[Resolved]  Flat Owner — flat owner is not returning the security deposit

Hi, I am staying in Flat no. 503 Rohini L, DSK Vishwa, Pune. We have taken this flat on rent with proper agreement on 1st April 2013 from Mrs. Ulka (Flat Owner) and Mr. Kadam (Broker). Owner contact no.-[protected] & Broker contact no.-[protected]. We had paid Rs. 20000/- deposite and some brokerage amount to broker. Now due to my backache problem we are shifting to new flat near to my company. And we had already informed Mrs. Ulka in the beginning of December month that we will be leaving her flat on 28th December 2013 month. But now she is denying to pay. She is making excuses for not to return the deposite amount. She is not picking up our calls. Even broker is not helping us. Please please help us.

Individual — Flat owner not settlig the deposit correctly

(1) I had taken a flat for rent from Mrs. Prasanna Parvathy during April 2014 in Bangalore. The interest free deposit paid for the flat was Rs.1, 00, 000 and the rent per month was Rs.16, 000, plus maintenance charges of Rs.2, 800. From the beginning on behalf of the owner her husband Mr. K.C. Iyer as well as her brother Mr. Srinivasan were interacting with me for the purpose of negotiating the amount of deposit, fixing of rent etc. (2) Mr.Srinivasan had got the agreement prepared and brought for my signature after I moved into the flat with my family. In that agreement it was mentioned that the same is for the period of 11 months and at the conclusion of the said period 10% rent should be increased if we wish to renew the agreement for next 11 months. At the time I pointed out that in Bangalore it is not in vouge to increase the rent by 10% every 11 months for the flats of middle class range. For that Mr. Srinivasan had observed that any how the agreement was for 11 months and after the conclusion of the same it is not binding on either of the parties and new rent could be negotiated again. (3) So, we settled in the flat and after the conclusion of 11 months promptly the flat owner's husband, Mr. K.C. Iyer promptly asked for a rise of 10% in the rent and when I reminded him of our earlier exchange of talk with his brother-in-law, he mentioned that he is not aware of that. Then, I decided to vacate the flat. (4) During mid March 2015 I informed Mr. K.C. Iyer that I would be vacating the flat at the earliest and he had to settle my deposit amount. As the agreement term was over, there was no need to give any further notice to him. Then he told me to vacate the flat as per my plans by the end of March and he would settle the deposit on 10 th April. After this I requested him to at least settle the part of the deposit, but till 6th April he did not pay me a single rupees as settlement. But, I had vacated the flat for all practical purpose and waiting for him to settle the deposit to handover the keys. As he could not pay even by 5th of April, without receiving any amount towards refund of my deposit, I vacated the flat and handed over the keys to his representitive. Now, he has deducted rent up to 5th of April though he should have not taken the same for the delay caused by him. There by he has deducted Rs.3, 100 more rent from the deposit amount. (5) Further, he was entitled to deduct the cost of colour washing of the flat. As I am in real estate industry only I know for that job the cost would definetely be less than Rs.10, 000. For this purpose he as deducted Rs.16, 000 from the deposit. (6) Aslo, one month's electricity bill was due and Mr. K.C. Iyer has promptly collected the same along with Rs. 200 as late payment charges, whereas at any given time the late payment charges levied by the agency would not be more than Rs.20.
