[Resolved]  Magic Holidays — REFUND OF RS.22895/- DUE TO CANCELLATION OF MEMBERSHIP AND CHEATING OF MAGIC HOLIDAYS(PANORAMIC GROUP CO.)

I had registered for Membership at Magic Holidays on 12.10.2014 with the amount of Rs.22895/- in the name of M J Tandel at the Big Bazar, Mulund(w). Magic Holidays executives(Deep Sharma, Deepak, Iqbal) smart cheating stratergy is by giving false promises in the big bazar to my wife that my wife got a gift item and constantly were calling to my wife to come with husband, she has been selected for gift items but they will give this gift item if she comes with the husband in their Magic Holiday Br. and then we will have to listen the entire package Then we will get the gift item. Then we went their and became a member in hurrily manner as marketing executive will not give any chance to think, read the form, continuously tells us this is a todays offer only. We have to sign the form and pay the money immediately by credit card. Ultimately they have given a false promise that our gift item (as per scratch card) will be delivered to our residence. But till date we have not received any gift item. But we have been trapped and cheated by executives by taking our signed membership forms hurrily with immediate money of Rs.22895/- by credit card This was a initial cheating trap of Magic Holiday. Initially you will not get anything in writing but only and only false information and false promises only. This is total injustice to me by non-refunding my money according to the terms & conditions which your marketing executive never explained to me. We do not know "Look in period" Can you explain me? As already clearly stated in my earlier various mails, You must refund my paid amount Rs 22895 with 15% interest within 3 days otherwise I will go to consumer court against your Company and also fight against your faulty package which is in favour of company than customer. If I never get any refund, ultimately I may lodge a police complaint against your Company and Mulund Branch all executives(Mr Deep Sharma, Iqbal Shaikh, Deepak Trivedi) due to cheating made with smart marketing stratergies by offering false promise of gift item, taken our signature hurrily on the forms without giving time to read, never given any copy of signed forms as well as payment receipt, no clarity in the Price scheme when explained orally, nothing has been shown properly and nothing has been given in writing at the time of taking membership on 12/10/14. We had received the actual kit in writing after 22 days i.e on 4/11/2014 then only we came to know the actual price scheme and other terms and conditions which is totally different from actually explained to us, Then Company could not fullfilled their marketing commitment on 9/11/2014 i.e. Enrolment offer within time limit. Initially the same was totally refused and then after 20 days i.e.on 29/11/14 it was given after our continuous fighting for refund and cancellation of membership. This booking is of no use because already we had cancelled the membership due to various reason. Now company is not giving me refund by keeping finger on Company's terms and conditions and trying to eat my money. Your terms and conditions are cheating terms and conditions for customers. Now it is confirm that your Magic Holiday is having cheater executives and your Company is Fraud and cheating Company. When I read various complaints against Magic Holidays on Internet site. I am shocked by reading so many those complaints because Magic Holidays already cheated to various customer like me. All customers are saying your Magic Holidays is a FRAUD COMPANY and have cheated so many customer like me. We remember when we discussed the issue with Mr Jayesh Dethe for few minutes on 13/11/2014 and He has promised us that he will investigate entire issue and he will call us on Monday or Tuesday to discuss the issue. Definately we will get the refund and also Mr Jayesh said that why company will retain this smaller portion of money which is not enough to make the properties. He will do justice for us. So Company simply by sending mail dt. 17/12/14 without any discussion and giving chance to speak customer, taking one side decision which is against democracy, your company forfeited the amount paid towards the membership. This is totally injustice to me and this will definitely affect my family relation and your company is totally responsible for any future consequences. Ultimately Mr Jayesh Dethe is also involved in this fraud company as he has not discussed and replied to my mail since last 10 days and keeping quite by eating my money. You have refused my refund on cancellation of membership due to following reason : 1)COMPANY => According to the terms & conditions signed and accepted by you at time of enrolment, an amount paid towards your Magic Holidays membership is refundable only during the look in period. => CUSTOMER ANSWER => First of all I have not filled up the Enrolment Form and it is filled up by your Marketing Executives only so there itself it proves that it is your smart cheating marketing stratergies and malafide intention of cheating "Do not give chance to customer to read