What is max. amount of penalty that can be charged for delay in monthaly maintenance charges?

I HAVE MY COMMERCIAL PREMISES (SHOP) IN KANDIVALI " SHIVDARSHAN APT." WHICH IS NOT YET REGISTERED. IT IS PROPOSED SOCIETY. I HAVE BOUGHT THE SAME IN THE YEAR 2003. SINCE THE MANAGING COMMITEE HAS NOT CALLED ANY MEETING AND GIVEN ANY BALANCE SHEET. MOREOVER BUILDER IS COLLECTING TRANSFER FEES AT HIS WISH.

WHAT TO DO TO STOP BUILDER TO DO SUCH ACTIVITIES /
HOW I CALL THE MEETING OF MEMBERS ?

1) who is eligible to make reules for a housing society?
2)i am living in a society wherein the secretary is now putting a ban on use of lift for 4 hrs a day as the bill of electricity is on hogher side.is he allowed to do so?
3) Are the flat owners to construct / renovate the flat and cover the balcony / terrace portion ?
4)Can the flat owner be charged for doing the maintenance / drilling working causing nusiasnce in late night hours?
5) There is likeage problem and the upper flooor occupant is not willing to renovate as he has done recontruction of pipe line and shifted kitchen and all. can he be sent notice and charged for the same?
please neeed opinion...
Playing outdoor games like cricket and football in the housing society premises.

Myself and my parents live on the second floor of a 1BHK flat at Mumbai suburb. We own the flat and are a member of the Cooperative Housing Society. Below the building we have some open space around the stilt. The problem is that lots of grown up school going children in the society play cricket just below our flat very close to our windows.
This is such a nuisance that they make loud noise and many times there were instances of cricket balls being thrown into our flat, fortunately the window glasses have so far not broken, but there is every chance of the same.
Earlier in the past also such things have happened which led to quarrel. Last time some ~2 years back we had to file a police complaint due to this nuisance and the police had given the orders to completely stop the nuisances and the outdoor games in society premises.
Till some dyas the orders were followed but the problem again started and we had to warn the society of filing a police complaint after which it stopped.
Now again since some months the problem has started. When we objected, some members of the society whose childrens play outdoor games are telling "Go and file a complaint to anybody. We will play cricket and other game here only in the society".
We have talked to the Secretary and the Managing Committee of the housing society and even submitted a complaint in writing. However as per our previous experience they don’t take proper action permanently as their children are also involved in this.

As member and licensee of these building we have right for peace and tranquility and this cannot be taken away by these boys who are not only creating a lot of noise but also indulge in hooliganism when asked not to play and disturb the peace in the society.

It would be a kind help if you can advise and guide me as to what course of action I should pursue to stop this nuisance permanently.

I am a resident of a building in Santacruz East which is not yet registered. In our building the Chairman, Secretary and the treasurer are the same for a very long period of time. There are no proper rules like the amount if increased in collecting the maintenance or even giving any account of the amount that is collected or spent since the time we have occupied the said building. All the members started residing since the year 2002.

For the past one and a half years mobile towers have been installed on the terrace. for some time I was under the impression that only two mobile service providers have been given permission but recently I learnt that there are all together 3 mobile service providers who have installed towers on the terrace.

the irony is that the responsible members are so insecure about the whole affair that they don't give the keys of the terrace to any one and I am on the Last Floor (4th Floor) inspite of that i had no idea about the whole thing.

The radiation caused by this towers is hazardous to health everyone knows about it but the worst thing is that our building is only upto 4 floors, technically is it possible for a construction which is meant to bear strength of four floors to carry the weight of the three towers.


Would appreciate if someone could guide me on the legalities of the whole issue

I am the person living in the hsg soc in Mira Road .actually we play cricket on every sunday and on public holiday from 4.00 pm to 7.00pm.Two member of our society has problem of our playing cricket in the the society garden. First we use to play cricket on saturday, sunday and on public holiday at 4.00 pm to 7.00 pm We have never damaged any of the property of society or of its member's. But they still have problem with us and they have warned us that they will take a legal action against us. So please tell me that can they take legal action against us and what kind of action they can take.please do email me on my email address. i am purchase a room in resale longback at Mhada Charkop, but society secretary & president not issue me NOC room. i am regular pay all the charges, maintenance etc. i am not interested society's pooja or other function, so they want to me entertain their all function, therefore they are not given NOC to me.please suggest me what to do or shall i take any action.

I had purchased a flat at Dombivli. The original Share Certificate was wornout & i had no intention to sell the flat in future i laminated the original certificate unknowingly. Now my parents came to stay along with me jointly because of old age, the existing flat was not sufficient for us to accommodate Two families. Therefore i sold my existing flat & purchased a new Big flat. Now the Society is objecting on the lamination of the Share Certificate & issue of duplicate Share Certificate (evcn though the same is in original but in laminated form) since the Transferees name cannot be written on the laminated Share Certificate. Please guide me the rules regarding issue of duplicate Share Certificate in such a typical case.

i am leaving in a Mumbai hsg, its a renewed bld under SLR scheme, we in A wing are new members and B wing are old members, Managing Committee member have taken old member permission and distribute all the syncing fund saying this fund was collected by them, can they distribute the syncing fund? In balance sheet they have show it as loss.

what are the expenditure, the society is required to bear towards repairs like leakages, choking of bathroom, w.c., mori? are there any fixed norms?
I am residing in a 2 BHK flat. The flat is in my name only and other flat owner requesting me to take the decision on this. There is a common water supply system for building. On the ground floor storage tank and at the terrace we have syntax tank and from this syntax tank water is distributed to all the flats.
As per the declaration agreement between Land owner and Builder, Terrace is belongs to the Land owner. Now Land owner wants to acquire all the flats. He stopped water supply (expects his flats) and locked the terrace area.
When we launched the complaint against land owner to the police, police saying this is a civil matter we can’t into the problem, might be bribe effect.
Can someone please reply to this thread on priority basis, because last 7 days we suffering from water, all the flat owner collecting water with labour-intensive from ground floor to 2nd, 3rd floor.
Please help us to resolve this matter on urgent priority

What are the procedures to get the money back contributed to society for repair work which is not on papers yet.

I am a member of a registered society at chembur, I purchased my flat 4 yrs back. our society is not functioning properly, so we took the matter to the register 6 months before they took charge of our society but now to the register is on their side and are favouring them in this connection what we should do and who can help us in this matter

I had registered my flat for giving live & License on 20th and given it to the tenant on 22nd Feb. after informing the society but society is objecting to this and asking me to wait till 1stmarch. even the society want to levy Rs 5000/ as penalty to me. is there is any provision like this ?

They are decided 1st you withdrawal the Legal leeter then society will write a letter to Flat owner if he is not ready society will take action, then also Scoicty still date they are not sending any singal letter to Flat owner why, i can not under stand. some bady saying owner different, then i contract the owner the Flat he says I have alardeay sold what you want you can do but thing is Society says still his name in the record one side sece/Chairman saying we are not sening any letter to any bady we don't now who is the owner matter is your leakage. Then several time i approch the commety, member then they are comming to my house very fiv the leakages then they are started the leakages my Contribution is 2, 000/- ( Two Thousand Only) i will paid still leakages is there they are not agree to repair . Sec/ Chariman cheating to the soc & Goverment also by oriely they are saying Chalke is owner he canot registeration & Stam duty not paid & Not paid the Society Donation also & Mr Chalke he is given on renatl basis to Mr.Patel mothly rent is Rs 3000/- He had purchased the Flat Rs 8, 00, 000/- but both party what is under stand we don't no please cheque up deatils. my above flat leakage should be stop
