Complaint against SVP Builder, Rajnagar Extension, Ghaziabad U.P. for Cheating me and not delivering on the promises.
I'm initiating and writing this mail as I have been cheated by a Builder named SVP Builder India limited having its Regd office at 17 Kiran Enclave , ( near Samrat hotel) Main G.T. Road , Ghaziabad, Uttar pradesh. Builder is the member of "CREDAI".
I have purchased a flat in SVP's Gulmohur Garden in Rajnagar Extension Ghaziabad ( U.P) in September - 2009 giving 95% of the total value as per builder’s demand . At the time of booking Builder shown a central park as well as a very huge green area (80% of the project), the same is also shown/ mentioned in the Brochure given to me during the time of booking. They also showed a sample flat and did a sale agreement with me.As per agreement they had to deliver the flat by June 2010 , failing which they have to give us Rs.3/-per sq.ft.as penality for the delay period . Now they are neither giving us flat nor the penality.I had sent them e-mails and registered letters to which they did not reply as yet. Even in 4 plus years they have not completed the project as on today.
Now builder is constructing three new towers on the park area and also cutting down the green area as he is coming up with another project on the same green land as Gulmohar Phase II previously started as Krishna Garden. On my inquiry, I was told by the Builder that he has an approval from Ghaziabad Development Authority (GDA). In fact he took the approval later on and after he received payments from us.
My Question is "How can a builder change a project/ site map without the consent of concerned people who have already paid and bought the flat in the project?" , Now the green area/Park which was promised to me at the time of booking is gone therefore I humbly request yourself that an inquiry should be mooted and immediately the Builders encroachment should be stopped till the time matter is not cleared.
In this month now the builder has started sending possession letters for 5 towers out of 10 towers to our group people with a notice that we have to take possession within 90 days from the date of letter otherwise we have to pay penalty and even he has mentioned that if we will not take possession within 90 days he will cancel our flat ,
When we asked the builder for completion certificate from GDA and approved map from GDA(Ghaziabad Development Authority) they denied and told us that at the time of registry they will provide us these documents,
Further the builder has not used those materials What he had promised us. Wooden flooring, Wood work, Aluminum Doors and Windows etc, below are the points where we are not getting promised materials in the Flats.
1) Doors- Builder have fitted low quality doors in our flats (Noida
Based local company Orion).Builder have claimed on their website that

How Wood work is done?
Dear Sir/Mam Wooden laminated floor is there in one of the bedroom
Skin Moulded Hardwood frames doors from MASONITE CANADA is present in
all the bedrooms including drawing, dinning, kitchen and toilets.
2) Window- they are giving low quality window but they have promissed
us "Power coated Aluminium windows with clear glass shutters."
3) Which Type of Tiles/Flooring you use in flats? For flooring and
tiles they use Verified tiles & designer Marble flooring., Anti skid
tiles frim Kajaria., Parry ware Cp Fitting in all toilets., Wooden
laminated floor., Katni marble flooring. but they have used different
4) Wooden floor in master BedRooms- they are providing wodden touch
tiles in the master bedrooms but they have shown wodden flooring in
their sample flat and they have promissed that they will provide

5) They told "Parry ware Cp Fitting in all toilets" and Anti skid
tiles from Kajaria and Parryware CP in all toilets.but they have not
installed in flat yet.
6) Swimming Pool Area Not Decided according to company website. see

7) What is the Park Area of this project? Builder promissed 3 Acres of
land for park area.New Building are in progress
8) What type of Sanitary Brand you used in toilets and kitchen?
Builder promised to use Parryware CP fitting in all toilets Anti skid
& ceramic tiles in toilets from Kajaria. And Hindware basin.These
things are not fitted yet.

9) What brand you use for Lift ? They provide you the Lift of OTAS
branded which is fully automatic power back up and Dual high lift for
every flat.But only one Lift is installed in the Flat, What about IInd

10)Could you please tell me the Electricity Fitting details ? They use
branded & Modular electrical switches from SCHNEIDER ELECTRIC Electric
work with copper wires in concealed PVC conduits. and Sufficient
lighting & power points for switches & sockets. Donot know about
11) Water Supply RO (Centralized/Individual) Ganga water supply in
each units which is in proposal,Individual RO system water supply. But
they are providing Ground Water. RO system is not installed yet.
12) Basement and Open Parking is not ready.
13) Entrance Gate for Gulmohar Garden is not decided Yet.
14)Three New tower is launched in the middle of the project so
Security is a big question.
15) Club is not ready it will take time
16) Central park is not ready, No play area for children.
17) Internal Road is not ready. Approach road is not ready. They told
that this is not their matter. GDA has to take action on 24 mtr and 45
Even he has not yet refunded open space parking money which he has taken from us ( as per supreme court order no Builder can charge) its a contempt of court .
What I have mentioned I have all the proof and if given time ,me along with my other group members can come for a one to one meeting with you.
Sir/ Madam I have high hope from your office and request that
immediate inquiry should be initiated against the builder so that we may
not be cheated by the builder .