the enrolment form and its terms and conditions while filling up the enrolment form". Then Your marketing Executives Mr. Iqbal, Mr Deepak and Mr Deep, have taken signature in hurrily manner and forcefully on one single enrolment form and have not given any time to read the enrolment form and its terms and conditions. Thereafter till date we have not received any copy of signed enrolment form, payment receipt, written terms and conditions etc which your executives are suppose to give. There itself it proves that your marketing executive intention is malafide and is going towards cheating only. The intention for not giving copy of enrolment form is "Member should not read and know the membership rules, terms and conditions within LOOK IN PERIOD" so that after reading these rules, terms and conditions, members should not cancel their membership within LOOK IN PERIOD. So all the procedures happened in so quick and hurrily manner that now we felt that Marketing executives hypnotise us so that we should not ask anything more and know more about Enrolment and membership terms and conditions. Quickness will be proved from all my signatures are differed from each others signatures on all the copies of entrolment forms. It seems that I have not signed any Enrolment Form more than one but when I asked my scan copy of enrolment form which is given on 4/12/2014 after 52 days (from enrolment date 12/10/2014), then only I came to know the actual rules, terms and conditions of membership, it is clearly visible that all my signatures differ from each others signatures on all the copies of entrolment forms. It proves the kind of pressure created for taking signatures on enrolment form. So for me actual look in period start from 4/12/2014 when I actually received the scan copy of enrolment form for reading terms and conditions. But I had already cancelled your membership on 12/11/2014 then subsequently sent so many mails vide dt.16/11/2014, 17/11/2014, 19/11/2014, 22/11/2014, 27/11/2014, 28/11/2014, 2/12/2014, 6/12/2014, 12/12/2014, 13/12/2014, 17/12/2014, 23/12/2014 clearly stated in all my these mails that I have cancelled your membership and you must refund my money of Rs.22895/- with 15%. 2) COMPANY => Since we have received your request for cancellation after the stipulated duration, we are constrained to forfeit the amount paid towards the membership => CUSTOMER ANSWER => Do you fulfilled your marketing committed Enrollment Offer within stipulated duration. The ANSWERE is "NO" Then you have no authority to forfeit my paid amount towards the membership due to canellation after the stipulated duration. It is a total failure on your be part for fulfilling your committed enrolment offer on time. You totally refused to give me the Udaipur booking against your committed enrolment offer and then ultimately I cancelled your membership on 12/11/2014 due to total dis-satisfaction of your service and treatment given to me and failure to fulfil company commitment vide enrolment offer letter dated 4/11/2014. Please note that You can not retain customer money if customer is not availed any benefit from your Company and also there are no expenses incurred to the company. Rather, I will say it is a cheating made by your marketing force and ultimately by Company with me if you retain my paid amount. Definitely I will take legal action against your marketing force and Company for retaining my paid amount forcefully and ultimately it is treated as "Cheating terms and conditions" only. You must refund my paid amount Rs 22895 with 15% interest within 3 days otherwise I will go to consumer court against your Company and also fight against your faulty package which is in favour of company than customer. If I never get any refund, ultimately I may lodge a police complaint against your Company and Mulund Branch all executives(Mr Deep Sharma, Iqbal Shaikh, Deepak Trivedi) due to cheating made with smart cheating marketing stratergies. As promised by Mr Jayesh Dethe, issue will be investigated and then will be discussed with us. Definitely justice will be made with us by giving refund against cancellation of membership. Till date I have not received any refund amount of Rs.22895/- with 15% Interest due to cancellation of Membership as well as Mr Jayesh Dethe have not at all shown any courtesy to give your reply to my mail dt.17/12/14 and also you never called us since last 10 days. Now it is proved that you also involved in this fraud company and not doing any justice to your valued customers which you had promised 10 days back. You must refund my paid amount Rs 22895 with 15% interest within 3 days. Also please return our all the documents(signed original form, signed ECS form, cancelled cheque, pan copy, copy of telephone bill etc.) which we had submitted to you at the time of enrollment. Please also confirm that you have cancelled the membership in your record as well as also confirm that company has stopped deduction of monthly charges as per ECS form completely due to cancellation of membership. This was already informed to you at the time of cancellation of membership. Awaiting your positive reply by refunding my money with interest.

