[Resolved] Maruti Udyog Ltd / Wagon R — Fraud by Dealer | |
Sir, 1. On 26-12-06, I had approached Maruti Suzuki showroom addressed at M/s. Magic Auto, Palam Dabri Road, Dwarka, New Delhi - 110 045 for purchasing a Maruti Wagon-R car. The Sales personnel at this showroom offered to me lucrative “yearend discount schemes”. It was promised that the discount scheme was a “combo pack” offer made by the together by the manufacturer, the dealer as well as the loan finance company. 2. The discount offered by the sales team lead by Shailender Thakur etc. among other was as under : (i) EMI of Rs.6, 168/- @ 10.90% (ii) Finance discount – 3 months EMI i.e Rs.18, 564/- (total EMI schedule is 57 instead of 60) (iii) Cash discount of Rs. around 22, 000/- 3. Upon the assurances and promises and believing them to be true I duly convinced about the pricing and discount policy and thus agreed to book a Wagon-R (Lxi) car and paid an amount of Rs.75, 000/- vide cheque bearing No.152854 & 1898544 all dated 26-12-06. The car was promised to be delivered within 3 days but the car was actually delivered after much delay on 14th. Jan 07 and that too after making frequent visits to the showroom. 4.That, to my utter shock & disbelieve when I visited the offices of ICICI Bank car loan deptt. (car finaced through ICICI bank as advised by the sales person), I was refused any finance discount as promised by the dealer and instead I was informed that the loan was financed @ 11.47% instead of 10.90% as promised by the sales personnel at the showroom. 5. I was further told that the ICICI bank letters used by the Car agent was forged and fabricated which means my total EMI schedule is 60 months and not 57 months . The dealer was indulging such illegal activities of making false commitments based on forged and fabricated documents of ICICI bank. 6. Thereafter, I was constantly approaching the dealer, to redress my genuine grievances and in this regard personally met all concerned and also wrote several e-mails but his office responded by saying that the sales person had already left the job and hence they shall not be able to help. 7. However, The Dealer failed to realise that the assurances were given by his Car Agency –Magic Auto and was in writing (by giving fake EMI Scheduler) and hence the dealer was vicariously liable to honour the commitment made by his sales personnel because any assurance given by his sales personnel could not been without his tacit approval. 7. In view of the facts and circumstances as detailed above, it is clear beyond any iota of doubt that such activities were being carried out with impunity and was within the knowledge and active connivance of top management of car agency and as such tantamount to “cheating” and breach of trust. 8. That, being the authorized agency of MARUTI SUZUKI were duty bound to protect the interest of clients, but instead cheated upon by giving fake statement. I, therefore finally call upon you all, that kindly address my grievence by asking the dealer to remit an amount of Rs.18, 564/- ( Eighteen Thousand Five Hundred Sixty Four Rupees Only) which is assured by the sales person by giving fake EMI schedule.
