[Resolved]  Orior Developer — Illegal Deduction on Investment

Dear Sir / Ma'm,

Please help me out, as my overall earning is in mess as I invested approx. 2.25 Lakhs in the project introduced by Orior Developers (website www.oriordevelopers.com). The project is behind schedule as it's been 2 years now, & as promised there is no clue of possession on the property. As I opted for part payments on the project the initial booking amount was of Rs. 99, 000 & another 1st installment of 1.22 Lakhs. Now, when many a times tried to contact them & confirm regarding the status, they have responded detrimentally & have been claiming that the project is on schedule. Making repeated reminders on the possession & development the efforts went in vain. After loosing my interest & hope in the project, I asked them to return the investment, they've been asking to go into a Surrender Agreement, where they've claimed a deduction of 10% on the total payment made by me so far. If the clause was updated on the application form, it was never intentionally brought to my notice. It's illegal, if any deduction is made on the investment, rather seeking any return on the investment the deduction was a shock of a lifetime. The way they've been performing on their projects should be questioned by the Govt. & the illegal terms & conditions should be sorted out immed. for consumer benefit. I imagine if the investment could have been done elsewhere like FD's, I would have gained a few. Here a loss of more than 20, 000/- overall is unbearable, I'd been saving throughout to make payments for the land & now I don't have land, nor any money.

Hi All,
Me too have booked a plot at Bhaskar Valley. Till now not much progress. Have already paid 2 installment. I think that they are cheating ordinary public. Should take joint actions against them. Any idea when they say that they will give possession.

To start with the told me 16 months. When later I told them 16 months Orior office peaole said that 16 months is for start of project and not end. We should take joint action against such cheaters.

I ask "ORIOR DEVELOPER and INFRASTRUCTURE PVT LTD" MANAGEMENT thru this letter to tell everyone when they plan to give Possession of plot at Bhaskar Valley.

I again give humble appeal to Mr Sudhir Chauhan (Director of Orior Developers), Mr. Gaurav (General Manager of Orior Developers) and other members of "Orior Developer and Infrastructure Pvt Ltd" Management to let us know when do they plan to give possession of Plots to Bhaskar Valley applicant. Why I ask them thru this open letter is because if I make call at their office, they will always say "Within next 3 Months". This is standard reply but "Next 3 Months" never comes. If they reply on open letter, at least they will have some credibility.

We had booked a plot at Bhaskar Valley around 2.5 years back. Till now they have not even made allotment of plot to me. I have already paid 2 installment. They are asking for 3rd installment shamelessly. Even when I had paid second installment, they had told that alllotment would be done immediatley after second installment which was around 15 months years back. I haven't seen bigger cheaters than ODI people. I have refused them third installment. Now the point is not third installment. It is 2 installement and initila downpayement which I had already paid and interest plus mental harashment which they have caused to me.

Since now my patience has run out, I am trying to enquire with Economic Offece Wing to see how we can jointly file a case of cheating against them. Also I exploring consumer court option.

You see if you talk to them, ODI representative always says that allotment would be done in next 2-3 months. This going for around over 18 months. I have lost hope in their ability to deliver.

I can understand any builder may need some time before possession. But allotments are normally made within 6-12 months of booking. Here already 2.5 years gone. But till now no allotments even.

Hope to inform you of any positive news about action against ODI next time.
I had booked a plot in Bhaskar Enclave II. And I have made couple of installments but now im reluctant to make any further payments after seeing so many complaints...
How do i get out of it? I called up the company and they say that they will deduct 20%... Help me out guys...

Lesson of life is : Do not trust any builder in India. They are breed of same field.
Its not ODI, take any small or big sbuilder in india and show, which builder has delivered in time with the same commitment ?
For Investment, choose Post office and Govt Banks.

