[Resolved]  UNITECH UNIHOMES CHENNAI — NON-REFUND OF MONEY

We had send Regd. Letters in Nov.2010 for refund of full amount. UNITECH has sent a letter on 25th Jan. 2010 threatening to forefeit our hard-earned money of Rs.1.50 Lac. The letter does not contain the name of the staff who has signed the letter. The letter is silent about the valid legal documents we asked for. Nor it has the reference about the worst service provided by them.

Even i too check with Unitech and they are asking me to pay 18% interest which i have pending amount.it is not far at all.because till now there is no confirmation date for handing over the house and as of november as per aggremnet they need to hand over the house. but they are telling it will take next november 2014.so as per them delay will they pay 18% interest which we have paid. and they said that we will pay penaly per square feet 5 Rs.is it worth?.

Plz group the people who have invested and need to take some legal action against this people.simply this people using brand name cheeting the people and staffs are not behaving good and there no clear update on the progress.

so plz join all who have invested and need to take some action against this people othere our hard earn money simply lie in this property owners and is any body got details so on date your house is going to be handover?

i had invested Rs. 50000/- in LOK FINANCIERS COMPANY (MR. LALIT C GANDHI ) IN JUNE 1995 AND THE COMPANY WAS TO PAY INTEREST @24% PER ANNUM. I HAVE BEEN FOLLOWING UP WITH THEM PERSONALLY FOR REFUND OF THIS AMOUNT WITH INTEREST FOR THE PAST 8 YEARS :.BY MEETING THE COMPANY'S REPRESENTATIVES PERSONALLY ATLEAST 4/5 TIMES A YEAR AND ALSO BY MAIL AND EMAIL AND ALL I GET ARE ASSURANCES THAT THINGS ARE IMPROVING AND THE FULL AMOUNT WILL BE REFUNDED. Undersinged has deposited an out station cheque of (standard Chattered bank,Alipore) No.240098”[protected]”505778”13 of amount Rs.10897.00 on 24th February. But it's a matter of regret that the same had not been credited to my account. On my enquiry your, person told me that it has been sent for clearance.The amount has not been enterd to my account as uncleared balance though there is a provision for this.I therefore request you to initiate proper action for the clearance of the cheque.

I refuse to believe that you received any such letter. First of all, Unitech is very reputed company and would not do any such thing that will malign their image. I have a strong impression that you have lost this money of yours due to some default on your side and now are covering it up with false implications on Unitech officials. No wonder you don't possess any legal document about this ordeal.
Absolutely I agree with the complaint which that Lady has registered. Because one of my friend who is also booked a flat in Unihomes Chennai and she is an NRI. Unitech's representative was promising to get her all documents including her booking form next day and collected the advance money. But till last month he had not even sent her booking form. Also the contract which they had sent to her was one sided. They are supposed to give all documents with regard to title clearance which they did not do so till today.

Also the Sales Executive gave false message that when she takes loan she will get all documents from financial institution. Due to which she had approached HDFC and she came to know UNIHOMES yet to give clarification about some legal queries. Once they give, the project will get approved. But based on her paying capacity and already she is having loans with HDFC, they have sanctioned her loan within no time.

She was under the impression UNITECH is a big company and they would be prompt in everything and applied the loan with HDFC and went to UAE. But Unitech did not give clarification to HDFC till November 2010 and my friend's loan approval got lapsed because it crossed 6 months period. She had resubmitted her application based on assurance given by one of the Big official from UNITECH, Dubai, My friend resubmitted her papers to HDFC and within no time again her loan is sanction and now since UNITECH Project is approved by HDFC they have asked my friend to submit contracts, documents etc. from BUILDER. She had written mails to UNITECH asking agreements. They have sent contracts for her signature but some document which they have mentioned in the agreement was missing. Also HDFC clearly told that she has to get all documents from UNITECH only and they will not provide any documents.

Now the contract has come to her for her signature without parent documents and UNITECH - the same Mr. Karthik was insisting her to sign and return the document without replying to her mails properly. Contract clearly states she has gone through all documents and after fully satisfied by her she is signing the contract.

Under this circumstances, how a person can sign the contract when she has not been provided any of the documents? What is your suggestion Mr. Devang? When you talk they are reputed company, don't you think they have to provide everything in time to prove their repuation?


Before she had made booking I have advised my friend not to book with UNITECH as they were having earlier also some problems, court cases etc. But by the time they had advanced. Her husband got clarified all what I have told her from the Executive and he had assured that nothing will happen in this project and next day he is coming with all document set, her booking copy etc.
The same lady has seen one flat on 27th January 2010 and got all document copies, 29th entered into agreements after satisfied with title deeds, on 1st February 2010 undivided share of land registerd in her name, applied loan to HDFC and 10th February her loan got sanctioned and 15th February it got released to the Buiilder. She did not wait in India, she went off on 6th February itself to UAE.

