Idea Cellular — Excess data billing

Dear Idea cellular
I have subscribed to 1GB, 2G internet pack. There is no possibility o[censored]sage of 2200 MB for which I have been billed.
Even if I had exceeded, I was not notified of it by sms or any other means.
My phone also shows a data usage reading of 760 MB .
Please look into my data usage, I am sure there is a mistake at your end.
Provide me with details of my data usage.

I further wish to add that my total data usage over 2 billing cycles has not exceeded 1 GB.
In the latest billing cycle it is around 700 MB
I have completed proof of it in my phone, if required, I shall produce it .

The issue has not been resolved.
1.) My sim card has not been inserted in any other phone other than my own LG handset, this was confirmed by your consumer care executive who contacted me. The internet usage was always from this particular handset.
2.) My phone data usage meter shows a data usage of well under 1GB.
3.) the costumer care executive kept on pressing on the fact that their system shows exceeded data usage, which I already know! But this does not prove it true due to the conflicting readings on my phone and your system. Also, the data readings on the phone cannot be tampered with (LG Nexus 5)
4.) Further, this had never happened in all my life, there has always been a close agreement between the data readings on both ends.
5.) Most importantly ! No message or notification of any kind was provided to me that I have exceeded my data limit. Even this was affirmed by your customer care executive. However, as per my knowledge, it is mandatory as per TRAI norms to provide 80%, 90% data warnings. The customer cannot opt out of this notification. The explanation given by the customer care executive for this was that the customer needs to activate these notifications. Which is false!! Even if it were true, how do you explain not informing me about this and the procedure for activation? Plus, a customer may need to activate the notifications but he does not need to activate warning SMS. this logic is technically flawed. This is not a value added service SMS I can choose to opt out from. Also I have done my research, a customer cannot even block this sms. There is no way on my part to intentionally not receive this message.

At this point I would request you to properly understand all the above facts. Upon understanding these facts, the following is inferred:-
1.) Both idea and me (the company and the customer) are equally likely to be right or wrong about the data volume consumed by me since both show conflicting readings. If you see my past history of bill payments, you'll see that I have paid all my bills promptly even when I had exceeded the data usage limits because in those times I knew that it was legitimate. I have never created a fuss about legitimate billings. Therefore, in this situation, the company (Idea cellular) is required to provide me with a Benefit of Doubt and compensate me for the extra bill amount collected by me by adjusting the differences in the subsequent billing cycles.
2.) Referring to point no.5 above: this is a clear case of negligence or failure of the company's systems. The customer service executive affirmed this. And as per my knowledge, this is violation of TRAI norms.This is a very strong point in my favour which makes it legally obligatory for you to compensate for my losses. Failure to do so will be legally deciphered as ' UNLAWFULLY WITHHOLDING INFORMATION FROM A CUSTOMER IN ORDER TO MONETARILY EXPLOIT HIM'. The customer has the comfort to take it for guranteed that he will be duely notified when he is on the verge of exceeding data plan limit. I rightfully took this comfort and ended up being exploited.On your end it is to be assumed as a fact that the customer has no other means of monitoring his data volume.

Given that I agreed earlier in this post that I do indeed have the means to track my data usage, but it has been established earlier in this post that there there is a conflicting data reading at both our ends. So to sum up we have :- failure to provide benefit of doubt, add to this withholding data usage information, your customer care executives testifing in support of this(mentioned above), failure of local idea office to understand the issue, harassment by barring my services for extended time, paid full bill for the month on which my services were mostly barred, causing a PHYSICALLY HANDICAPPED CUSTOMER to be made to approach the nodal office repeated number of times only to end in futility.Thus this is a case of multitudinous levels of harassment faced by a single customer simply due to the fact that my complaint, given its complex and unique nature, has not been thoroughly understood by idea cellular. Next time, I request you to only let someone educated enough to call me only if required. I however am hoping to receive a compensation mortification instead. Having to explain the whole scenario again to another new person will be considered the same as yet another episode of harassment.
P.S: I am a differently abeled person, it is very difficult for me to run around to the company's regional offices or to the consumer court if need be. I would request idea to put an end to this and provide be with my rightful compensation.
