[Resolved]  Nokia N79 — Defected product sold

Im ashamed of myself for purchasing a mobile and being cheated from such a reputed organisation..
tHE NAME OF THE STORE IS PLANET M.

The incident goes as follows..





I wanted to purchase a cell-phone- Nokia N-79, from your store, since the store advertised for a 2 yr warranty etc..in local newspapers, I went to ur store on[protected],the sales man imran, at the planet m store at Inorbit Malad w, opened the box, immediately after my payment & submission of the photo id proof, behind my back and when questioned he said that he just opened it and it would go to waste if I did not take it, as I had already made the payment, I accepted the phone, he fitted my sim card, and I took it home, when I asked him if the phone had any drawbacks like a battery problem etc, he declined and also said that after buying the phone besides the 2 yr free warranty we also offer home delivery of mobiles etc if the product gives trouble..the total price of the phone was 17, 801.

Within a month, the phone started giving immense trouble with the screen getting hanged, battery draining, etc, I went to the planet M store on 25th July 09 since I wasn’t in Mumbai continuously and approached a sales staff- Nagraj & manager Shalivan.

I displayed the cell to nagraj, where in he stated that I had kept the phone in a good condition.

I switched the phone off and took out my sim in front of nagraj.

I explained the problem to them, looking for imran, I also mentioned that my phone box mentioned of an accessory of a phone case, but I did not receive any phone case, and told them that the phone was opened behind my back. They heard me out and had a job sheet which was filled by nagraj mentioning the battery & hanging problem, to my surprise, I was told that imran, the sales person who sold the phone to me, was asked to leave planet m.

When my phone came back almost after a week, and after continuously calling nagraj, my applications like the oxford dictionary, secondary camera, my games like fifa 09 etc, had gone, my no of icons in the menu had even reduced, and more so my battery problem too wasn’t resolved, this infuriated me and I fired nagraj , and shalivan, and told them u cant cheat a customer like that by further spoiling the phone, my software issue too wasn’t resolved, I told them I would go to the consumer court if this prevailed, they again took my phone, and shalivan stated that the problem would be looked into again, Now I gave my phone to them, the 2nd time, and after about 2 weeks, in august they returned my phone, but with very few games, these games were not earlier present in my phone when I purchased the N-79, more so my oxford dictionary wasn’t restored, I was extremely upset, furious, and told nagraj, that this is no way to cheat some1 of 18k, he told me that these were applications and that I would have to go online and install them back, I argued saying that when I purchased the phone, I purchased it with the functions which were Already present, only to know I was cheated and fooled by false promises from ur sales man imran. I said that it isn’t my fault if the people who worked on my phone have altered my features, it was the onus of the concerned people to make good the damage done, also my battery probs, were not resolved, my screen would keep changing and my probs with the phone only started increasing, was indeed fed up and regretted buying the phone from this Planet m outlet.

For the third time on the 19th of aug, a delivery boy came to my residence & I showed him the phone, [ that was in working condition, on the standby theme, - a clear screen devoid of any lines etc.] I switched off the phone took off the sim & gave the phone to him, my brother was present when this took place.

When I called nagraj, I dictated to him the probs, that of the screen hanging, battery, applications missing, etc I told him to write it down and he assured me that this time he would personally take care of the phone. I called him up on fri- 21st aug, he told me that it has gone to the nokia H.O. in goregaon,

When I called him on mon 24th aug, he said that it was with nokia and only they will call up & let us know when its ready, when I called him again on wed, he said that nokia had reported a physical damage on my phone, mentioning that the lock key had been tampered- smoldered or something and asked me if I had taken the phone to get it repaired from an outside source, this made me very furious and I told him that I had no reason to do that since I was within warranty and why would I pay to get it alright from an outside source, he further said that because it is physical damage I do not come under warranty and that nokia isn’t repairing my phone , if I wanted I would have to pay Rs.600, on this I argued and again felt extremely cheated of Rs 18k, because I had a software issue, which wasn’t repaired, and now after a month, and a week of keeping it with nokia gallery, they report physical damage, I spoke to shalivan and asked that the money be paid by Planet m, and not me, since when I gave it there was no problem, they declined, and I told them I would go to the police if this wasn’t restored for justice.

Shalivan said that I could go to whoever I want but they are not authorized to come to the police station.

I received my phone on Sunday-30th aug, to my horror, this time my screen, was even more badly hurt, my phone had scratches, and quarter of my screen my marked with lines, and there was dirt inside the screen. none of which was present when I gave to the phone to the delivery boy, So once again I was cheated.

I lodged a complaint with bangur nagar police station and when shalivan & nagraj came, I narrated the history of this entire incident in front of the insp on duty, shalivan, nagraj, and another insp. I asked them to stop me if I was incorrect or gave a false statement, they admitted to what ever I said.

The police have told me infront of them- shalivan & nagraj, that I should make a case and fight this in court. I was even willing for them to settle it and told them if my phone is repaired I will take back the complaint. However, they did not co-operate.

I have narrated this incident to you as a final attempt to resolve this case, as I want justice, and if my damages are not rectified, I will seek redressal from the court of consumer affairs in this week,

I want justice and this is no way to cheat a customer. And I will make sure that my experience of this fraud being done to me goes to all the people that I know.

I truly suspect, that the piece itself was fake since it was sold to me open.