When a medium size builder can do like this, why UNITECH has not given any of the documents to her till date? When they delay like this how the customer will make payment and how can you say it is default from customer side?

Home loan Complaint — Refund money

I have apply a loan in DHFL I give to DHFL cheque amount Rs 5515 /- for processing fees . But They have not refund my amount last 3 month.and staffs are not gave any answer properly
I agree with this. I booked a house in Palm Villa, I was intially informed that ICICI bank is the approved banker.

Once i booked the house, I came to know that ICICI need some legal documents from Unitech and they are yet to provide the details to ICICI to clear the payment to Unitech, My loan is sanctioned and ICICI has given the amount to unitech

Unitech is putting pressure on me to give the remaining payment. When we ask for legal documents they say all documents are in delhi and not in chennai office.

I have faced similar issue on Palm Villa. poor response from UNITECH & in my case HDFC has not approved the loan stating some clarifications are pending from UNITECH. This is in pending since Jan 2011. But, UNITECH is keep sending me letters to pay installment on every month.
I do agree with the issue mentioned above.

I booked Palm Villa in UNITECH, Chennai in July 2010 & promoted the same to my relatives as well.

Issue is regarding the HDFC home loan. Whenever I visit UNITECH site office, I could see one or two HDFC home loan agents roaming inside the office & I assumed that I can get HDFC home loan for UNITECH villa thinking of their reputation. But, unfortunately the moment I applied to HDFC loan in January this year, I got known that they haven't approved this project, hence, I can't get loan from them. When I enquired Prabhu Das (Unitech Banker), he mentioned that UNITECH doesn't provide any documents that are needed for a home loan other than UNITECH portfolio banks (India bulls & Dausche bank).

When I enquired some of my peers, I learnt that when there might be some issues related to land acquistion or some legality issues, then only these banks wouldn't approve the project. I thought of to wait till UNITECH clears their documents with HDFC & other banks. But, UNITECH is keep on sending every month asking me to pay installments of 8 lakhs, otherwise 18% interest fine will be levied, even thou they haven't completed project approval from a reputed Indian banks. I don't know why they don’t support customer preference. Why do they want to hurry the things if they are not proper with legalities?

So far, I paid 25 lakhs to UNITCH, cancelling all my other planed assets & now, I don't have any more savings neither to pay installments nor to get HDFC home loan. If I ask Karthick or Prabhu das to accelerate the process to get the Palm villas project approval from HDFC, they drive me to go for the banks as mentioned above. If you go & read the comments in internet about one of the bank mentioned above, I could read only pains of the loan takers!!
I have paid 1.00 lac at the time of booking on[protected]. When Booking Mr. Jude told us that he would provide the document within 2 days. Later he told that Financial institution would provide document copies. Therefore I was forced to apply loan to HDFC. My loan within no time got sanctioned and they have asked me to submit the agreements but also they told Unitech's project was not approved due to some legal queries. It got approved during Nov 2010 only. From that time onwards I am after Unitech to provide document copies for verification but they did not provide the same and insisting me to sign the agreements. All the delay has happened due to their delaying everything. Now Mr. Karthik states that they cannot provide document copies stating that it will be misused. Also he added that in case if we do not make further payments, they will forfiet the booking money. In what way the people will misuse the copy of the documents? One Mr. Surendra has come now and he promised me personally that he would resolve the issue within no time during April 2011. Till date he did not reply to my mails. The best part is Mr. Karthik was previously employed with ICICI Home loans. Believing our words one of our friends booked 2 flats and paid 5.00 lacs.

Though All checkes - Mr. Vinod only recommended to book with Unitech but he is also not responding my mails. Recently I came to understand that he is a close friend of Mr. Jude, who is in Marketing in Unitech, who did all false promises to me about documents.
I strongly agree with the complainant, as my own experience is very similar.

I had booked a flat in Unihomes project. I had paid the initial advance and three subsequent part payments as necessitade by Unitech from my own pocket.

Now, when I applied for a home loan from HDFC, after ascertaining from Unitech guys that HDFC is one of the approved financiers, I am told that Unitech guys are refusing to share any documents with HDFC, for this particular phase of the project, as they have not got required clearances from Government authorities. So, after having paid advance and three subsequent dues to Unitech, and after having paid the processing fee to HDFC, I am stuck ! Because the home loan cannot be processed further because Unitech itself is not sharing the documents requested by HDFC, because they have not got complete clearances; And HDFC is one of their own approved financiers !

