[Resolved]  Jaipur Nagar Nigam — Life & property threat by basement construction of 82/41

Dear Sir, I, Mintu Dubey, owner of 82/42 in Mansarovar, Jaipur, want to bring to your kind notice that construction of 82/41 is created the threat of stability of the structure of my house. Basement has been excavated and the work has been in progress. To my understanding with logic and technical structural stability following points have been overlooked:- 1 Originally the colony was made as group housing scheme by Rajasthan housing board, Jaipur with an oath to maintain the originality of the plan given and constructed/executed by the lessor (housing board) but lease holder has changed the entire plan by demolishing the old house fully & excavating upto the depth of 9 to 12 feet from ground level. 2 As per the approved/signed/Notarized Rajasthan housing board perpetual lease document clause no 13 all the lessee takes oath as quote “ The lessee shall not without the previous permission in writing of lessor (housing board) and also the sanction on permission in writing of proper municipal or other authority erected or recreated of the house/flats of make any alteration or addition either externally or internally, to such house/flat provided further that in cases where addition of subsequent story is permissible under a scheme the leesee shall follow elevation etc. as prescribed by the board”. 3 Foundation of the original whole colony is only 5 feet below ground level where as the said house 82/41the excavation is done approximately 9 to 12 feet from ground level without setback. Hence the stability of my house i.e. 82/42 is in great threat. While doing so he has undercut my foundation also which has lead to high risk to the stability of the structure. 4 He has constructed the RCC pillar at “0” setback distance from my side in front building offset covering my open space given by housing board which was meant for ventilation & sunlight. Such construction should not be permitted/demolished. 5 As per Rajasthan Govt. Gazette dated 22/02/2010 section 9.7. (1) & 9.7. (4), the owner of 82/41, Mr. R.S.Gupta has completely violated the norms side setbacks. 6 No consent bond ( Chati purti band patra, as per clause no. 9.7.1 sub clause (i) of above said Rajasthan Gazette notification ) has not been submitted since no consent from my side has been asked for by Shri R.S.Gupta. 7 As it is well known fact that Jaipur is coming under category of Zone 2 of seismic zone these pillars strength should confirm the statute provision so that the safety is maintained. 8 The said work in the house no 82/41 is going on without any safety measures like piling, shoring & shuttering. Hence it’s an additional hazard to work force and to the safety of nearby structure. 9 No approved drawing/plan/structural drawings approved by competent person as the whole structure is dismantled and reconstructed has not been shown or kept at the site. 10 The owner of the house Shri R.S.Gupta has excavated his property from last four month and made the shape of the site as a pond and I stay far from this place this matter came to my knowledge three days back. The monsoon is about to knock the door soon the risk will rise exponentially. The safety barriers must be constructed immediately without delay and laps of time. From the above pictorial representation you will appreciate that the basement construction will make the site unstable. I am of hope that no such permission to excavate the basement might have been given. Even if by mistake such permission is accorded I would request you to kindly review the permission & cancel the basement construction of Shri R.S.Gupta & maintain the original status as provided by housing board. From the above, I may be able to convey my concern to your kind self the unlawful & unsafe construction carried out in house no 82/41, Arawali Marg, Mansarovar, Jaipur, Rajasthan, with repeated request with folded hand to take care of my, my family, my property, etc’s safety. Your help and cooperation in this regard will be highly respected & solicited. Thanking you.
