Maruti Suzuki India — Unethical and illegal behavior of dealer

Subject: unsatisfactory service by maruti suzuki dealer in hyderabad, india.

Based on my recommendation, my mother has purchased a maruti suzuki celerio and has been encountering several problems because of defective service from a maruti dealer in hyderabad, india.

I am listing all the deviations and consequent problems my mother (A senior citizen) has been facing on account of your dealer in hyderabad.
1. The car was delivered on 14th march 2016, and the permanent registration documents (Prd) are supposed to be given to the buyer, along with the vehicle on the same day. The same is also mentioned in the temporary registration document (Trd).
As per govt. Rules, the vehicle must undergo permanent registration (Pr) within 30 days from the date of delivery, and the physical presence of the owner is mandatory, since the owner’s photo will be transposed on the registration card.
2. Driving the vehicle after 30 days from the date of delivery is a direct violation of the law for which, my mother could be imprisoned and heavily fined. Furthermore, in the event of any accident, even if it is the mistake of the other vehicle, my mother’s vehicle stands to lose any insurance claim, despite paying rs.11, 000 (Approx). Also, liability of loss/damage to the other vehicle or persons. And it will be a criminal case against my mother for using an unregistered car and causing accident/damages.
3. Though the vehicle was delivered on 14th march 2016, the registration documents were not handed over, even though my mother and father visited the dealer on 4 consecutive days – 15th, 16th, 17th and 18th of march.
My father urged and pleaded with the dealer to deliver the registration documents immediately, regardless of the charges. The dealer charged rs.635 towards services for registration and yet did not deliver those documents.
4. After futile visits to the dealer for documents, my mother had to leave hyderabad due to family emergency on 19th march 2016. (My sister, who lives in bombay, delivered a baby, 40 days prematurely, and because of this, my mother is not in a position to leave my sister and the new born for 4 months. Furthermore, the doctor has strictly advised my sister not to go out for 4 months.) consequently my mother cannot leave the new-born and its mother, just for the sake of permanent registration, which could not be completed, before the emergency occurred. If only the dealer had handed over prd, as mentioned in the tdr, my mother could have completed the permanent registration before the emergency occurred.

While this is the main problem about the complications in completing permanent registration formalities, we suspect the dealer has resorted to the following unethical and maybe even illegal practices:
A. The dealer has mentioned the life time road tax (To be paid to the govt.) as rs.53, 560 in the price list and also charged but has paid only rs.52, 140 to the govt., thus overcharging rs.1, 420 above the listed rate.
B. Further, the dealer has given insurance form that listed a choice of 6 different companies. My mother selected new india assurance company but the dealer has given bajaj insurance.
The price for insurance was listed as rs.11, 201 and was charged accordingly but the amount paid to the insurance company was only rs.10.951, which is again over charged by rs.250.
C. The first invoice date shown in the service manual book was 26th january 2016 by a dealer in nizamabad (Another town in telangana state) but the delivery was made on 14th march 2016 at hyderabad, which causes us to suspect that foul play was involved. January 26th is a national holiday in india, and no govt. Or private office in india is allowed to work on national holidays.
D. The mandatory services and manufacturer’s warranty are accounted from the date of delivery mentioned in the owner’s service manual/book. As per the date mentioned in the book, all these dates become invalid for any claim.

In all probability, the vehicle was sold and invoiced to someone else on 26th january; and sold and invoiced again to my mother on 14th march 2016. Consequently, the delivery of permanent registration documents was delayed by 9 days.

While i realize there could be one or two mistakes, so many cannot be tolerated. On account of my recommendation to buy a maruti suzuki car, my mother is undergoing a lot of trouble and my father (Also a senior citizen) is running from pillar to post, unable to comprehend such legal complications.

I request you to advise maruti suzuki india limited to make necessary amends, by taking back the car for a full refund made to my mother, without any deductions, towards any services, since any service provided has been unsatisfactory, defective and troublesome.