All my correspondence to Unitech Chennai has so far not been responded. Thinking of appropriate actions to take Unitech to task.
I strongly agree with the the above complaints. I have booked 2 flats in unihomes chennai in Feb 2010. I got the loan sanctioned in principle by HDFC. However due the various reasons stated above, HDFC was not able to disburse the loan. Unitech has been putting undue pressure on forcing us to make the payments by approaching India Bulls / Deutsche bank. They have been charging us the 18 % interest also citing delayed payments. I have every single communication with Unitech documented but as always, Mr Karthik and Mr Murugesan have not been able to give us any proper reply as the entire delay in the process was due to the company's inability to submit the documents required by HDFC. I have visited their office in person, spoken to them softly, harshly, requested politely, been rude but nothing affects the. Like a complainant has said above, they pass the buck to their delhi office. This is absolute harrasment from a reputed builder like Unitech. Extremely disappointed. Their office rep also told me that it would be difficult and prove costly for me to pull out of the project now.
If we can get together, it would perhaps help in pushing our case

The week gone by witnessed a key development in the real estate sector in India, one which may have far-reaching implications. The Competition Commission of India (CCI) imposed a hefty penalty on prominent builder DLF for delaying a project in Gurgaon and for imposing one-sided contract clauses on apartment buyers. This case may open the doors to redress grievances of many home-buyers across the country, who, after investing large sums find themselves at the mercy of builders. Inordinate delays in handing over possession, low compensation for delays, changing project scope or house specifications without buyer approval, and many such – the litany of complaints if you talk to home buyers, tends to be quite long. In extreme cases, home buyers are even victims of outright fraud with the builder's title to the property being defective and relevant statutory approvals for development not being obtained.

A key reason for this state of affairs is the largely unregulated nature of the real estate sector in India. Often, buyers do not conduct necessary checks or pay attention to the builder agreement details. Even if they do and ask builders to modify unfavourable terms, the latter using their dominant position are able to have their way citing “standardisation of agreements” for all buyers.

It remains to be seen whether the CCI ruling opens the floodgates for complaints against errant builders. In the meantime, caveat emptor (buyer beware) has particularly high importance in real estate dealings, given that a house is probably the single-biggest investment many people make in their lifetime. Here are some important aspects buyers should look into before signing the agreement.

Proper and clear title - Home buyers should ask for and check certified copies of the title deeds to the property on which the building is being constructed. This is to ensure that the builder's right to sell the property is clear and free from legal claims. Buyers should ideally get these documents examined by someone well versed in law.

Proper approvals - Buyers should inspect whether proper approvals for development on the property and for the building plans have been obtained. An important document in this regard is the plan approval from the relevant governing authorities.

Encumbrance certificate - Encumbrance certificates for the last few years including the latest certificate for the property should also be inspected. This is to ensure that previous transfers have been in order, the builder is an authorised transferror, and to ascertain whether there are any loans or mortgages on the property.

Plans and layouts - Copies of the construction plans and layouts of the project, buildings, floor and individual houses will help buyers assess the property, and also whether it matches with the approval granted by the authorities. This will also come handy for buyers on a later date if actual construction deviates from the plans.

Built-up area and carpet area - An important aspect is the difference between the area mentioned in the agreement and the actual living space which will finally be available. Agreements usually state the super built-up area which includes proportionate share of common spaces such as staircases, lifts, building lobbies, etc. The carpet area which is the actual living space available could be around 20-35 per cent lower (known in industry parlance as loading) than what is mentioned in the agreement. Higher the loading, lower the actual living space.

Penalty for delays - Check for clauses which provide for penalties in case of payment delay by the buyer, and also in handing over possession by the builder. Generally, buyers are heavily penalised for payment delays and charged interest at around 18 to 24 per cent per annum. Also forfeiture in case of default beyond a certain period could be between 15 to 20 per cent of the total sale consideration. On the other hand, penalty for delays by the builder are relatively much lighter, attracting charges of around Rs 5-7 per square foot per month of delay, after providing for a grace period. Though the quantum of penalty may not be adequate compensation for the buyer, such a clause could cut losses for the buyer and at the same time incentivise the builder to stick to schedule.

Early exit charges - Buyers should also check for penalties in case they wish to terminate the agreement. Forfeiture charges in such cases could be quite high ranging from 15 to 20 per cent of the total sale consideration. Also, the builder may not return the balance immediately and may do so only after re-sale of the house to a third party.

Tax liabilities - Check whether the agreement clearly lays out the obligations of the builder and the buyer regarding payment of various charges and tax obligations, and the periods from which they apply. Ambiguities in this regard could be a drain on the buyer's pockets.
Preferential location charges - Such charges could include floor-rise charges (extra cost for apartments on higher floors) or additional payment for apartments with preferred views. Buyers should confirm that the agreement clearly mentions any such extra charges, so that they are not caught unawares later.

