You had issued cheque on behalf of our bills raised and accepted by your company. You assured us that your company all the cheques will be honoured on its presentation to the banker. But it was to our surprise that cheque were returned by your bank as unpaid marked as “INSUFFICIENT FUND” 7 times instead of your repeated requests that you have some problems. We approached you various time about 100 calls 20-25 visits by our office persons and various requests by you above cheques were returned 3 times by the banker as unpaid. That since the aforementioned cheque has been dishonoured in view of the Act and omission, you have intentionally and clerly committed an offence under section 138 of Negotiable Instruments act 1881 s amended uptodate.. It is against requested to please make the payment of the above cheques within 7 days, failing which we have no alternative to file a criminal complaint u/s 138 read with section 142 of Negotiable Instruments Act 1881 ( s amended uptodate). That I draw your attention to the provisions of chapter XVII of the Negotiable Instrument Act, the dishonoring of the cheque attracts imprisonment to the extent of two years or with fine which may extend to twice the amount of the cheque or with both. You shall ignore the notice at your own peril and cost. A copy of this notice is retained in my office for further necessary action, if it is also desired. Complainant Sh Mahendra agarwal had approached Delhi Govt Mediation centre for taking of his case through mediation.The complainant has approached the mediation centre directly after knowing about it from one of his friends.Accordingly notice for appearance was sent to the opposite party who has appered before this centre and also showed their inclination to settle the present disputes
The present dispute is regarding the dishonoring of three cheques bearing no: 000097, 000213 and 000214 dated 20/7/2011, 23/7/2011 and 23/7/2011 for the sum of Rs 3000, Rs 7040 and 3309/- respectlively all drawn on Bank of India vikash marg, C&P Banking New Delhi 110002 out of these three cheques . First mentioned two cheques have been issued in the nameof m/s Quality of India and the third in the name of Hi-tech expositions pvt limite and these cheques have been signed by Mr Bharat on behalf of the second party.
During the course of the proceedings, it has been informed by sh Mahendra agarwal that he is the Director in M/s Hi-tech expositons pvt limited wheras he is the proprietor of m/s Quality of India.The parties have further informed that sh Mahendra agarwal has given certain comments/remarks on the intrnet against the second party.
Heard the parties separately and jointly and various proposals were put forward by both the parties .It is further resolved between the parties that:
1. That the 1st party shall take appropriate steps to remove the adverse remarks against the second party from the internet and in this process sh mahendra agarwal will also write a letter of request for the removal of the comments/complaints/remarks against the second party within 10days from today.
2. That after seven days of removal of the said comments/complaints/remarks from the internet, the second party shall make the payment of Rs 11000/- to the 1st party by way of demand draft in full and final settlement of all disputes in respect of the above referred 3 cheques and the first party shall simultaneously return the original of the above said 3 cheques to the 2nd party.
3. That the 1st party states that it has not initiated any other proceedings against the second party and in case it is found in future that any case has been filed by the 1st party against the 2nd party before and court /authority etc the same shall be treated as satisfied/settled.
4. That in view of the above, there remain no claims, disputes or dues etc of any kind arising out of the present complaints.
5. That the settlement has been voluntarily and freely accepted by both the parties.
6. It has been agreed that both the parties have undertaken to remain bound by the terms of the settlement.
