[Resolved]  IILM Institute For Higher Education, Gurgaon — Not refunding full fees as per govt rules

My son,Prateek Saini got admission in IILM Institute for Higher Education Gurgaon and deposited Rs. 90000/- vide receipt No. 16703 dated 17.12.2009.Prateek Saini informed the Institute regarding withdrawal on 31.05.2010 ,one month before the starting of the course and requested to refund the fees deposited after dedudting Rs. 1000/- as per Govt. of India ministry of HRD and AICTE rules.Institute refunded only Rs. 45000/- vide cheque no.000226 dated 05.07.10 against due amount of Rs. 89000/-.i have sent Emails on dated july 4,14,16,19,21,23,24,26 to Jasdeep Chadha Dean IILM .He replied on July 23&24 and said that they have already refunded more on humanitarian ground. Now neither he is responding nor refunding balance amount of Rs. 44000/-.Kindly help me in getting my balance fees of Rs. 44000/-. Which is justified as per govt. rules.

PUBLIC NOTICE

ATTENTION TO AICTE APPROVED TECHNICAL INSTITUTIONS, REGARDING MATTERS CONCERNING REFUND OF FEES, RETURN OF ORIGINAL CERTIFICATES AND OTHER STUDENTS RELATED ISSUES

All India Council for Technical Education (AICTE) has been empowered interalia under section 10 (n) of AICTE Act to “take all necessary steps to prevent commercialization of technical education”. In compliance with the provisions under AICTE Act and in the light of directions of Govt. of India issued under section 20 (1) of AICTE Act vide Letter No. (U.1 (A) Section), it has been decided to issue instructions to the AICTE approved Technical Institutions, in the matters concerning students.

Whereas it has come to the notice of the AICTE that AICTE approved Technical Institutions are admitting students to technical education programmes long before the actual starting of an academic session; collecting full fee from the admitted students; and, retaining their school/ institution’s leaving certificates in original;

And whereas, Institutions are also reportedly confiscating the fee paid if a student fails to join by such dates;

And Whereas, certificates in original are being detained by institutions to force retention of admitted students;

And, Whereas the time-limit for students to join the courses/ programmes is also being advanced in some cases unrealistically so as to pre-empt students/ candidates from exercising other options of joining other institutions of their choice.

In the event of a student/ candidate withdrawing before the starting of the courses, the wait listed candidates should be given admission against the vacant seat. The entire fee collected from the student, after a deduction of the processing fee of not more than Rs.1000/- (Rupees one thousand only), shall be refunded and returned by the Institution to the student/ candidate withdrawing from the programme. It would not be permissible for Institutions to retain the School/ Institution Leaving Certificates in original.. Should a student leave after joining the course and if the seat consequently falling vacant has been filled by another candidate by the last date of admission, the Institution must return the fee collected with proportionate deductions of monthly fee and proportionate hostel rent, wherever applicable.

Any violation of instructions issue by the AICTE, shall call for punitive action including withdrawal of approval and recognition of erring institutions. AICTE shall on its own or on receipt of specific complaints from those affected shall take all such steps as may be necessary to enforce these directions.

about technical education — return of original certificates

I got admission in engineering Institute (AICTE approved) under MDU in 2008.
At the time of admission I paid first year full fees but due to financial problem, I was not
able to continue and left the college after first semester. Now I want to take admission in other course.
when I requested for my original certificates to Institute, they demanded three year fees and told it is an supreme court act.
Now I request you to please help me in receiving my original certificates at the earliest possible.
And I also request you to kindly take the appropriate action against these type of institute.

Dear Sir/Madam,

I am Vijay Kumar Sharma from New Delhi, I just have purchased a Brand new Eureka Forbes product i.e., Water Purification Machine through the company's client whose bill no. is 028559 (order cum receipt no[protected] dated 7th June, 2009.

According to the quality of your company's product as described by your client the machine is not working properly and subsequently, all the family members are facing abdominal pain because of impurified water. And when I complained against it, then the technician Mr. Manoj Kumar told that the membering of the machine would be changed and company will charge Rs. 2300/- for the this.

I want to esquire that why I should pay this much amount ?

IILM Institute For Higher Education — Blackberry Handset

I on the behave of my Boss would like to give a wrritten complain .
My Boss is using a blackberry handset 8310 Date of purchase 7/1/09 from Lodhiroad Store. All the sudden this handset stoped working and as it was under warranty period we requested your Hutch Max paging pvt ltd to replace her handset with a new one inspite of that they gave me a receipt and told me that you will get it after 15 days. I further requested them to replace it urgently or within one or two days. But they refused. Even my boss wanted to talk to them but they even refused to talk to her on phone as they said that we are not allowed to do so. Date when we had Given the set was 14 July 09.
As my boss cannot remain without the phone due to office commitments she was forced to bya a new handset. Which was a loss of money and time.
It is very sad to say that after voda company taking over hutch it has still not improved. and your staff at your outlets are also not trined to talk to your customers.
Anyways it is already more then the time told by your representative . but still my phone has not been replaced. It is a matter of great harrasment. Thenceforth we will not buy any phone from vodashowroom and will not suggest anyone else to buy one too.

If you can help then please do so or we have to take some serious step.

This may be true about other Institutes too but Mr Mahesh Saini is absolutely right in inferring that IILM does not care for the AICTE guidelines in refunding the fee. In 2010, IILM advised me to deposit the full fee amount of Rs 1.90 lakh towards admission of my ward, at IILM, Greater Noida. The registration was to be done on 7th June at IILM, GN but I was asked to deposit the amount by 30th April. As per the spirit of AICTE guidelines this is wrong. When registration and admission are to be done on 7th June how can you ask for full amount, in advance, by 30th April ?

Now, even more, my ward didn't do registration or take admission . Instead, he intimated IILM, GN his intentions of not taking admission and requested for money return. Nothing has been returned so far, even after 18 months (since May, 2010). They, first didn't respond to the repeated letters sent to them until a formal complaint was lodged with AICTE. AICTE, after examining the case came to the conclusion that the entire amount is refundable and accordingly advised IILM, GN. The institute, instead, asked for certain clarifications from AICTE. AICTE again served a reminder to IILM to return the entire amount. This time, IILM misled the AICTE by writing to the member secretary AICTE that the candidate was admitted and hence the fee was not to be refunded. AICTE is maintaining an eerie silence, contradicting its own letters that asked IILM to return the money to me.Till now, nothing has been refunded to me.

The fact remains that these unlawful institutes like IILM, operating directly under the central govt nose know how to manipulate the rules, do the illegal things and get away with it. This is not possible without the complicity of AICTE officials, some of whom might be on their payrolls too. Institutes like IILM and govt bodies like AICTE know that an individual has a limitation. Every body does not have the resources to go to the court or become Anna Hazare.

So, the fact remains that my ward didn't take admission, IILM is continuing to keep my hard earned Rs 1.90 lakh, ILLEGALLY AND FRAUDULENTLY for the past 18 months and AICTE, for the reasons best known to it is SLEEPING, allowing IILM to become an education mafia in North India and in the process, to bring more laurels to a corrupt India.
