[Resolved]  ICICI Bank — Unfair recovery practice ruined my peace of mind and life.

I need help. ICICI ruined my life two years back and they are still trying to harass me more. I am just copying the exact details of what my story is.

I am also attaching the content of the mail i received from RBI when I filed a complaint againt ICICI. I have written number of emails in December 2009 and they never gave me a straight forward reply now they are saying they got order from court to recover my car. I am not going to give it to them. I need help or I will commit suicide."

I had two personal loads and car loan from ICICI. I suggest you to read my complaints copied below. I need your legal advice. The Bank blocked my salary account three times. First time they blocked I paid 66k in May 08 then they blocked again in June and I paid 15k. I told them that I need sometime I will pay of the remaining amount and they blocked my account third time in Dec 08. This time I was forced to leave the job only because of ICICI and my salary account is still in block state only. I filed a complaint with RBI and in May 09. I received a reply from RBI with a copy of ICICI settlement letter which was never sent to me. Moreover If ICICI settled this case without my notice why the still have a lien on my salary account which is no longer used.



So In December 08 I was forced to quit my job because I salary was only 26K and I paid so much amount to them in past six months I took credit from others to pay this thought I will get everything on track in few months. Dec 08 was a worst period I went through mental torture by ICICI I wrote them number of mails through my ICICI account and they never responded or took action. I was also having a auto car loan and was not able to pay the amount from Dec 08 because I left my job as ICICI forced me to do so. Then after couple of months I got a job where the salary was very low and I didn’t paid a single money towards my car loan but for all these things ICICI is responsible.



The mental torture the bank and their managers have given me over the period of time now I don’t want to pay the car loan at all I want to file a complaint against the bank and get some compensation for the mental harassment trauma I went through in the past year and half. Please go through my case and suggest me how much compensation I should demand legally and what will be the procedure for all these things. I am not staying in Delhi, I took the loan from Delhi and need to know is it possible to file a case and teach them a lesson so that they will think twice before blocking any salary account in near future.



I even posted all these in different websites. My copies I sent to RBI. Please go through this case and suggest me the best step I went to mental trauma because of this bank for year and half and now I need compensation for all these harassments. And I want to make sure I will never pay the remaining auto loan to ICICI.

This mail is in regads to the conversation we had over the phone on

11th December'08. As you asked for a detailed mail with account

number and other things, I herby providing the same in this email.



I was haing a couple of personal loan account with ICICI previously. I

was undergoing some financial crisis and I was not able topay EMI as

the EMIs subjected to the saving account was not maintained by me

because of this financial crisis. I thought Iwill pay the entire money

and close the loan accounts once the financial condition get better.



I joined a job in Sutherland on April'08 and knew it very well that if

you have a loan account the bank will block my salary account. I was

positive to pay so I provided my correct information while opening the

account and the bank somehow traced my account they in the month of

may they blocked my salary account and was asked to pay the entire due

to get the lien removed. In May'08 the bank took 18650 rupees from my

salary account which was part of my salary for April'08 (21st May'08)

(I was only left with 2500 rupees of my salary to survive for the

entire month. Then they blocked some amount on my account which I

borrowed from someone and paid on 28th of May 18350 rupees. (Receipt

of cash payment on 28th May'08 - L[protected])

I knew I have some dues towards my car loan (Loan

A/C:LADEL[protected]) and I volunterily paid 29350 rupees cash on

28th May'08 (recepit no L[protected]). I have also given in written

that I will pay the remaining debts in couple of months. Finally my

salary account (A/C:[protected] was released but salary for that

month was not credited to my account so I requested for advance salary

and I received 18900 rupees as advance salary on 9th June'08. I

thought I will pay 6000 rupees towards my car loan account and that

the reason I kept that amount till the end of the month. But due to my

shift timings I was not able to visit the branch to make payments. I

once called ICICI customer care and tried to request to send someone

to my place to collect the money (Can be checked with bank call

records) but they told me that thsi will take five or more business

days.



In total I had paid around (18600+18350+[protected] rupees in the

month of May'08. My intensions are not to be a defaulter I am willing

to pay all my debts but the bank need to understand that I am a human

and I have my own expenses. If the bank blocks my salary or snatches

the salary ( i.e.my bread and butter) how will I survive in this new

place where I don't have relatives or friends. When I will not survive

i will either die or leave the job then how will the bank get the

remaining money from me.



Then in the month of July the bank blocked my account for 30K and I

had a discussion with Manish Singh (Manager incharge of my account)

and he told me that you have to pay the entire money but later he

agreed to part payment and then I paid 15K and promised to pay the

remaining afterwards. The transaction fo the 15K payment is copied

I told Mr. Manish Singh clearly that I have moved from Delhi and I

have all my luggage lying there and I am paying rent without staying

there so I need sometime and I will pay it later. Then I tookall my

luggage +my car from Delhi and it cost me 12K car+20K luggage = 32K. I

was still paying the autoloan emis regularly because I know if I don't

pay this the sum will be more and will be hard for me to pay. In the

month of October 08 I went to Mount Road branch in Chennai to pay part

of my dues for the laon account (LIDEL[protected]) but they told me

the account number is not valid and I came back checked the loan

account number and went again and then they informed the account is

available there must be some problem with the account number. I then

wrote an email to ICICI through internet banking stating the problem.