Mr Jayesh Dethe,


This
is total injustice and harassment made by you and your company with us by taking
one side decision without considering and listening our sayings and bluntly
refused to refund our money on the grounds of your terms and conditions as per
signed enrolment form which your executive quickly taken our signature and not
at all given us the time to read the terms and conditions, taken away the signed
form immediately after our signature by your executives’. Also You are suppose to give us the copy of
form when we signed but your executive never given with a cheating intention
that we should not read the detailed terms and conditions of the package so that
subsequently we may cancel the membership immediately. we have not received copy
of our signed form till date for our
reading. Please note that Signed
enrolment form is one side and other side we are asking a refund against
cancellation of membership at the initial stage only and due to dis-satisfaction
of your customer service, false promise of gift item which will be delivered at
home, non-fulfillment of your enrolment offer(marketing offer) on time, false
oral information, difference in oral information at the time of enrolment and
actual package received by us after 22 days ie on 4/12/14. So it is my right to claim a refund amount if
we are not satisfied about your service, when we have not at all availed any
benefit or enjoyed your properties at the inception after becoming a
member. You cannot simply refuse to
refund our money on the ground that we have signed an enrolment form and now
company cannot refund our money as per your terms & conditions. Ultimately
it will be treated as cheating only by retaining our money without any justified
reason. So we will request your company
to please take our refund issue with your higher authorities and reconsider the
issue without any further delay i.e
within 3 days otherwise we will compel to take legal action against your
executives and company which please note. You and your company will be held
responsible, for my financial loss to me as well as mental harassment to me and
my family, for any consequences due to non-refund of our money and for any legal
action taken by us against your executives and your company. Now we are claiming our refund amount only
but if you are not refunding my money within 3 days i.e. before Wednesday
31/12/14, refund amount Rs.22895/- will get increase by adding interest 15%
w.e.f.12/10/2014, mental & physical harassment cost, legal cost incurred by
us in this connection and any other cost which we may be incurred towards
getting refund legally i.e. advocate fee, Xerox expenses etc.. Please note that my wife health is also
affected during last few days due to this refund issue. If we incurred any medical cost for both of
us, this will be added along with refund amount which please note.


