[Resolved] Kotak Mahindra Bank — Onerous and illegal charges on credit card not in use | |||||
I am a holder of Privy League Signature Credit Card of Kotak Mahindra Bank. Being harassed by rude calls made by recovery agents on a day to day basis for the re-payment of credit card dues, I called the customer care and expressed his desire to cancel the credit card, because it was a cause of not only mental and psychological agony and harassment to me, but also resulted in a drain of my financial resources, in the form of lot of onerous and unexplained charges, which was levied every month and reflected as a part of amount due. Getting in touch with the customer care executive and explaining to him the problem is another ordeal that every customer is put through. Calls are transferred and disconnected innumerable times, before the call finally goes through. It appears that it is not customer care but a customer harassment centre. Anyways that is a subject matter which is not being discussed herein. So finally when the call connected with the customer care executive, I enquired the total amount payable for cancelling the card. After a call which lasted for about close to two hours, I was told that the total amount payable was approximately Rs. 1, 01, 250/- (Rupees One Lakh Two Hundred and Fifty only). Approximately because the ban k could not tell me the exact amount due. I clarified with the so called customer care executive that if I paid the indicated amount, would the card be cancelled. He told me yes. So, as discussed with the so called customer care executive, I made a payment of Rs. 1, 01, 250/- (Rupees One Lakh Two Hundred and Fifty only) on 01.06.2016. I also told the concerned executive at the bank branch that I was making the payment so that the card could be cancelled. He called the concerned officer from his phone and enquired the amount due for cancellation of the card. The concerned officer told him to make a payment of Rs. 1, 01, 250/- (Rupees One Lakh Two Hundred and Fifty only) and the card would be closed. Hence, I made the payment and of Rs. 1, 01, 250/- (Rupees One Lakh Two Hundred and Fifty only). The payment of the said amount of Rs. 1, 01, 250/- (Rupees One Lakh Two Hundred and Fifty only) was made with a great difficulty. Recently, I was shocked to receive a message from the bank, indicating that an amount of Rs. 5, 959.03/ (Rupees Five Thousand Nine Hundred and Fifty Nine and paise three only) was due. When I called the bank to ask, I was informed that annual charges had been levied on the card. I replied that I had on various occasions requested the card to be cancelled. The executive quite rudely replied that I could not prove the same and that I had to pay the said amount. I requested him to raise a request to record my complaint. He refused. I told him that I will be constrained to redress my grievances before appropriate forums, to which he coldly replied that I had to make the payment and that such complaints are made on a daily basis but nothing happens, and that I would end up running from pillar to post. I am victim of onerous and illegal charges being charged to my credit card, which I do not even use. It is not only illegal, but also unethical and unfair trade practice. The bank and its officials are randomly levying charges on my credit card, which at the time of taking was made out to be free of annual charges and hidden costs. This is inter alia unfair trade practice, abuse of dominant position and in any way illegal. Recently, I have also come across various people who have been burdened with such charges at some point of time or other. The onerous charges and terms and conditions are not appraised at the time of taking the credit card. In fact, an unsuspecting customer like me is told that the card is free and without any charges. I request you to kindly reverse the illegal and onerous charges levied on my credit card, otherwise I will be constrained to approach appropriate forum/s to redress my legal grievances, in law – civil, criminal and tortious.
