[Resolved]  HSBC Personal Loan — Harassement

Hello,

This is in reference to the letter dated 22/01/2010 issued in favour of account # 000000003035943434872 for an overdue payment of INR 19,956.00.
Name on Account: Sunil Kanodia

Can you please make an effort to explain me how a post dated cheque already issued in favour of HSBC bank and in HSBC's possession be overdue? Since the cheque is already with HSBC, why did your officials not deposit the cheque in time?

I have received numerous number of calls asking me to send a cheque of the above mentioned amount since it seems that there is an overwriting/misspelling issue in the previous cheque issued by me. Can you please explain how did HSBC make a decision on this rather than depositing the cheque and letting my bank(State Bank Of Indore) take the decision whether the cheque would be cleared or not? What is the reason behind not sending my original cheque and asking for another cheque? Why is it not possible for an international bank like HSBC to send me a VOID copy of the cheque back to me and take the new cheque?

Also, even if the cheque has a spelling mistake why did HSBC not deposit the cheque when I clearly mentioned to all the representatives I have spoken with in the last 10 days spending more than 16 hours of my time that any charges that may incur if my cheque were to bounce would be solely my responsibility? How difficult is it for your representatives to understand such clear instructions and stop harassing a customer who has been continuously making payment for more than 2 years without any bad credit history? Also, when your agent took the cheques from me 2 years back why didn't they make a complete survey of the cheques making sure that they were clean from any mistakes?

I have included CIBIL in this email communication to maintain a record with them as per your mention in the letter about my credit history being emailed to them.

Please revert back with appropriate answers helping me understand HSBC's policy in this matter. I would again suggest you to deposit my cheque # 723566 drawn on State Bank Of Indore and let them take the decision whether the cheque has any issue or not. If this is not possible then send me the original cheque or a void copy of the cheque to obtain a new cheque from me. Also please make a note that I won't be liable to make any late payment charges if you fail to reply in time since if the cheques are in HSBC's custody it is your responsibility to deposit them in time.

If I am still harassed by your representatives, I would be forced to file a lawsuit against HSBC to protect my human rights.