As
per my trail my, yesterday myself and my wife, 2nd time had visited to your HO
on 27/12/2014 at 4 pm regarding taking our refund amount of Rs.22895/- due to
cancellation of membership. 2nd time, we experienced very
bad treatment from you and your company which we will never forget
(Unforgettable time badly experienced with your company). You awaited us for
half an hour and there was no polite courtesy seen from your company and that
too from Head Office executives. We never expected such type of bad treatment
from executive seating at HO without making any justification towards their
valued customer. This is shame on your company and you all people, specifically
you as a senior executive. One side you are writing greetings, always with
customer and valued customer but practically, it is not at all seen when we
visited twice to your Head Office. When we repeatedly reminded your reception
counter, even though you and your company never bothered to meet me to discuss
the issue. We know we came to your office without appointment but it does not
mean to neglect the valued customer. The reason is you are unnecessary delaying
our issue with an intention of eating our money only by taking help of terms and
conditions. When I have already written a mail dated 23/12/2014 Tuesday for
discussion and then you are started calling from Friday 26/12/14 late evening at 6 pm that also I picked up by
giving a reply to your executive that please call after 5 minutes as right now I
am busy with my higher authorities. But your executive never called me again.
Then I called back but unfortunately, I heard your regular office timing tape.
It is observed that regularly last 2/3 times your executive called on same time
i.e 6 pm even. by giving miss call so that you can send the mail
dt.27/12/2014 stating that your executive called me but I never pick up the
phone and you have given an appointment on Monday. This is a poor and smart
customer service when I am writing a mail on 23/12/14 and customer wanted to
discuss for getting proper justification to his issue. You must appreciate and
welcome the customer for discussion immediately instead of avoiding the
customer. But on the contrary there is a 4 days delay in replying my mail
saying your authorities are not available. Please remember any company will
prosper and will make growth if there are no grievances against their company
and even though there are grievances/complaints, it should be resolved with the
proper satisfaction of customer only. This will create confidence and goodwill
about company in the minds of customers and it will be automatically spread into
market very fast. We are very sorry to say that whatever your yesterday’s
behavior towards us was very shameful and very bad because when you ultimately
came outside at 4.40 pm(we literally waited 40 minutes), you never apologize or
said sorry to us for waiting us long time (40 minutes). When we asked you,
you started blaming us that we have come without your appointment and your
authorities’ time is more precious than customer time. When, we demanded our
refund amount immediately. You, Mr
Jayesh Dethe, Sr.Executive of Magic Holiday, started showing us the Enrollment
form which is signed by us and as per terms & conditions of the form we will
not get the refund. It is our fault only. We also said whether company has
fulfilled enrolment/marketing offer on time.
But Mr Jayesh was not ready to listen anything. He was showing the signed form again and
again. We also replied that all the
signatures differ with each other on all the copies of forms. I do not remember
whether I have signed all the copies because style of signatures differs with
each other. I also told Mr Jayesh that
we have not received any copy of form and receipt till date. It also proves the
kind of pressure created by the marketing executives When we again and again
demanded refund amount today only. Mr
Jayesh Dethe arrogantly loudly replied us in marathi that "REFUND AMOUNT NAHI
DENAR JHAH” (REFUND
AMOUNT WILL NOT BE GIVEN TO US AT ALL WHEREVER WE WANT TO GO WE CAN GO BECAUSE
WE HAVE SIGNED ENROLMENT FORM). Whether
this is the way one senior executive should talk like this. So we got wild after
listening above sentence and asking the refund immediately. But you threaten us that you will call the
corps. Whether this is the way your HO
executive should talk with valued customer.
This itself proves that Mr Jayesh Dethe, Sr.Executives is having cheating
type, rude, arrogant type nature behavior towards customer and not giving any
justification to the customer. Due to such type of executive behavior, issue
will not be resolved but definitely aggravate the issue more.


Ultimately
it is not our failure but your company’s executive failure to convince the
customer and win the confidence of the customer. Mr Jayesh never investigated the matter
properly and given the decision one side without taking into consideration of
our saying and points. If Mr Jayesh
would have taken a decision to refund our amount at the initial stage only, then
it would have proved genuineness about company and definitely it would have
created confidence of the customer towards company and its executives. We would
have felt that some justice is there with your higher authorities at HO. This is one type of publicity which is very
important from company’s point of view.
Now I am giving this advice free of cost and not like you by eating my
money without giving any benefit on time and ultimately making injustice on us
by retaining our valuable money. I will ask one question to all your executives
(Mr Jayesh, Ms Pradnya, Mr Deep, Mr Deepak, Mr Iqbal), please keep yourself in my
place and what you would have done if your money is taken away by somebody
without any justice and proper reason? Can you bear this cost without any
benefit and enjoyment? The answer is
definitely “NO”. So my request to all
your executives please think and make a justice to me by refunding amount to me.


