Complaint against Avnish Director of ABA Builders Ltd ( Orange County , Indirapuram) for Breach of Trust & Cheating customers. He promised to give possession in May 2009 but after he is giving it after 1.5 year.

According to penalty clause he is suppose to pay Rs.5 per sq ft but he is saying that delay is because of some Environmental issue, of which he has arranged a fake certificate and has refused to compensate.

Also currently society is not in a condition to live. Bad Roads, most of the buildings are under construction...security issues, dust, building material...etc...if we don't take possession within one month we would be liable to pay Rs.7,000 per month. He is also demanding Rs.73,000 in the name of Miscellaneous charges (Rs.31,000), Electricity meter, Water connection, Gas line...He makes false promises at the time of booking...his staff is also rude with customers...

It would take atleast 1.5 year more to finish the construction...club, swimming pool, parks work have not even started...

Pls think 10 times before you book a flat in Meriton Group Projects ( Olive county , Neelamber , Platinum Park , Belvedere, Sun n Moon , Le Grand )

problem regarding that delever person Mr PRAVEEN was took mony 0f 385/-rupees for delever the gas cylender, But the beill give me at 352.19/-rupees, remainig 32.81 rupees was taken by him, then he tell me these are all tell them (DEEPTHI GAS AGENCIES, vadakare, kerala state, CST;1103C006805)

We had booked a holiday to Far East (HOLIDAY TO SINGAPORE, BANGKOK, KL) by paying full advance 4 months back with Orange holidays in Bangalore. When we wanted to go now on the trip (HOLIDAY TO SINGAPORE, BANGKOK, KL), they kept saying we will get confirmation since last 10 days. We applied for leave and got ready. Orange holidays said 3 days before schedule date of departure that they cant get confirmations on air ticket. Finally we demanded a full refund for which Orange holidays agreed. They have given us a cheque yesterday for the full amount of Rs 50, 000 which has bounced. You can’t get anyone on the phone, they are always evasive. They only come out with full page advertisements to lure innocent people. This is to advise all fellow Indians and travelers not to trust these cheats. ORANGE HOLIDAYS AND THE WHOLE GROUP ORANGE PROPERTIES ORANGE RESORTS LOOK LIKE THEY ARE BIG CHEATS. BEWARE!

Fully agree. These are a group of cheaters . Is there a way we can file a case against them ? I think more people who have booked flats here should come forward . I had booked it in 2006 - Sept and was promised posession in Dec 2008 . Also the construction quality is not as it was promised. It is below average . I feel like being cheated big time by choosing Orange County .
I agree. Infact I was fooled by Avneesh(ABA builder) into getting the registry done at the pretext of giving possession on April 15th 2010. However the possession seems far off. Also the builder is charging exorbitant rates for the maintenance charges. Note that things like club, swimming pool etc. are chargeable and not included in maintenance cost.
I also agree with those comments and when my parents visiting them asking details..they were rude to him.. I think now I am thinking feel like I have made bad choice to deciding flat in OC..

The delay is true however the builder is giving 50% of the penalty to everyone. The comments are too harsh and unjustified. I too am a future resident of the society and had a verbal altercation with the authorities the other day about an issue related to my house and the delay. However I have also read the clause which talks about penalty and am pretty clear about it. I know other BIG builders in Indirapuram itself whom the residents were just not able to reach at all for the penalty.

I have no misgivings about Avneesh or his staff as they have been very kind and cooperative all throughout. I would be happy if your statements can get us 100% penalty money. I doubt if a personal vendetta post like this would be of any help. This only leads to greater frustration level to no result. If you really need a solution and you think its worth it, hire a lawyer and file a suit.

I am not defending the builder, however, I would just like to extend a logical justification in the tough times that you might be in currently. I am not sharing my name with you for obvious reasons.
I am TOTALLY agreed by above comments. They indeed are cheating customers. Nothing is ready and even then they are charging lot of money in the name of Misc & Maintenance charges.Promosing possession from a long time and nothing is ready.b50b8

The 50% penalty payment is just a gimmick to force buyers to pay the entire payment. Otherwise they could have easily deducted the amount from any balance payment. The rest could have been given cheques.

ABA builder will not pay a paisa to buyer.

They follow the Diwali-Christmas(NewYear)-Holi cycle of handover promises. And i doubt if it would be any where close to worthy-of-living by diwali 2010.
I agree to it completely.

Everytime when they wanted booking to be done, their executives wore on their toes. Now when it comes to the delivery part from their end. They are just buying time.
There are many builders in India who have completed its project on time and Orange county from day one were boasting the fact that they are 'CLASS APART'. And now they are proving the same.

Can the orange county management deny from the fact that:
1. people who have purchased the flats are waiting since may 2009?
2. People are paying rent for their present stay and also instalment on bank loans.
3 Even the OC management are not sure, when will this campus be leavable.
4. The quality and offerings in real are different from that what was offered during booking?
5. They just waant to rush in without having parking and other basic amenities ready?
6. If you visit to their office ( as you have pusrchased a flat) no one is their to attend to your queries.
7. Girls/ exe sitting there are just not conveincing?
8. If one takes a look from outside...it looks like the project is 60% complete...are they going to omplete all their work before jan 2012...I have a dounbt.

This is high time that the management takes serious note about the delay and shows some constructive will to make its owners happy and delightted even after understanding the fact that its the owners of the flat who are at receiving end...but let them not forget what has happened to biggies like unitech and DLF...when the flat owners start taking things to the authorities...things realy comesout in bad taste...

why 50% penalty? and what for?
they should have realy shown some charecter just by sending in letters to people apologiesing for the delay and detteling the penality amount with the balance payable amount by the flat owners whit a concreate notification of the date of posseions .

Let us understnd, these are the same people who would make your life difficult if you delay payment from your side even for the day be it the final payment or payments for getting other amenities. If OC management is realy customer oriented...they should comeout with an offer of something which delights their customers...may be a 50% penality + free maintainaceetc for one full year post possesion.
Let us come together in yahoo/google groups like [protected]@yahoogroups.com (I am waiting for my membership approval since yesterday?) OR [protected]@googlegroups.com (which I have created yesterday) and share our views/opinion on varying issues in Orange County. This will help us in long way in building consensus and taking concrete actions now and henceforth, to make our stay better and best in OC.

I am wondering when the flat/building will be livable :( so that I can stop paying my rent.

I am wondering how OC has started registration and have got Clearing Certificate from Government when construction is still in progress all over. Is there a law in place? How are audits performed?

After seeing the condition of the flat, it will take atleast a month or two to complete all the work in flat. But the 'building' is not going to be livable for atleast 3-4 months from now.

Reasons:
1) Basement Parking is not ready yet. As an alternative, I am told that residents can park below the tower, where there is limited space and continuous labour movement/work. It will allow max of 20-40 cars.
2) Water supply (dry run) is tested only in two flats.
3) I doubt that electric supply generators have been tested yet by putting load on it.
4) Let us not forget the lack of security with so much movement around. What about people who have small kids, elders - they should not dare move in till few have moved in and declared 'All Well'

"Joke" - After all this condition, buyers are told that it will be ready by April 20th.

I agree that it may be worthy of living only near Diwali by BUILDERS Grace. Welcome to Diwali 2010!
