What is max. amount of penalty that can be charged for delay in monthaly maintenance charges?

Dear Sir, Madam,

I am staying in Thane, I have started my renovation of Flat which I have purchase last year. I have taken a Permission for carrying out the work from the Society. The permission is granted to do the work from 9.30 AM to 6.30 PM. After starting of work one of the Society member which is resideing below my flat told us to stop the work between 2 PM to 4 PM. and they are threatening that they will do the police complient if they do the work in that time.

Is this Legal & what kind of action I will take againt them.

Sir please help me to know the prosess of mahada soct law that story is i purchase 30 mtr room in charkop of mahada raw houses while dealing chairman & seceretry was no where after final with seller next day he called me and told me that you have to pay rs.30, 000/- for getting soct noc ETC all the required document for registration time.and Rs.30, 000/- soct donation i said ok i paid soct donation Rs, 30, 000/- and i commeted that i will pay you some time later when i met one of soct member and i ask him how much is soct donation he said Rs.15, 000/- only then i contact chairman & seceretry and ask him why you taken extra 15000/- from me he said i give you NOC and all the require papaer for that only then i ask him why you takeing anoter Rs.30, 000/- from me he said don't ask me you have to pay Rs.30, 000/- more and i am takeing every seller or buyier. so my question is he is right or wrong should i pay him, please help me.

Dear sir,

what is the affarmative guidline given by the Maharashtra state govt. after the sale of new construction / property/ develop flat after the hand over to the register member of society: 1, Seafage in the building construction within the year of the hand over of the society to registered members. 2. Is there any act / By- Low to refirm the builder/ Developer for the said construction of the building seafage found in the construction of the building. 3. Is our LOW of the country deframed / used for the sub class affarmative of the classes?
can 2nd holder of flat can become secretary of co op society??
I am the Regd committee member. Our society members are not asking permission and they are doing the structural changes. If the outside (like Door) structural changes are done then what penalty committee has to charge.

Vijay Co op Hsg Society — Occupation Certificate

Sir,

Our society has been registered in 2003. The builder has neither made conveyance noy has applied for occupation certificate. Whenever we go to him for this giving one or other reason he tolerates and delays the mattr. We do not know how to go ahead. Kindly advise us in the matter.
Can a person who is the owner of a shop ( a commercial venture ) located on the ground floor of a residential building which has all its flats used as residential houses, and all the flats are ownership basis, become the general secretary?.

r/sir, there is leakage from terrace in my flat, since years back, in writting informed to the then scty. secretary and chairman. getting fed-up, i stopped paying monthly maint. charges, after no. of years, scty. put up asbestoss shed . ( which i feel wrongly designed by contractor ) it is still leaking. scty.has issued a letter for charging heavy interest on dues. I am suffering a lot from years till date. please advice
advice for water leakage problem of top floor flat, informed to secretary and chairmam in writting, waited years together, got fed up, stopped maintenance, recieved letter from scty. charging heavy intersest, inthe mean time an asbestoss shade installed ( which is wrongly desgined and leakage still persists -a partial lump sump amount paid ), aditionally water tank also leaks please advice.

I have flat with purchase parking in ratnagiri. The sell deed it is clearly mentioned that flat having 604 sq. ft with vahical parking 145 sq ft. But society rise objection regarding purchase parking. they told that you can't purchase parking space. please send the rules of parking.

I would like to install solar heater unit on the open tarrace of the Society. However society has objected it saying that as per bye-laws 170 & 171 open space cannot be permitted to be used on permanent basis.

Sub: Issue of monthly maintenance bills, and transfer of Share certificate in our names.

Respected Sirs,

We have purchased Flat no. G1-705 in May 2008, and subsequently paid the society registration fees of Rs.25, 000/- to the Hsg Society, as per the requirements of the Maharashtra State Housing Cooperative Societies Act. Till date, we are still receiving the monthly society maintenance bills in the name of the previous owner, and we are regularly paying the monthly bills within the due date.

At the time of purchase, the office bearers of the society had verbally demanded an un-official donation amount of Rs.20, 000/- (without receipt) to transfer the flat in our names. We have checked with the other neighbours, and read the Maharastra State Cooperative Society Act, which clearly mentions also that we are not legally liable to pay any such unofficial donation. Other neighbours have all denied paying any such donation at the time of purchase. We have observed that the society has included this unofficial amount in the monthly bill since July 2009, and included interest on the said donation, the cumulative amount of the donation with interest as in the August 2010 bill is Rs.26, 987.


We have issued them a letter in August 2010 requesting that going forward the monthly maintenance bills and the share certificate have to be transferred to our names at the earliest. Till date we have not received any reply from them.

Other society members have informed us that the mandatory Annual General Meeting has not been held for the last 2 years.

We were also informed that parking would be provided on a first come first served basis in the society premises as per the society waiting list, at the time of purchase. Inspite of applying for parking in May 2008 at the time of purchase, we have not yet been allotted any parking in the society premises till date. It has come to our information, that those who have purchased flats in 2010 have already been allotted parking. We have also written to the society members in this regard, but have not received any reply.

Absoultely right It has been seen that there is common maintenance charged where as in one flat there will be three or four members or as in other flat there may be 7 to 8 or even more members found which is unfair. consumption of water will be more, consumption of Lift will me more so why there is common maintenance charged even at the time of repairing the building equal charges charged which i totally disagree
