[Resolved]  Nokia — Nokia's compensation cheque also get bounced

Hi All,
This is to bring to your kind notice regarding the quality of the customer handling services under your able leadership at Nokia.
Over here I am just mentioning my concerns in brief as appended below:
• I have filed a case against Nokia Ltd in District consumer forum vide case no 604/09 at Janak Puri.New Delhi.
• While the case is still subjudice representatives of Nokia approached me for out of the court settlement. Against my wishes and like a gentleman I agreed for the same.
• The settlement was mutually agreed at refund of my damages costing Rs 9,500/ less then the claim which I am expecting had it been come through the verdict of the court.
• Due to the rigorous follow ups and mental harassment given by the representatives I finally decided to go for out of the court settlement.
• Representative of Noika was sent to me with an affidavit and a Cheque amounting to Rs.9,500/.Prima facie the Cheque was appearing to be tampered fudged with signatures/over writing.
• I immediately brought this to the notice of the drawer XXXX and the arbitrator in the deal Ms. XXX about the flaws in the instrument and the possibility of its getting dishonored.
• It was assured to me by the drawer that we the Nokia is a big company and Cheque bounce of Nokia is a big question in itself.
• Trusting on the words like a true soldier I handed over the defected phone N -72 along with all the accessories to the individual who had come to collect the same. Not only I handed over the mobile set but was also made to sign on forge affidavit that was to be deposited by Nokia before the Hon’ble consumer court proving that the case has been settled out of the court and the customer has given his “ No Objection Certificate” in the form of affidavit.
• To my utter surprise the same thing happened of which I feared and doubting, the Cheque actually got bounced for the same reasons and I was charged penalty from my bankers.
• Still I thought it would be wise to again give one more chance to the Nokia people. I immediately appraised this to XXX and XXX. I was again promised that fine it is the mistake and they would be making good the loss by paying in cash.
• Its almost days when I told them the payment has still not been settled and to my sheer disgrace I was rather pounced back by your team by saying that its my duty to check with my bankers the reasons of check bounce. They treated me like as if I am there slave and asking for some obligation from Nokia. Rather I was getting call after calls for different numbers from different people that literally harassed me mentally.
• But they said now we have already got the hand set and obtained your signatures on the affidavit and now we are under no privy to be challenged at any court of law.

Remedies available to me
I have got all the proofs with me to be produced before the Hon’ble court as next hearing is due on XXX and I have not withdrawn the case. If the forged affidavit has been submitted to the court speaking that the customer has agreed for the out of the court settlement then it would be even worst situation for Nokia as I have got the bounced Cheque with me and Nokia would be heavily penalized on this fraudulent malpractice they adopted with me.
Also would like to read the clause for you straight from the Negotiable instrument act :
Under section 138 of the Negotiable Instruments Act,1881 “Cheque bounce is a punishable offence and Punishment prescribed for such an offence is fine which may extend to twice the amount of the Cheque or imprisonment for a term which may be extended to two years or both.”

Please treat this mail as a valid legal notice in writing following a principles of natural justice as fair chance given to the opposite party communicating that the Cheque details as appended below issued to me stood to be bounced dated Aug 28,2009.

The above is just a information as a well wisher to the Nokia leaders to open their eyes regarding the malpractices being done at below level.I just wanted to highlight for your favour only other wise my case is still sub-judice with the court. I just wanted to open your eyes to the fraudulent and pathetic customer dealing services right under your nose of which your are oblivion. Its pathetic to learn that such is the quality of the staff that has been hired by the Nokia whom the company is paying fat salaries with zero accountability and bringing disgrace to your reputed company.Leave alone the mental harassment done to me still the staffers of Nokia do not learn how to present themselves in front of the customers.
