[Resolved]  IDEB TIVOLI — Cheating

IDEB has a project Whitefield in Bangalore called Tivoli...The project started in 2006 and the company (IDEB Parkway holding) have sold more than100 flats to people promising possession in 2007 and 2008.But the company has been delaying construction and even thgough all the buyershave paid more than 80% of the sale consideration, the construction and registration of the project is not underway.
Various public notices have been filed but the Company nor its MD - HS Bedi, have responded.The copany office, based in Sigma Tech Park, Bangalore, just has a few staff left and none of these people answer any of the questions posed by the buyers nor provide information on where the Directors like Bedi or Gajra can be contacted.
Legal Notices have gone unanswered,Just Dial numbers are always in the busy tone and even the project loans sactioned by banks like HDFC have been defaulted.
The builder - IDEB and Parkway- owned by HS Bedi and Gajra are still walking free trying to cheat more people despite complaints.This further points to a strong political and illegal nexus between various banks and statutory bodies which have choosen to keep quite .
This further points to the sad fact that the laws of the country are there only to protect rich and powerful while the common man gets easily cheated of their hard earned money and savings by such fraudulent builders.

WOW, instant replies from geeta 1985 and digital123, as if they are on line all the time. guys I am as interested that project is completed, its not about IDEB or Parkway. question is I need guarantees for completion and those to me are not coming (maybe some of you are more persuasive than me so have already recd chqs from Mr gajra...I have not). so lets not push the blame on x, y or z or hide behind some other company.You say Parkway has paid to HDFC, but when I met HDFC they confirmed to me that all Tivoli collections will come to them to clear the loans first and not for construction...also when I rang up Parkway and asked to meet their MD, Mr Tewani, I was informed that he doest stay here and Mr Gajra in Calcutta.They connected me to Rajesh who was evasive in talking about compensation but was only asking for money to pay HDFC...so my friend, I have also burnt my fingers but do not want to jump from frying pan into fire without sureties now on completion of the project...thats all. i met the project consultants at site(it was not a sunday...and there was not even power at site...so much for progres...on asking why they dont even have a generator, project consultant informed that none has been arranged yet)...anyway he informed that work of about Rs25 cr is balance at site which Parkway is saying it will do in !0 months!!!
just be care full guys ...my money is hard eaned ...dont want to loose it.

It seems Bedi has filed a FIR against Gajra in Whitefield police station on 17-Feb-2011.

Apparently Gajra has called off the settlement between these guys and the cheque that was given to Bedi has been dishonoured by the bank.

so I think things are not ok. In your own interest stay away if you are planning to buy a flat here. You are likely to lose your money and not get a flat also.
hi, i was looking to buy a flat there, but looking at the responses from ppl i am really confused as to what is the situation now?
is the issue sorted out or still some lacunea are there.
Please help me in making my decision.

Parkway guys are saying that this will not affect the progress of the project.
Does anyone has additional information on this?

Why are you so intent on damaging the project, we are comfortable with the way things are going forward. Because of your personal problems with the builder/developer why are you spreading false rumours about the project. We got to know from the builder that you havent cleared your dues till date and that is the reason they have sent you a notice. Kindly refrain from making false accusations.

I am reacting for the benefit of all buyers. I can prove my case on the basis of documents. Geeta is passing comments without any documentary proof.
Geeta should refrain from passing comments on the basis of information received through verbal comumunications. We have to see the ground realities.
Geeta has made false allegations in her comments addressed to Nitin/Bhakti. I have no intentions of damaging the project. I have not made any false accusations at any ponit of time. The Comments posted on July 21, 2011 do not contain any allegation or accusations. The comments dated July 21, 2011 do not provoke any one. The fact that Geeta got provoked for nothing and posted her coloured comments, speaks about her loyalty and concern for completion of the project. It seems as if Geeta is a moutpiece of the builder/developer for comunicating unrelaible information to the public, or else derives some undue benefits from the builder/developer.
i fully agree with bhakti gupta.. there are no personal issues anyone is dealing here.. the builder has been enjoying our funds for the last 5 years without completing the project..full payments have been made towards the project.. do not speak on behalf of the builder and trying to spread misleading news to public by protecting builder when he should be punished openly for his acts..
I was planing to buy a flat in Tivoli Bangalore. After seeing the comments and enquiries made I have come to know that the builder has collected total cost of the flat mentioned in the agreements signed by the builder with buyers. According to the agreement signed, builder was to deliver the flats by May 2008. Delivery period could be extended by six months. Builder collected the total cost by June 2008. Builder has not obtained the statutory clearance namely environment clearance from the government. Flat area is calculated as super built up area which includes plinth area, common area and balconies. Builder is trying to hand over only the plinth area of the flat and the balconies. Builder has not developed the common area. Therefore he cannot collect money unless the common area is also developed.

Builder has not constructed and has not delivered the possession of the flat as per agreement signed between the parties. Builder has breached the terms and conditions of the Construction Agreement and Agreement to Sell and rendered the agreement as null and void. Construction Agreement and Agreement to Sell have no legal force after expiry of the extended period of delivery period in November 2008. After November 2008. Builder has no right to invoke any clause of the agreements and take any action under any clause of the agreement.