I am a customer of reliance communication company for last 7 years , my numbers is [protected] mp region , I have a balance of nearly 300 Rs on 9/11/2009 in night , but on 10 th is come out to be zero , I inquired about this in reliance mobile store (web world ) they said u have activated a astrology pack on 6 th November ( all 12 zodiac sign ) , this is totally wrong I doesn’t activated this ever ,if I have the balance must be deducted on the same date but it not debited on that date please try to resolve my issue and credited my balance on my account .
Any updates from investors in ODI's projects in Navi Mumbai or Jaipur? Their website says that a lot of plots in Jaipur have been regularised by JDA which should translate into good intentions but bad delivery which is aceptable given the legacy of Indian Builders.
I agree with all of you, its humiliating that after paying them timely we are unable to get even a satisfactory reply.

Look at ORIOR DEVELOPERS name in the list of Fraud Builders.

The Supreme Court has issued notice to the central and state governments seeking guidelines on mass media advertisements by real estate operators and builders to protect consumers. A PIL was filed by an NGO Sanrakshak- the Protector, which highlighted the misleading and false campaigns by real estate developers. A bench of Chief Justice K.G. Balakrishnan, Justice P.K. Balasubramanyan and Justice R.V. Raveendran while perusing the PIL has also asked all Union Territories (UTs) to furnish their response. Appreciating the urgent need to save such poor innocent purchasers and to punish the real estate builders/ developers involved in alluring and duping customers with screaming hoardings and advertisement in media, the Supreme Court has put its foot forward.

The PIL was filed against the unscrupulous builders and developers who were involved in the housing sector scam amounting to thousands of crore of rupees in the country, by cheating the general public by offering huge lucrative false and misleading advertisement in the print and electronic media. It threw the responsibility on the State governments and in particular the Ministry o[censored]rban Development and the Ministry of Law and Justice under the Union Government for its inaction to protect such gullible buyers from such huge cheating. It alleged that the builders or developers by huge and big advertisement offered general public residential plots and flats at much cheaper rates, when neither they had any land in their hands nor any of their were approved by the concerned statutory authorities. Proceeding on the modus-operandi the petitioner informed that of these so-called builders & developers first issued huge lucrative advertisements in all important daily newspapers and on important national electronic T. V. channels and then after collecting hundreds of crores of rupees from the general public, they, all of a sudden, closed down their offices and shutters and did not return even the principal amount invested by general public and thus these builders & developers were involved in cheating/defrauding the innocent poor persons/ investors in the organized manner. Citing the example of JVG group of industries that had allegedly duped people through misleading ads, the petition named PSG Developers & Engineers Ltd., Vian Infrastructure Ltd., Arun Dev Builders Ltd. (all Delhi based), Seven Heaven Developers India (P) Ltd., Lord Shiva Infra Developers (P) Ltd. (both Noida) and ORIOR Developers & Infrastructure Pvt. Ltd. Pune.

The Bench has issued notice to the State governments and in particular the Ministry o[censored]rban Development and the Ministry of Law and Justice under the Union Government on the request of the petitioner to direct them to frame National Guidelines for issuing Public advertisement in mass media by any builders or developers. The petitioner demanded that the builders be made to deposit all the relevant papers with the publication through which their ads were to be issued so that the buyers could cross-check their claims at the initial state itself. Notice has been issued to Ministry o[censored]rban Development, Ministry of Law and Justice and Press Council of India on a prayer to direct them to constitute a statutory or regulatory body to examine all aspects of the claims made in such public advertisements. The Bench also sought response from the Ministry of Law on the NGO’s plea for necessary amendment in the Indian Penal Code to insert section 420B (Publication of false advertisement) in Section 420 (cheating) and make it an offence punishable within the definition of Sec. 420, as recommended by the Law Commission. The Bench moreover has sought replies from several leading real estate developers as well.
Why there is no response from ODI officials? Even there is no update on development in progress at the site.

If all the allegations are baseless then ODI should come out and regain the trust, investors are loosing due to their silence on the matter.

Myself along with three of my friends have booked plots in Bhasher valley Karjath. Its going to be three years since then but nothing happend.
they have already taken booking amount of 72000 and three installments of 65350 .

had this money been invested anywhere I would have got good returns.

only favour they did is putting some green photographs on website.

this is a corrupt company who is utilising customers money in other works and we are suffering. No rules and regulations being followed.

