Dear Sir, I am re-posting the Old complaint again as there is NO ACTION in the matter till date. Its over 10 years now !!! Employee Name : Mr Hitendra Sampatsingh Mehta Employer : Deepak Agro Solutions Limited, Pune ( Group Company of Deepak Fertilisers & Petrochemicals Limited) Company Located at : Yerrawada, Off Shastri Nagar, Pune. [protected][protected][protected][protected][protected][protected][protected] FACTS 1. I was working with M/s Deepak Agro Solutions Limited as Manager (Finance). I had separated from Deepak Agro Solutions Limited w.e.f 31.10.2005. 2. Upon resignation, the PF forms, pertinent to PF withdrawal, duly filled and signed were submitted to PF authorities, through Company. The PF authorities, settled my PF a/c in full and post-disbursal, the PF authorities closed my captioned PF a/c. 3. However, in my Full & Final settlement, which was done after 4-5 months, additional PF of Rs 8482, on Privilege Leave encashment amount was deducted. This additional deduction was not contemplated while filing the PF withdrawal forms with the PF authorities. The need for this additional PF deduction arose due to clarificatory Notification on PF rules, reference notification no. coord/3(4)2002/clarifications dt. Sep 9, 2005 signed by SK Khanna Addl. Central PF Commissioner), which necessitated deduction of PF on Privilege Leave encashment amount. 4. The Company deposited the additional PF deducted alongwith Employer’s contribution, aggregating to Rs 16964, to my captioned PF a/c. 5. Upon following up with PF authorities for release of additional PF deducted and deposited by the Company, PF authorities gave the feedback that my PF a/c is closed and there is no due payable to me. Company made several representation with proof of deposition but to no avail, as the amount was not traceable at PF department’s end. They guessed that it could have gone to “Suspense a/c” as deposition was made by the Company after closure of my PF a/c. In Suspense a/c also it was not traceable. In the interim, the PF dept shifted it’s office and all the original forms filed by the Company were not traceable. PF authorities asked to file fresh forms. Fresh forms were re-submitted. However, vide it’s communication ref. MH/34949/2/XIII/PF/Accts/Pune/927 dt. 12.12.07, Office of the Provident Fund Commissioner, Golibar Maidan, Pune 411 001 returned the Forms No 19, 10C filed by the Company with remarks, “the attestation of the employer on the claim is not agreed with the specimen signature available in our records”. Subsequently, the Company filed the said forms on 22.10.2007 again with proper signatures. 6. Since then the Company has made umpteen number of follow-up with the PF Authorities but the matter still stands as unresolved. The Company also has closed down and there is no one to represent my case. It’s almost SIX YEARS and the amount is yet not disbursed by PF authorities, Pune. COMPLAINT It's sheer misgoveranance at PF office Pune. How can the amount depsoited through cheque that too by a Company get lost and be untraceable. Multiple times the forms were required to be submitted. There is no one who is desirous to resolve this matter. Original submitted forms get lost, no one bothers to reply and the matter is pending for around SIX years. ACTION REQUESTED 1. Request PF authorities, Pune to please trace the amount deposited by the Company. It’s a cheque payment and the bank entries can very well get cross checked. The deposition was for multiple employees, hence cannot go unnoticed. 2. Release my PF amount of Rs 16964 ( Employee + Employer contribution) alongwith interest thereon for approx. 6 years.( Now over 10 years ) Yours sincerely, Hitendra Mehta Cell : [protected]