They asked me to go to ambatturr branch and pay the money. In the

month of november I went to ambattur branch and they said they will

accept the entire amt. due and not take part payment. I then came back

and thought to pay the money later on when I have some money as I have

some NSC maturing in March Last.



In December they again blocked my account and they put a debit of 30K

again. I got in touch with Manish and said him what all happened he

was not listening and said talk toJitendra ([protected]) ICICI

employe. I called him but he is not at all wiling to listen to me and

my problem. I told him that in November I went to Ambattur and this is

what happened and then I had 10K in my hand and I invested that and

took a house rent for myself. All this time from April I was staying

in Manision and friends house. How long one will stay in other's house

so I thought I will pay the bank in March and took a house. I have the

lease agreement done on Dec 03.



Right now I don't have money at all and I have to do Savings for TDS,

pay LIC premium or for next three months I will not have salary at

all. I was begging Mr. Manish and Jitendra to get the lien removed for

three months. I told him that I am ready to hand over my LIC original

documents also so that you can have faith that I will not run away and

I will work in Sutherland as I have invested 70K to bring my house and

get the luggage and car from Delhi. But he is not willing to listen.



Sir, My father has retired long back and I have to take care of my

family and I have to take care of my lodging and fooding I am staying

alone in Chennai. I have commiitments for TDS (very important for my

next couple of month's salary. If ICICI take my salary or even part

of my salary I will die.



I am begging you please don't snatch my life from me. I will pay in

March If think I will run away please let me know I will submit my LIC

documents policy worth 3.5L.



Please get the lien removed. I am not lying it will be a matter of

life and death for me. for the entire year I have paid 96+15K = 111K

+car installments 20K = 131K, I have invested 70K in house and getting

my luggage. 200K in total I don't want to get into worst condition so

that I have to commit suicide.



Please help me with great hope. (Please forgive the spelling and

This is to bring to your notice that I have been harrassed a lot by

ICICI bank loan division in the past few months. I am a loan consumer

of ICICI Bank I have taken four loans from ICICI in the past. One two

wheeler loan (Detail not available with me right now) all amount

cleared towards this loan account. Then I took a personal loan of

78000 rupees (Loan A/C: LPDEL[protected]) and one Auto loan (Loan

however managed to pay the installments for the car loan till

December'07 (with some skips). Then I got a good job in Chennai and

they block my salary account in the May and took 18650 rupees from my

salary account which was part of my salary for April'08 (21st May'08)

They did the same again they put a block of 30000 rupees on my acount

by the end of June and they snatched all my salary, I am again left

with 7600 rupees to survive for the entire month. I came to know that

Mr. Manish Jain (mobile: [protected]) has leaned my account for 30000

rupees for another Loan A/C:LIDEL[protected]. I tried to call him and

say that I will pay the money in two installments because I need money

to pay towards my car loan and other expenses. But he was not at all

listening to me. He said he will talk to me after sometime but never

picked my phone. I called him not less than 20 times all the time he

disconnected my call.



Please think that the bank took 96300 rupees from me in two months my

salary is 26000 rupees, I was running through tough time for one year

will I have money to eat, live work and pay the bank debt. I am not at

all in a condition to pay a single penny towards my car loan account

(Loan A/C:LADEL[protected]) under the current situation the bank has

left me with.



I am mentally harrassed like anything by the bank. If I was to be a

defaulter I wouldn't have paid any thing after the bank auto debited

my salary. I would have left this job and joined someother company. I

never did this I voluntarily paid money towards the car loan where the

bank didn't block any thing on my salary account towards my car loan.

Still the bank is not at all cooperating with me.



The only option left with me is to leave this job and go to my home

town. I want to file a case against all these harrassement of

snatching my bread and butter when I was willing to pay all my debts.

I will file a case for all these what the bank have given me when I

wanted to be loyal and if at any point of time I commit suicide the

bank and Manish Jain (mobile: [protected]) will be responsible and they

will be responsible for my family, my father has retired five years

back and he don't have any source of Income. I am the only earning

member of my family at this point of time.



I want you all to guide me what to do when I have paid so much still

the bank is not cooperating with my problem.



Yesterday, I called customer care of ICICI to file a complaint against

Manish Jain (mobile: [protected]) for not listening to me and behaving

in rude manner. I spoke to Mega More representative and she lodged a

complaint gave me a reference number SR71369679. Manish Jain along

with ICICI bank snatched all my happines and left me with tensions,

harrassment and tears. I am depressed don't have a way other than

suicide. In case I have to die I will make sure his happiness are

snatched from his life. He will be responsible with the bank for my

death.



Please help me I need help I am dying !!
