[Resolved]  State Bank of India — Release of Gold article of diseased customer

My wife Smt SAMMETA KAMALA aged 64 years holding saving A/c No.[protected] (nominee not registered) with a balance of Rs.2400/- and Gold loan A/c No.[protected] dt 28/11/08
(net weight of 50 gm, balance payment of Rs.12062/-) in SBI branch. She expired due to illness on 27/7/09 (Xerox copy enclosed)
When I approached BM for release of gold article, you advised to obtain the legal hire certificate from revenue authority, but the revenue authority denied issuing certificate (MRO, Dist. collector not empowered to issue the legal heire certificate- Govt.of.AP. revenue SER.III department Ltr.no.12138/SER.III (2)/2006-4 dt.13/07/06-xerox copy enclosed)
We the family members (my self, Daughter Smt.K.V.S.Mani aged 46 years-Hyderabad(A.P), daughter K.Sachi devi aged 45 years-Bilaspur (M.P) and S.Lakshmi Sharmila aged 39 years-Nanded (Maharastra) and all are married stay in different states of india) have executed an affidavit stating we only the legal heirs and all the three daughters ready to relinquish the right towards me (Xerox copy enclosed) and we also ready to submit guarantor of you branch account holder. I can submit my ration card showing family members.
The RBI under( Ltr.No.RBI/2005-06/48, RPCD.CO.RF. BC.No.12/07.38.01/2005-06 July 12, 2005 (B) Accounts without the survivor/nominee clause 2.3) advised:- In case where the deceased depositor had not made any nomination or for the accounts other than those styled as 'either or survivor' (such as single or jointly operated accounts), banks are advised to adopt a simplified procedure for repayment to legal heir(s) of the depositor keeping in view the imperative need to avoid inconvenience and undue hardship to the common person. In this context, banks may, keeping in view their risk management systems, fix a minimum threshold limit, for the balance in the account of the deceased depositors, up to which claims in respect of the deceased depositors could be settled without insisting on production of any documentation other than a letter of indemnity.
I being a 72 year old, physically and mentally depressed. Not in a position to walk and stay alone at Khammam-A.P, I shifted temporarily to my elder daughter’s residence at Hyderabad, It is not possible to approach COURT and make assemble all the three daughters at khammam for long period, In this connection i personally around SBI khammam branch for five days but no use.
Finally request you to kindly release my gold article by adjusting the saving A/c balance at an early date. Please inform to the following address for future correspondence.