In addition to the above, buyers should check that the amount of advance collected is not unreasonably high, and confirm that the facilities sought to be provided in the agreement match those originally promised by the builder. Also, check for other clauses including maintenance charges to be borne by the buyer, and the period from which these become applicable.

Check how the undivided share of land (UDS) has been apportioned among buyers and conditions regarding the same. A higher number o[censored]nits constructed than approved will reduce the UDS for each unit.

It is also a good idea to see whether banks have appraised the project for giving loans. Though not a substitute for buyers conducting their own checks, this could provide an additional level of comfort about the veracity of the builder's documentation.
There are quite a lot o[censored]nfair trade practices by Unitech particularly Nallampakkam project in Chennai.

They haven't got propoer governmental clearances that spoils processing the home loan even through their project's approved financiers.

If you are planning to buy a Unitech flat, please, forgte it, there are many more fair builders available. These guys harass a lot, and don't even respond if you have any problem.

After investing, you shouldn't regret your inability to get out clean.

Anyone or many, contemplating something on the lines of class action suite, please do post your thoughts.
Hi viewers, 30Aug2011, i visited this site, the scanarios that happend to me proving the above complaints, WHO EVER WANTS TO BUY FROM UNITECH - TAKE EXTREEEEMEEE CAUTION. The mktg guy told they have tie-up only with deutch / icici and some more. When i asked about HDFC and SBI he wasn't showing interest at all. (thatz the catch) (Note: I'm only checked this page after my visit). And he also insisted that if you agree to start you EMI soon he will give a 7% offer.
I asked him how a bank will give the loan even the project is not yet started . He said the options are like that...(I'm not sure..)
Then for selecting the flat i asked the master plan, where we can see the individual flat in a tower/block, i asked many times during our discussion, but he tried to mange only with brochure. So Why they are hiding or refuing to show the master plan (blue print short of thing)
I did see some blogs mentioning UNITECH is not good, in year 2008. It seems the project is 3-4 yrs told and projects completed.
I think they are in huge money crunch or some legal issues.
They are advertising in the name of IIIT (opp to this project) & Sports City & Their Delhi Public School.
I'm not sure.. if they are not trustworthy then nobody will think of the above features.
I took an civil engineer with me, he was telling that the steel they use for a G+3 Building is inadequate.

Finally, Itz very worrying factor that these realestate giants robbing (trying to rob) our hard money and want to swallow that. (Somebody said that for someone having a own house will be biggest and lifetime asset - I'm in that category only)

I've decided not to go for this project. (Sorry for my english and these are my own opnion and views)
Excellent, I had the same experience about 6 / 7 months back, except only that the financiers were different, becaus HDFC was in !

They compelled me to go in for 100 % option, tempting me with a 7 % discount, but I would have had to start paying the EMI immediately even before the beginning of the construction !

But I wasn't wise like you, I did opt to go book it, (not through 100 % ) but now feeling a lot of pain !

I went through HDFC, and Unitech guys in Chennai were not even willing to share documents with HDFC because they hadn't got any approvals. So, after paying about 3 / 4 instalments, and even after getting a loan approved through HDFC, which was oen of their approved financiers, I am stuck !!!

So, ANYONE CONSIDERING UNITECH NALLAMPAKKAM WOULD DO WISE TO GO SOMEWHERE ELSE AS UNITECH IS FULL OF CHEATERS RIGHT FROM THE BROKER WHO CONTACTS YOU TO THE SALES & OTHER FINANCE & ADMIN GUYS EMPLOYED IN UNITECH. NO ONE WOULD RESPOND TO YOUR MAILS OR CALLS>
I am about to book a flat in Unitech nallambakkam, after seeing all your comments i am almost dropping the idea. i enquired through one of their bankers HDFC, i asked him about the past issues, he said everything was cleared, they are going to approve in another ten days. can anybody advise me whether it is still advisable to go with these guys
PLEASE, THINK THROUGH THE CONSEQUENCES IN CASE NOTHING HAPPENS ON THE APPROVALS FOR A YEAR AND THEN WHETHER YOU CAN STAY THAT EASY FOR THAT PERIOD !!!

I have gone through many such turmoils, and I am yet to even get a response from Unitech !!! The brokers as well as the sale guys o[censored]nitech, (both at the site and those at the Teynampet office) will say so many things when you book but nothing will happen after you book. The same cheat who promised you, will not even respond to you, after you book.

I was told the approvals will come through within a week, and that was about 8 months ago !!! The approvaols have not come and my home loan through HDFC is still to be sanctioned for want of approval papers from Unitech. I have already paid about 6 - 7 lakhs to Unitech and remain stuck.
