg chinchwad pune. I applied for the housing loan to Deewan Housing Finanace Co Ltd and the loan amount is approved. For disbursing the loan, the bank needsNOC in own format from the Society. I have applied to the society requesting them for the NOC. They are not co-operating with us in giving this NOC and on the contrary the Secretary told us that in the past they have not given such NOC and they wont give it to any one in the future as well.

I want to know whether Society NOC is compulsory for home loan and if so what action can I take against the Secretary and Chairman of the Society.

I request your help in this regard urgently.

We have purchased a flat in Krishnanagar sector 20, Jagdmba hsg chinchwad Pune.
This is resale flat . We are completed sale deed agreement. This is 3 rd transaction for the same flat. 1st owner was purchased directly from Pradhikaran. That time article of agreement made between Pradhikaran and owner . 2nd party took the flat., doing all legal formalities. Then we purchased from 2nd owner.
Submit to the bank with Transfer deed & convenes Deed of 2nd owner. But owner is not given his original sale deed to us. after discussion had with owner we understand that deed is misplaced.& 1st owner article of agreement was return to pradhikaran during the 2nd owner transfer formalities.
I applied for the housing loan to Deewan Housing Finanace Co Ltd and the loan amount is approved. For disbursing the loan. Bank asking for the original sale deed of another 2 parties. but we haven’t original deed papers,
So what we do in this case. Can we arrange all documents from Pradhikaran? This will be accepted to the bank ?
