Dear Sir,

1. I have an account in SBI Subathu, a/c No [protected]. On 23 Dec 08, I tried to withdraw money Rs.20, 000/- from SBI ATM at Sect 6 Dwarka, New Delhi but despite two attempts money could not be withdrawn. On the next day while taking money from SBI ATM at Gopinath Bazar, I noticed that a sum of Rs.40, 000/- has been debited in my account on 23 Dec 2008 in equal transaction of Rs.20, 000/- each.
2. I contacted SBI Nangal Raya, Delhi Cantt for help as ATM is under them but thet did not take my complaint. I also contacted my SBI Subathu (HP) who has sent them a fax complaint. Dear Sir

I had opened a joint saving account ([protected]) along with my wife in SBI Subathu while I was posted in Subathu from 2001 to 2005. I got transferred from Subathu in Oct 2005 and had some balance in my account. I withdrew money through my ATM at Delhi while passing through Delhi.

In the moneh of Jan 2008 I received a letter of SBI Subathu through my Head Office stating that individual has taken loan of Rs 15000/- in 2006 and is not repaying it despite repeated requests. Immediately on receiving this information I contacted the SBI subathu Manager to know about the loan case because I had never applied for any loan from SBI Subathu. I sent them a letter asking them to provide me a copy of my loan application form (available with the Bank) and the names of witnesses who have signed the loan application form. On detailed analysis I came to know that the case is not of Loan but a case of ATM withdrawal which the Bank has not debited from my Saving Fund Account. Them I requested the Bank authorities to amend their wording of non repayment of loan by me instead let me know in writing the actual case stating that the it is a case of ATM machine/bank's mistake. Them bank authorities agreed to iot and sent a letter to regretting the mistake of the bank.

After consulting many Bank branches about the position on opening of loan account by SBI in any individual's name (in case of ATM machine mistake) when the same individuaa is having live saving bank account in the same branch. All clarified that Bank authorities should have sent an intimation to me stating that due to ATM machine/Bank's mistake an Over drawal of money has been made from my Saving Bank Account.

Now Bank has levied a huge sum of interest on that loan account which is by NO means is legal. However Bank Manager (Sh Dinesh Kumar ) is now requesting me to remit the basic value of Rs 15000/- My request is to kindly do let me know if there is any mistake on my part or otherwise It is totally Bank's mistake and banks should pay the interest levied on the unauthorised loan account opened in my name forcibally. I therefore request the Zonal Branch Manager Chandigarh to kindly issue necessary directions to Manager SBI Subathu to accept my basic value of Rs 15000/- and close down forcibally opened loan account in my name and oblige.
