[Resolved]  Orior Developer — Illegal Deduction on Investment

Dear Sir / Ma'm,

Please help me out, as my overall earning is in mess as I invested approx. 2.25 Lakhs in the project introduced by Orior Developers (website www.oriordevelopers.com). The project is behind schedule as it's been 2 years now, & as promised there is no clue of possession on the property. As I opted for part payments on the project the initial booking amount was of Rs. 99, 000 & another 1st installment of 1.22 Lakhs. Now, when many a times tried to contact them & confirm regarding the status, they have responded detrimentally & have been claiming that the project is on schedule. Making repeated reminders on the possession & development the efforts went in vain. After loosing my interest & hope in the project, I asked them to return the investment, they've been asking to go into a Surrender Agreement, where they've claimed a deduction of 10% on the total payment made by me so far. If the clause was updated on the application form, it was never intentionally brought to my notice. It's illegal, if any deduction is made on the investment, rather seeking any return on the investment the deduction was a shock of a lifetime. The way they've been performing on their projects should be questioned by the Govt. & the illegal terms & conditions should be sorted out immed. for consumer benefit. I imagine if the investment could have been done elsewhere like FD's, I would have gained a few. Here a loss of more than 20, 000/- overall is unbearable, I'd been saving throughout to make payments for the land & now I don't have land, nor any money.

I have a plot in bhasker enclave 2 I have deposited 421000 rupees nearly 90
% of amount now after 4 year no progress is seen in site They collected money and fill up thier pocket why JDA registering without seeing is any work has done. my agent ncr relator proposed 5% discount at the time of booking and he also not give me nearly 11000 moeny from 2 year, so both developer and agent are bunch of cheater
I had booked a plot in Bhaskar Enclave - II. Seeing no progress in the project I requested my money back. ORIOR returned on 80% of the amount and deducted illegally 20%. I was assured by Mr. Gaurav Doddy to return the said 20% after talking to the seniors in ORIOR but inspite of various phone calls and waiting for more than one year the said 20% was not returned. Mr. Doddy stopped taking my calls. Can some one guide me how can I recover my 20% from cheaters like ORIOR

well i visited orior developers office in gurgaon today and i was very much satisfied with Mr.Gaurav dhody, he is a very nice person, very positive person, with very positive attitude, he shwd me all the maps of bhasker enclave-2, of mostly maximum blocks and gd news for all the customers of odi here in indian consumer portal is that the maximum registries of mostly all the blocks have been done by JDA.only two or three blocks are left which will be over by maximum of 6 to 7 months this year what is told to me by Mr.Gaurav.
and he has also given me many better options to me to switch.
so i think that if one has waited fr such long he or she shd wait fr sme more time.becoz registries are done frm JDA only and Jda only selects the blocks according to the khasra number and do registries so jus wait and pray that ur block comes under the khasra selected by JDA.
SO i really thank Mr.Gaurav.and i hope that the company shd satisfy every customer.and i am also very sorry fr wht i wrote abt Mr.Gaurav .they have also updated there site and also every person can see the blocks registerd on JDA site as JDA site is also been updated.

This is to update you on new development about Bhaskar Valley Project. I have received allotment letter for my plot at Bhaskar Valley. Hope everyone else too have received (or may be soon receiving) their allotment letters.

Dear Investors,

I hereby would like to share with you that ORIOR has started sending allotments letters and collecting the balance outstanding money including the fourth and final instalments. There is also some escalation in price (270 per sq yards) and this additional money is also required to be paid if you want the NOC and call for getting the sale deed executed in your name.

ORIOR has set 15 days deadline for payment of all the dues alongwith the escalated price. The allottment letter has date of Fourth week of April 2010. Hopefully the registraton process will complete by May end for fist batch of 20-25 investors who would make the payment as per the deadline set by them.

This is the version I got from their Gurgaon office when I met Gaurav Dhody.