If company is having such type of cheater
executives, company’s survival is definitely in danger because whatever
marketing or business they are doing by eating customer money with the help of
smart cheating marketing strategy i.e filling up the form by executive and
taking customer signature in quickly manner without giving any chance to read
the form and also they are not giving copy of signed form so that customer
should not read the hidden terms and conditions. Then customer should not cancel
the membership within their look up period of 10 days. It proves that there is
no clarity while selling your product.
All the genuine and customer like us will definitely curse to individual
executive of the company as well as company as whole. Definitely, today God has punished us by
giving financial loss along with mental and physical stress to us but tomorrow
God will definitely punish all the executives along with company more than our
financial loss which will not be recovered at all. This will make the Company to CLOSE and
terminate all the executives seating at home and no executive will get any bread
and butter due to their past bad behavior i.e CHEATER. Please note that all good
and bad destiny give rewards accordingly, you have to suffer in this life
only. Because GOD has recorded all the
things in proper manner and time will come, today company eaten my money and
ruined my tours and enjoyment, tomorrow it will be revenged on all the concerned
executives and the company as a whole by GOD. Remember ultimately GOD is their
to make the Justice to everybody. CUSTOMER SATISFACTION IS ULTIMATE SATISFACTION
WHICH WILL MAKE YOUR PUBLICITY AUTOMATICALLY THAN ANYTHING ELSE i.e
CHEATING/FRAUD. Whenever you sale your product there should be a clarity in your
product, win the customer confidence and trust, disclose all the terms and
conditions, if customer is not satisfied about your product please reimburse the
customer immediately as it happens one single case out of 100, always give
respect to customer because CUSTOMER IS GOD FOR YOU. BECAUSE REMEMBER ON HIS SATISFACTION YOU ARE
RUNNING YOUR BUSINESS AND EARNING YOUR BREAD AND BUTTER WITH PROUD
FEELING.


Your
organization is cheating the customers by not providing complete information
about product even signed copy of agreement is also not provided at the time of
registration. This
is not a FMCG kind of product to return if not liked in 10
days.

You must refund my paid amount Rs 22895 with 15% interest within 3
days. Also please return our all the documents(signed original form, signed ECS
form, cancelled cheque, pan copy, copy of telephone bill etc.) which we had
submitted to you at the time of enrollment.
Please also confirm that you have cancelled the membership in your record
as well as also confirm that company has stopped deduction of monthly charges as
per ECS form completely due to cancellation of membership.


Please
note that now we have made a complaint to R MALL Br. as detailed above on
27/12/14 and informed R MALL Management that very shortly we are going to lodge
a police complaint against all the executives of Magic Holidays against CHEATING
made with us by non-refunding of our money when I have not availed any benefit
from the Company. One more information
we have received that we are the 2nd person who is making such type
of complaint. It means already one
person has lodged the complaint against Magic Holidays, R MALL
Branch.

This in regard to your complaint Mr.Mohit Tandelji, I DEEPAK TRIVEDI, would just like to reminde you your almost sat for more than 2hrs for presentation and heard all the pros n cons before swapping your Debit card for paying your down payment nobody had put hand in your pocket or had forcefully asked to pay the amount which only after getting fully convinced you paid secondly knowing there is no refund policy after 10days cooling period and before receiving the membership kit you are verified through a verification call from the admin department which is always on records but this entire hush hush from your side was only what I belive is regarding the booking which was even provided to you on your selected destination that too on your given dates of which mail copy you have not attached on this portal I still do not understand just either reading few negative reviews or may be u know better why were to requesting for withdrawal whereas I belive there only few hand full of people if they are not satisfied had put their remark not a single Member of Magic Holidays who had been on holidays had put a single negative remarks which is what we still belive in service as a customer service oriented company I would once again request you please see to belive rather than just to listen few mouthfull of words. I hope if you are driving a car on the raid and there is an accident on the road you see of the same model of car will you ditch your car or you will blame the driver please think wise we are still open to serve you at the best of our serving capacity
Hi, I'm Sanjay Vaidya ([protected]) a Member of Magic Holidays since 2010, Mr.Tandel on request of Deepak Trivedi I just want of clarify, We had been on holidays at Mahableshwar & Karnala, whereas Mr.Bhupendra Pal my friend again who had taken this membership had been to Singapore & Thailand and had been so far in the best of memories with our family. Hope you might had an expereince of your holiday with your family before getting negative. Rest is all your call.
