[Resolved]  Lifecell International — payment deducted even when service is not opted

Dear sir,

my wife was pregnant and we were looking for cordblood banking serivce, we have decided to go for lifecell international, but later we decided not to opt service from lifecell due to improper service issues informed to me by my peers. however we have already filled the contrat form and ecs documents for installments, hence we informed life cell to cancel the contract, we have also received a call from their call centre regarding the payments but we informed that the serivce is not opted and they should not proceed with ecs installments. however they ignored the request and deducted Rs 6250/- from my back account. ive been requesting them for refund since 23rd august 2011, but they have not reverted to me yet. yesterday i recived a chq of Rs 1250/- only and they have deducted Rs 5000/- for unknown reason and no one is answering my calls too.

request you to kindly look into the matter as we have well informed the organisation for not opting the serivce but im charged Rs 6250/-

This is very much unprofessional. how can you claim yourself No.1 in business when you cant even co ordinate within dept. first you take my money even though i did not opt for your service which was well informed in advance and now your are not even bothered to refund that amount to me. i understand that couple of days means 2 days.. 2 workings days to be precise in your corporate terms.. but now its been more than 10 days. Dear Sir, we have decide not to opt for lifecell international due to service issues. however before this decision we have submitted ECS form and chq. We had informed local executive Mr. Deval for collecting the kit from us and returning the forms and chqs but unfortunately it was missed out from his end. few days back i received a call from your call centre informing about the ECS dates, where i informed him that we have not preserved stemcell via lifecell and should not proceed with ECS instalments, surprisingly the request was ignored both by call centre person and Mr. Deval. request you to refund the deducted amount of Rs 6250/- immediately. snapshot of transaction is attached. I am Deval Vyas.

I do not agree with the complaint given here. Mr. Jeegar Baria had contacted lifecell in March 2011 via our call center. I was informed by the client that they had contacted us because one of their colleagues has suggested Lifecell.

After successful presentation and follow up, the client finally enrolled with lifecell in March. Upon enrollment we had issued the client, a bar coded kit box with necessary documents, terms and conditions.

However, later on, the client cancelled the contract with lifecell as he had negotiated a price of rs. 60000 with some other cord blood bank, payable in installment.

( I have a mail from the other bank giving committments which are not mentioned in the agreement.. The client had himself forwared the mail to me as a proof of lower price that other banks are willing to offer)

However we had explained that there is anomaly in agreement of the other bank when they are negotiating such cheap rates with them but the client was ok with this anomaly. The agreement of that bank clearly said that no extended services will be provided if the client takes discount. The client apparently had some mail communication that these services will still be given even if discounts were offered.

However this commitment from the other bank was still only on mail and there was no commitment on stamp paper. The stamp paper agreement clearly says that the client will not get any add on services in case he opts for any discount. That is an anomaly and not a legally good option to opt for especially when one is banking something so important as one’s baby stem cells. However, the final choice always rests with the client.

We at lifecell do not allow or promote such anomalies like saying one thing in agreement and giving completely different thing in mail. Hence we also do not offer such huge discounts on our services.

For these reasons the client’s agreement was terminated. As per the company’s policy Rs. 5000 is non refundable. So the company has recovered rs. 5000 and refunded back the remaining amount.

We had sent the cheque of rs. 1250 one month back in name of Mrs. Baria who is the primary client, but the client wanted the cheque to be in his name. So we again took the cheque back and issued the cheque in the client’s name. Hence there further delay in giving him his refund cheque.

I think it will be unfair to say that lifecell is not giving good services, where as even for client who has cancelled his contract we give special service of preparing cheques twice as per his requirement.


SO PLEASE NOTE THAT THE CLIENT DID NOT CANCEL THE CONTRACT BECAUSE OF SERVICE ISSUE. THE CLIENT CANCELLED THE CONTRACT BECAUSE HE NEGOTIATED A CHEAPER VERSION (NOT NECESSARILY BETTER VERSION) WITH SOME OTHER BANK.
