Samsung C3303 Champ Mobile — Lots of scratches on back body in new mobile & Hand free is not working

my self Kanubhai mehta (M [protected]) purchased new Samsung 3303 Champ mobile on 16/10/2010 from Arihant Collection, Shop No 4, Sai shopping Mall, Opp Railway station, Borivali (W), Mumbai 400 092.There is a lots of scraches on back body and hand free is not working properly & shopkeeper is not ready to take any action. Please provide proper service like nokia co.
