[Resolved]  Icici Lombard — for not paying car claim for more than 50 days for cash loss policy inspite of receiving all the documents

Please Register a complaint against ICICI Lombard General Insurance Co. Ltd. In furtherance to our complaint dated 1.11.2014, it is regretted that no payment has been made till date by ICICI Lombard General Insurance Co. Ltd. The mail is repeated herewith for your convenience and further delay being caused is detailed below : Extraordinary delay in passing Claim of Car No. CH01AP0054, Skoda-Superb Policy No. 3001/82412279/01/000, Claim No. MOT04065746, disgraceful service in settling the claim taking more than 45 days on 0 dep policy having IDV of Rs. 17, 06, 250/- The above car met with an accident on 13.9.2014 at about 2.30 a.m. and car was deliver for repair same day to Giri Raj Motors, Gurgaon but till date the claim has not been settled. The brief particulars of bad service of your officers especially Mr. Rajeev Dhawan handling the claim are as follows:- Date of accident - 13.9.2014 Inspite of various phone calls senior surveyor was not appointed between 13.9.2014 onwards On 25.9.2014 the Investigation Officer visited our office to whom the required undertaking and details were provided On various phone calls and personal visits, nothing concrete was informed, only it was informed that the investigation has been completed On around 17.10.2014 it was promised by Mr. Sidhanshu your officer that it is a full loss and the claim amount would be paid by 22.10.2014 Your officer Sh. Rajeev Dhawan never responded to various calls of ours On 27.10.2014 it was informed by Sh. Rajeev Dhawan the car has been put on online auction to pay the full loss which will be settled by 31.10.2014 But on 31.10.2014 your officer Sh. Rajeev Dhawan refused to various phone calls made to him, lastly various messages were sent to him in the evening but and the response received was that the exact information will be provided on 3.11.2014 and if the full loss is not paid by 3.11.2014, the repaid of the car would be initiated on 4.11.2014. It has taken 52 days to settle the full loss and now it is being informed that on 4.11.2014 the repairs will be initiated. We hereby give you a notice to settle the full claim by 4.11.2014 or else we will file the damages case against the company and its officers for providing disgraceful services in settling the claim. After several phone calls made from 11.00 a.m. till 4.00 p.m. to Mr. Rajeev Dhawan on 3.11.2014, the following mail was received at 4.00 p.m. on 3.11.2014 Rajeev Dhawan <rajeev.[protected]@icicilombard.com> 4:01 PM (20 hours ago) to pavansacheva, me Dear Sir, Plz find below list ...if settled as Cash Loss basis 1) Original RC. 2) Original keys (All) 3) 5 Photos 4) Foreclosure/Financier NOC if hypothecated with bank. 5) AML Docs ( PAN Card, Address proof ) 6) If Superdhari on vehicle then Sale letter issued from court. 7) Service Manual 8) Original Invoice if Hypo not mentioned on RC. 9) Indemnity as per cash loss settlement. ( on 100 Rs stamp paper attested by the notory, attached ) 10) Request Letter ( As attached on plain paper ) 11) Form 28, 29, 30, in triplicate 12) Cancelled cheque with printed name. ( if name not printed then pls attach bank statement ) Address/Signature on the claim form should match with AML docs provided. Rgds Rajeev Dhawan ICICI Lombard - Nibhaye Vaade. The documents required above were made ready by 5.30 p.m. on 3.11.2014 and it was requested to Mr. Rajeev Dhawan that if they can be delivered at Gurgaon office by 6.00 p.m. but he declined to receive the same day and called the CMD to deliver the papers at Green Park Office between 11.00 and 11.30 a.m. on 4.11.2014 so that the full loss payment can be made immediately. The required documents have been delivered at 11.20 a.m. on 4.11.2014 which have been duly checked by Mr. Sunny Bhalla of your company’s office at Green Park, New Delhi. It is important to note that the required documents delivered did not specify the claim amount as they were asked to be given blank. NEFT form has also been sign and submitted. The copy of the letter submitted is as follows : MS SHOES EAST LTD. 112-A, EKTA ENCLAVE, NEW DELHI – 110 087 Ph. No. [protected] E.mail : [protected]@gmail.com CIN No. L93000DL1986PLC023612 Ref: ICICI/Insurance claim/0054 Date: 3.11.2014 To, The Manager ICICI LOMBARD GIC LTD. Gurgoan. Dear Sir/Madam In reference to your e.mail dated 3.11.2014, we are enclosing the following : 1. Original RC 2. Original Key 3. 5 Photos of Pavan Sachdeva, CMD of the Company 4. Foreclosure/Financier NOC is not required as we have not taken loan against the Car. 5. AML Document – PAN card of MS Shoes East Ltd. & Pavan Sachdeva, CMD of the company and address proof- Form 18 filed with ROC, Company Master Data, view of signatory details and Form 25C filed with ROC showing Pavan Sachdeva as Managing Director and Memorandum & Article of Association. 6. Superdhari is not required as the car is not on Superdhari. 7. Service Manual. 8. True copy of Invoice. 9. Indemnity on Rs. 100/- stamp paper attested by Notarised for cash loss. 10. Request Letter 11. Form 28, 29 & 30 duly signed and stamped in triplicate 12. Cancellled Cheque with printed name (HDFC Bank Ltd.) PLEASE NOTE THAT THE CLAIM HAS ALREADY BEEN DELAYED MORE THAN 50 DAYS, WE EXPECT YOU TO PAY THE ENTIRE CLAIM AMOUNT WITHOUT FURTHER DELAY BY 6.11.2014. Sd/- Chairman-cum-Managing Director Pavan Sachdeva (Original Received and signed by Sunny Bhalla on 4.11.2014 at 11.20 a.m.) However, after receiving all the documents Mr. Sunny Bhalla informed that it will take seven days to receive the money which will be given after the buyer pays. Further the balance amount would take another two weeks thereafter to be remitted from Bombay office. It is important to note that as per Mr. Rajeev Dhawan the online auction was completed on 31.10.2014. It is regretted that we are not concerned whether you sell the car and when you sell the car. We are concerned with the cash loss which occurred on 13.9.2014 but still we have been told to wait for another 20 days to get our claim. This is what your insurance company is upto keeping the claim of Rs. 17.00 lacs to earn interest on the money holding to settle for more than 60 days. We again reiterate that if the payment is not made immediately by 6.11.2014, we will be constraint to file damages case against the company in all forums.
