Dear Sir,
Subject : violations by owner of house no.1299 Sec-45
This is in continuation to our previous letters regarding illegal Construction which is NOT SANCTIONED in the MAP by House No. 1299, Sector-45, Gurgaon.
We have already communicated that he has constructed First Floor and Second Floor + Parapet Wall on our Rear Balcony Wall, which is highly objectionable.
A)** For doing violations he had dug my foundations excessively for making his basement forcefully not according to sanctioned plan. They damaged our foundations in the front and rear courtyard as rainwater created big holes because of excess digging .We are sending you photographs of the damaged portions .this is because of negligence of plot owner of 1299 sector 45(as excess digging checked by officers, violations were declared in the plot by them )
1) My basement was filled with water and wooden boards and items in the basement had softened due to water seepage.
2) The underground pipelines and rain harvesting got damaged in my rear and front courtyard.
3) Cracks have developed in Kota flooring because of cavities developed underground due to excessive flow of water into our foundations.
4) As we informed you before also .sending you some photographs and previous letters
B)**Even he is careless about the plinth level of their floors, he has taken the plinth level / floor level higher than our floors .his basement roof is 1.5 ft. higher than ours , his ground floor roof is 10 to 11 inch higher from our ground floor roof .
Dampness from the neighbor floor will enter the wall. The problem of dampness will become a permanent headache one day for our house.
C) **As per RTI norms of HUDA (Copy enclosed for reference) no body is allowed to construct more than 1 Meter Vertical wall /Railing on Balcony.
Now he has constructed Vertical Wall for Two Floors (First Floor and Second Floor) + Parapet (9 Inches wall) on this Balcony. By doing so he has violated the HUDA (RTI) Norms.
Apart from violation of Law – it is a threat to our Building Structure as Balcony is NON LOADING Structure and he has constructed a Load of TWO FLOORS on this .Tomorrow if some Accident happens because of this – who will be held responsible – Owner of H. No. 1299.
If we construct a Vertical Wall more than 1 Meter on our Balcony – it becomes a NON COMPOUNDABLE OFFENCE,
So if he does the same offence – it should be treated in the same manner as ours i.e. NON COMPOUNDABLE.
D) **He has not yet filled the sand in his rear courtyard which is posing as a threat to us as it can again harm our foundation due to rain and also when his workers water the walls the water seepage through the open holes can be seen on our walls.
E) **Our neighbor uses common wall using its strength and support. When we construct the basement the reinforcement wall (RCC side walls) in the common wall plays a necessary part, otherwise dampness takes place in the basement walls. The reinforcement in the common wall is counted as a part of the foundation. He hasn’t even constructed any pillar in the common wall to support it and he has also refused to share the expense done by us for reinforcement and pillars. As per the HUDA norms they are liable to pay a common share in all expenses of the common wall according to the sanction maps. THEN HOW CAN HE DENY IT?
F) **After making 1.5 ft. extra area in rear courtyard he has extended a 5 ft. balcony , can govt. allow us to construct a balcony of the same length in our rear courtyard {WITHOUT ANY OBJECTION}to maintain our privacy and uniformity of our house. If yes, then how we build it without support or without harming our existing structure .We request to HUDA to think of the uniformity of those who construct their houses as per the sanctioned map. Please think of those who have lost their peace tolerating aggression and misbehavior due to violations by violators. Thank You :Priya Dhawan