ODSI is taking everyone for a ride. They are only demanding money either as escalation or as pref plot which they presumably alot to you withoout ur asking. they do not give any sitemap to confirm the location on the layout keeping the flexibility to cheat u once again. I suggest that u visit the site to see the shabby development which they are laiming to be excellent sitting in gurgaon. I suggets you write your booking no with contact to me with the nature of your complaint at [protected]@gmail.com and we will collectively take it forward instead of bending to the threats of Gaurav Dody.

I agree with all that investing our money with ODI has been a pain, but with the recent development of allotment & registration process with such a big delay, I think one has to give them some space. As for the escalation in the price for the development is concerned I was shocked when I received my allotment that after such a long time how can they charge such an amount, instead they should pay us the amount for the delay. I visited there Gurgaon office and same old stories were given to me, but when to find out the factual I visited the site in karjat, there is where I got the exact picture and they are right on their part as the cost of development has increased and they have valid details for the same which I have seen in person. Knowing the fact that there has been a delay on the developers part and despite that we will have to bear the burden I have finally come to the terms that it is better to get hands on your property registered in your name than rather keep playing the blame game, knowing that the last 2 years have been bad for the economy. So on humanitarian grounds I would agree with the developer also. Rest everybody is a better judge to their judgement. I would rather request everyone to take the allotments and get the plot registered in your name, at least the developer still exist unlike others who have vanished in the thin air.
I have been constantly chasing the Orior guys for last 3 years asking about the progress at the site and also about the continuously increasing prices of the plots in terms of JDA patta, stamp duty and what all stuff. But to my shock, they don't even bother to respond back to my queries at all specially Mr. Hitesh Kumar and Mr. Gaurav Dhody. I am terribly disappointed and frustrated with the type of service these guys give to their customers.

I SERIOUSLY FEEL THAT WE SHOULD RAISE A COMPLAINT AGAINST THEM IN THE CONSUMER COURT SO THAT THE ORIOR guys UNDERSTAND THAT THEY CANNOT JUST PLAY AROUND WITH THEIR NOTORIOUS ACTS AND NEGLIGENCE.
I am also an alotee of Bhasker Valley.
It seems that how these property dealers simply making fool o[censored]s, they are enjoying at the cost of our hard earned money.
Govt. authorities are looking all these activities and sometimes also involve into it.
Adarsh Society is a live example of this.

The registration process for Bhaskar Valley plots at Karjat is going on, as our 200 sq yeards plot was registered on[protected] at Karjat&we have
received the registry papers.So it is untrue to say that registration process is not going on.Though the ODI company has illegally charged Rs 270/sq yd
extra as escalation charges besides an abnormal delay in plots allotment there by causing an escalation in the registration fees &other related charges
that could have been averted, had the allotment done on time.The company should compensate for the delay at its part but it was done just contrary to it .There is an old saying, that states~Better late than never.So if someone is alloted a plot & that is any how registered then he is lucky &it is okay.

I booked a plot in Bhaskar Enclave-II ( Orior Developers) in Jaipur more than 05 years ago. I was told that the township will have all ultra-modern infrastructure and possession will be given within 18 months. It is learnt that still as on date development is at the very initial stage and the developer making pressure to extort the balance instalments in the name of registry. What is the use of registry if the developer do not provide the basic facility? How an individual will reach to his/her plot if roads are not there? How will the construction carried out without water and electricity... There are so many things to count which are must in a township. Every time builder's official assure to complete the work within 06 months and hand over the possession but all in vane. Can anybody suggest what to do ?????????????????????????????

The Company orior developers has been cheating the innocent people and Govt. and other agencies responsible in this regard are keeping silent. I have been trying to contact Orior, who everytime tell me that the process of registration of plots is under way and since the number of plots to be allotted/registered is too high, it is taking time. I now understand that it is just delaying tactics on the part of the company. I feel, the only way out today is to raise voice against the company with the Company Law Board, to take legal action against them for not honouring their commitments. I also feel that all the investors should get united to take legal action against all its promoters and its employees, who are knowingly misleading the innocent investors.

I also agree with Vikas that Consumer Court should also be moved immediately. If anyone has ever visited the site and can tell whether the work is stand still or some activities is going on. Can this attitude of company can be construed as fraud on the investors, so that legal action can be taken accordingly.
