What is max. amount of penalty that can be charged for delay in monthaly maintenance charges?

FREAK HOUSING CO-OP SOCIETY — NOn Issuance of NOC for Rental

I have fixed an hosue for rental to an IT executive on 5 th march and before to proceed for agrement . He was directed to meet the society office to collect all the required forms for submission . The society did not provide any paper and asked to submit as per normal procedure . I have submitted all the papers as per Bye laws prevailing in Mumbai . The duly filled requisite papers of tenant on 11 Th march for issuing NOC and Gate pass to move his belongings to the Appartment on 15 Th March . But till 1 st April , The ociety has not issued any NOC neither reponded to my request . The tenant finally left canceled the agreement . I have incurred financial and menntal stress in following the society's inhumane treament to both the owner and tenant.
I am a handicapped person of 49 years old. Recently the managing Committee without taking the approval of the members closed a small gate which was the access for over two thirds of the members and residents of our society, putting me and other old, senior citizens to great inconvenience and discomfort. Tjere was a signing campaigning by all like minded members requesting to withdraw their unilateral action and keeo the same gate opened as it was for the last fifty years. Till date they have not called a special meeting or made any attempt to reverse their earlier action. I therefore request your advice on the same. I would also like to know if i can put all these committee members behind bars for unnecessarily harassing and tortuting an handicapped person whose degree of disability is over secenty percent. Please throw some light and address my grievance as they have encroached upon my fundemental right of movement and livelihood. thanking you

Dear sir,
Our is registered society having 92 flats, we have 9members committee which is expired on 31.03.2011 before expiring this committee we have taken special AGM to select new committee for the next 5 years, accordingly conducted meeting on 20.02.2011 and selected 9 (Nine) members in the meeting, meeting attended by 34 (thirty four) members. on 13.03.2011 we have taken 9 members meeting for selecting Chairman, secretary and treasurer, during the selection five members supported the selection and remaining 4 members not supported, accordingly we have filled the M form as per Bye law, Now the question is selected 4 members forcing us to dissolve the committee along with support of society members. Now what we have to do in this matter, reason behind this is they want chairman & secretary post.
Please tell us how we should proceed in this matter.

And what all services are included in the Maintainance.
The secretary & Chairman of my society are highly adamant. They never provide requested information . In AGM, behaviour of managing committee members is highly aggressive & coercive. Therefore hardly 10% to 15 % members attend the AGM. If managing committee members are asked any query/clarifications, they fight with everyone and eventually impose their decision on everyone. This has resulted in majority of members staying away AGM.
These members don’t even attend the dinner, for which M.C. members forcibly spend from society’s funds. It is always proved as waste.
Recently M.C. has partly collected out of 85 lacks for repairs for which details are not furnished by the society. In another incident, society again raised 45 lacks towards installation of G.I. pipes. In their letter dt. 18.3.2011, they stated that it was unanimously sanctioned by AGM. The information in the said letter is concise, therefore I have called for a detailed information vide letter dt.26.3.2011.
However despite several oral requests made for detailed information from time to time, secretary is not providing the information called for deliberately
I think all the transaction is very much suspicious . This might be the reason why they are not providing any such information .Plz let me know whom should I approach . I WOULD LIKE TO KNOW WEATHER A MEMBER OF CO.OP.HSG.SOC, IN MUMBAI CAN FIGHT MANAGING COMITTE ELECTION IF HE OR SHE HAS MORE THAN 2 CHILDREN.
if some member put there cloths to dry in the society area what can other members should do

I am staying in M/s.Aakansha (2) co.op.hsg.soc.ltd. Nalashopara (E) Achole Road, Near Talati office. I have given my 3 to 4 written application and several reminder orally to our Secretary and Chairman of the society regarding my grivances but till date no acion or nor any reply has been given by the society, it is almost 140 days passed out but still my matter is pending . For further information here, I would like to say that in my first letter I have clearly menation that unless and untill resove my problems and grivances I will not make payment of maintenace Charges and delay for making paywment of maintenace charges will be fully responsible by the secretary/chairman of the society. Here, I am requesting in such cases what step I have to take against the secretary/chairman of the society pls. guide me

Or society redevelopment is over. The Managing omittee has dne a wrong agreement and cheated the tenants of building No 4 The Sec and chairman has made money through the builder ene free enough money, to buy a house for the daughter and a car and a house in Nashik.
he society assurred us free of maintenance. So far nothing. The builder has not handed oer the property so far to the society,
How to solve this problem? Registrar has ben informed and enqyuiry aginst u/s 88 ordered against the M.C.

I stay in a cooperative housing society in the western suburbs of Mumbai. The Managing committee Was formed abt 8 yrs back. Since then the Committee has not audited the Accounts or conducting any Annual General body meeting. We the tenants want to dissolve the standing committee and form a new Managing committee. The existing committee members are not willing to submit the accounts and not willing to step down from their position. They are collecting the maintainence but not maintianing the society premises or paying the taxes.

I am staying in Ambarnath (Thana )Maharashtra, iam staying in first floor & water leakage in my toilet & bathroom from 2 floor so the 2 floor owenr is telling he wil repair but we should give half of the expence for the leakage, so i need your help that in society rules is there is such rules is there, pls advice urgent,
sir i am member in the society my child and his frnds play on the teras ie the open area at the top of the building but one of the member does not allow children to play and has warn children of legal action to be taken .can he ragister a case or there is any serious problem

krishna park housing society — mobile tower

Dear Sir,

Our building had installed a mobile tower around 4 months back. Some members of the society were against it due to EMR radiation effects and later in the general body meeting it was decided by majority that we will go ahead and install the tower and observe for one year, incase any health problem arises then we will remove it. Post which the installation was done

After around 4 months, many o[censored]s here are surprised to see that there is one more tower coming up in our building without the members being aware about it. No general body meeting has been called and no concensus was taken.

The problem is the Chairman, secretary, treasurer are all corrupt to the core and more than 50% people are ignorant. The mobile tower installing people are taking fulll advantage of this.

Please advice on what action can we take to stop it
