Please advise me regarding the charges that an adhoc committee can charge a flat owner according to floor wise in case of a 11th flr bldg. The society is charging Rs. 3 per sq. feet without showing any break up. Moreover the Charges are as Welfare fund since the building is still in the builders possession. Also would like to know if any concession are given to 1st flr flat which do not use the lift which comes to about Rs. 43,500 per month.

at 3rd floor but the problem his the seceratory of society has made lots of illegiale constraction in building
2 car parking garages which has allowed for commercial offices and the terrace of 2 flats which as been
covered by shades,
Also the 3rd floor terrace which has been covered by shades and saying that has been purchased
by landlord and his there his rules the flat owner can purchase thepersonal terrace and keep the goods
And top of my flat there is one more terrace which the repair his not been done and every moonsoon
i tell him and write that the terrace work should be done no reply so we had stop giving payment to society
can we repair the terrace and debit the account in society in this moonsoon
I am Mr. anish Mahadik, residental at Jogeshwari, & my father purchase a shop & flat at nallasoopar (E), but some reason our family are not going to live at nallasoopara, therefore our flat & shop giving the rental for legal & paying the maintance for society act @10% for NOC (Flat charges Rs. 385 & Shop charges Rs. 410), but our building scretary has say your maintance charge are not legally, in this connection i am giving the letter to vasai tahsildar office to our complaint but society secretary giving no responce and said to @10% act are not accepted & told me you are paying a NOC for Rs. 200/- (Shop & Flat) & charging a intrest @21% for balanceing amount. Our building are 22 years old, but not revnovation till date, they said this building are not making a revonation perhaps redevloped, but when, after colapse the building.
so you are give me a suggestion to meaning for @10% NOC & how to pay the society.
I am anish mahadik residental at Jogeshwari (E), my father has been purchase a one room kitchen & Shop at nallsoopara (E), in some reasons our family was not going to live their therefore that particular are giving the rental basis through by the tahsildar & registar & paying the maintance charges by the govt.law at @ 10% of mentaince, but still our society secretary would be not agree to accept the 10% NOC, they said you are paid full amount of NOC for Rs. 100%. In this connection i am sending a complaint to Tahsiladar office at Vasai, they are sending a report to the our society seceretatry to accept the 10% of NOC against the Maintance charges, but scertary would not be agree.

What is the procedure for a second applicant to become a Committee member of the CHS, if the first applicant has no objection if the second applicant becomes member and has voting right? The existing committee members twist the bye-laws according to their convenience.
Also, for an Apex committee for 5 chs to be formed, can committee be formed without any consent from any of the members or notices?
I m a tenant in my society, I m living with my family . In our club house there are so many amenties, but there is rule that only owner are allowed without any chargeand they are taking 500 from only tenant.
They are also not allowing the guest of the tenant.

Recently I Purchased flat on Bank auction, Which was unoccupied for the last 10 years.Now the Society members is asking us to pay the full Maintenance chargeswith interest for the the last 10 years. As per my Knowledge if the flat is unoccupied only 10% of the maintenance charges is to be paid.Where can I get the legal information on the Maharashtra Registered Society Laws.
We own a 3 BHK Pent is Khadki, Pune which has been presently rented out to a Korean family (husband and wife). The foreigners have been registered with the Foreign office and also the nearest police station and we have a valid leave and license for 33 months.
Recently a rule has been passed by the society to vacate foreigners and singles staying tenants within the next three months. The society wants only married people.
1. Since I have signed a leave and license, what can I do now?

I live in a society in Chiplun Dist Ratnagiri, Maharashtra...Before 3 years we bought a resale flat in the society...it was having some problem of lickage but society told us that time that the procedure of consruction of leak off is going on so there would be no problem to u in future...and as per they said they did also...but yet our walls are getting mosturised so wall colour is getting off from the wall it looks very dirty...we realised that the problem is due to the lickage in either toilet or bathroom of the family who live upstairs to us...we told and showed them too...the issue came under comittee meeting also...society told us both to make the solution over it ourselves...but the issues is, the leakage is in the toilet or bathroom of others family and why should we spend our own money though it will make solution of our problem...
I want to know from you the exact rule whether the expense is to be done by we family or the another family or the Society itself...

I had recently sold my House in a Co-Operative Housing Society to someone and that individual wants to start the Day Care and Nursary in the premises. What are the rules and regulations for starting the Day care in residential housing society as the society is refusing to provide NOC on the ground that they should first obtain the legal clearance from the education authority but according to my knowledge the pre-primary education doesnt come under any of the education authority as of now. Currently when I roam and see every Day care centers are situated in residential buildings or independant houses in the city. I would like to know first whether it is legal to run a franchisee of known brand day care in a residential house, and what are the rules and regulations to obtain legal permissions from co-operative society.

our society consist of few raw houses and amulti storied building having 110 flats. the raw house is exclusively for few individuals. no entry is provieded / allowed inthese raw house. but common facilites like watchman, water are shared by them also and they are members of this registered society and paying the society charges. each one of this raw house is provided with 2 water storage taks of 1000 liters capasity.these tanks are exclusively for these individual and no entry is provided to this tanks by the individulas and it is as good as a private property for them.society pumps water for the at society cost.NOW THE QUESTION IS HOW WILL MAINTAIN THESE TAKS LIKE CLEANING, CHANGING OF FLOT VALVES WHEN IT GOES BAD.

I have a house in Tilak Nagar - Chembur and the maintainance cost of the house is same for all flats i.e. 1bhk, 2 bhk, 3bhk , as well as duplex. I am aware that the maintainance cost is based on psf, hence i feel highly cheated. Could you please guide me on this subject and the next steps. Please treat this as urgent.