Be aware, they are planting comments by their chamchas on the net to show they care for customer.

unluckely our government is sleeping with all the comfort.

Good News regarding Bhaskar Valley from Orior Developers and Infrastructure (ODI)!

Few months back, I had expressed to you my frustration and unhappiness towards ODI thru this site. Today, my perceptions have changed. I will take this opportunity to share with you some positive developments at Bhaskar Valley.

Yesterday I had visited ODI office at Gurgaon and met Gaurav (GM-Sales at ODI). I was told that ODI now has all approvals for Bhaskar Valley from the concerned authorities. This is very good news considering the fact that getting approvals in India is not an easy thing. Also I was shown the approved map of Bhaskar Valley and confirmed the plot numbers for my plots.

Looking back I feel that ODI's intentions were good from the beginning but their execution was slow (probably due to Government Approval problem). We know that getting Government Approvals in India is a very un-deterministic thing. Probably due to delay in approval process, ODI’s project used to slip behind schedule and ODI was unable to keep commitments made to us. Finally ODI team was able to get things done.

Anyway, all is well that ends well. I wish all of you (who have booked plots at Bhaskar Valley) very good plots and a very happy living at Bhaskar Valley. Probably we will be neighbors some day (I have purchased this plot for my own living and hope the same is the case with you).

This is to update everybody that yesterday I met Gaurav (GM S&M) in his office in Gurgaon and got some positive feedback as mentioned below:

1. The sanctioned plan for Phase-1 was shown to me.
2. They are going to start sending letters of allotment to everybody starting end of February 2010.
3. The updated photographs of development at site are going to be posted on website very soon.
4. Gaurav was sounding very positive on all the issues. Let us hope for the best.

Good News in the new year.

I had visited the orior office yesterday regarding my status of plots in bhaskar valley and personally met Gaurav Dhody (G.M.). He showed me the map of the sanctioned sector-1 of bhasakr valley and also i got my 2 plots allotted. HAPPY at last to have go my rights. Last time when i had posted on the wall i was very frustrated and was loosing my trust in orior, but i think now i have slightly changed my thinking- All is well that ends well. Thanks to Mr. Dhody and the efforts done by the company i think it was at the end a wise decssion to have invested with them. Also I met the M.D. Mr. Sudhir Chauhan and found him to be a very honest and genreous man.

Hope things would change for the better.

So I hear from some of you that finally Orior Developer and Infrastructure Pvt. Ltd. has started allotment of plots after over 3 years of booking? Normally companies give allotment within 3-6 months of initial booking. Orior Developer had also promised at the time of booking that they would do allotments within 6 months of booking. But they are finally starting allotment after more than 3 years of booking after a delay of more than two and a half years. I think that instead of feeling satisfied on allotments, we should put pressure on the company to give possession of plots fast. Shouldn’t we ask Orior Developer and Infrastructure to compensate us for so much delay in allotment and make sure that they give possession to us very fast.

Oriors aim seems to extort max. money from the investers in the name of registeration. Where is the possession ??? What is the development???? Is it township?? What is the future of the investors?? What is Rajasthan Govt doing...?
Only way is to fight against fraud collectively, and use personal influence for recovering the investment in the common intrest of all investors.
These persons never reply a querry, does any person has their bylaws & copy of the approvals given by Govt for Bhaskar Enclave-II & Bhaskar Valley, Karjat.

I have also booked a plot at Bhaskar-II Jaipur during Aug 2006. I have paid more than 70% of my premium. They have asked for balance payment and registration of plot. But on seeing at ground there is no development work at the Enclave. No conectivity of road and provided basic facilities to the plot. Please suggest me what to do. They have charged very high rate towards the civil area.

I have also invested in the Company for Jaipur, Tonk Road. But now the Company is demnding more money and not ready to give me the invested amount back. Even without interest? Govt. should take over the matter and give a lesson to the Developers.