It seems money collected by the builder for development and construction of the project has been used by the builder for purposes other than the purpose for which money was collected. Builder has been enjoying the money paid by the buyer, for the last three years.

Builder has lost his credibility and is not reliable and also not trustworthy.
I understand several legal suits have been filed against parkway and its director, gajra, for cheating and they have defaulted to their partners.. pl be cautious
i had discussions with HDFC officials and parkway officials. They have clarified the matter and are genuinely engaged in resolving the issues. They are hopeful of handing over the possession in Nov'11. HDFC officials are very supporting of efforts of Parkway in resuming the project.
The builder of Tivoli project, Banglore, has taken personal interest in resolving the issues raised by me and has settled all disputes. We are satisfied with his changed attitude and his sincerity in completing the project in November or before the end of the year 2011.

Who have you dealing when you say builder, is it Parkway or IDEB ? Also which block are we they promising in November. In Sep 10 they were promising to hand over possession of the first two blocks A and B by June 2011and C and D by November 2011. I pass through that area once a month and have hardly seen any workers on site. Also did you know the latest status of the two legal actions one by IDEB and another by HDFC Bank against the property.
Guys i gotta chance to visit Parkway today and they promised the builder is planning to leave the apartment by end of this year 2011. Where all the blocks will be ready by then. I asked them more or less most of the work is over why not even a single guy has occupied? They told me that, they need to get approval from Fire department to get sump and other stuff working so that there will be water supply. Since presently there is no water, no body is in...

Best to my knowledge only 15 flats are left where 197 flats are already sold... car parking looks to messed up needs lot of cleaning, sump work is still going on, swimming pool they have started only. Even in the model flat no lights are working, so i guess even clearance from BESCOM is in due... I guess at least it will take 6-8 months for this flat to get into proper shape. I saw hardly couple of workers on the site and a security and a marketing guy in parkway tivoli..

This is Manish Gupta here from Home Solution and we are working on sales of Tivoli Project at Whitefield.
Just thought o[censored]pdating on the progress of the project.

The project has been delayed by a long time, since parkway took over the project from last year end. They had informed in Jan 2011 that they would hand over the possession by 30th Nov 2011, but seeing the project there would be a expected delay of about 45- 60 days.

At the site the work is going at decent pace, not at what it should have gone. Apartments upto 6th floor are ready to take possession. The plumbing, flooring, door, windows, painting has been done and flooring upto 10th floor have been done in all the blocks.
The lift ( of Hyundai company) which to my knowledge is a pretty good company ( you can see the same in Brigade Metropolis) the latest update from the lift engineers is - in block A and B - the lift poles have been installed, they are installing the doors and in block A and B they would start the testing by early Dec, after fixing all the doors on all floors.
On landscaping - which is being done by Dhruv Associates, the excavation of the swimming pool is done.
The compound wall - foundation has been put, the compound wall has been take about 12 to 14 feet inside with the present compound wall, hence visitors car park would be outside the new compound wall. The foundation for the security cabin has been put.
there has been steady progress and got the project to better shape as it was last year.
The things which are basic essential for people to take possession is
a. Providing power ( BESCOM)
b. Water: which is by borewell.
c. Powerback up: Installation of generator.
d. Entry plaza, basement : The marking and there has been work on the entry plaza is going on - the basement is also ready but need cleaning and checking of sprinkler system which already has been installed but yes it need cleaning as it is pretty messed up.

Hence by Jan end at least the basic infrastructure such as Entry plaza, Security, power back up, power, water, lift should be ready.
The other work such as Club house, squash court, finishing of stair case room, lobby, landscaping might take 45 to 60 days.
Hence owners can take possession of apartment in Jan ( mid - end) and start the wood work and by march 2012 definitely they should be able to move into the project.
HDFC & Axis Bank are funding the project and payments have been done for new apartments sales done in last few months, bank would not take risk if they would see any legality issue with the company/ project.

Tivoli - the main usp being the floor plan which is probably one of the best plan in this surrounding, with very good carpet area and the work such as Structure, wall, etc are very well done, the project being stopped for 2 years - you would not see any seepage or cracks on the walls etc, which is very common in many of the projects.
It is not that Im supporting the developer, Im just trying to give the recent update and our view of the project - after working on the project for last few months.

Lastly it is all hard earned money of Buyer who would buy apartment and also understand after reading review on the project they would feel it to be a risk by buying in this project, hence we suggest that any buyer who is keen on the project can first get the legal papers checked by a good lawyer, and we or parkway group are always available to clarify any doubts on the Project etc.

With all these concerns - the price is kept reasonable considering the surrounding projects. But this does not mean that there are still issues with the project, developer or completion of work. There are only two units of 2bhk, about 8 units of 3bhk 1830 sft/ 1865 sft, two penthouse, two duplex ground floor apartment and there are no 2.5bhk with the builder. Hence there are not too many units that developer has to sell.

We at home solution work on almost all the big developers across Bangalore and we have taken personal interest on Tivoli project as getting a project in such prime location, with such good floor plan and such reasonable price is very difficult.
