[Resolved]  Maruti Suzuki — Rejection of claim of defective battery within two years of purchase.

I have purchased Ritz Diesel LDI on 14.02.2012 from Modern Automobiles, Ambala City having Registration No.HR01AF9339. In the month of December 2013 my car met with an accident and for accidental repair I sent my car to Modern Automobiles. After my repeated follow ups, my car was repaired after inordinate delay of around 1 month. After getting the car on next day the car started giving starting problem and I again went to Modern Automobiles dealership in the month of January 2014. After diagnose it was told by the officials of Modern Automobiles that prima facie the gravity is too low and seems to be replaced. But referred to the exide stockists. The problem in battery arose in the first year of the purchase and may be due to faulty battery or due to negligence on the part of employees of Modern Automobiles during the approximately one month period they took to repair the car. However, the exide stockists after 2-3 days of charging returned the battery and which was refitted in my car. It was assured that battery would not give any problem. Thereafter, it was summer season and I carried on with the same battery. However, now with the advent of winter season in the month of December 2014 the battery again started giving starting problem. Then again I went to Modern Dealership Ambala and my battery was referred to exide stockists who has rejected the claim. My claim has been rejected since the car has run around 54876 kilometers. I wish to say that the warranty to battery is of years and not on mileage basis. I have been told that the warranty of battery is ranging from 24 to 27 months from the date of sale and is not concerned with mileage. This is an end to end warranty which is passed on to the customer who purchases the vehicle. Hence I feel that my battery needs to be in warranty as my car is yet to complete 2 years in 2015 and the problem arose during the first year of purchase and again within 2nd year of purchase. I have been harased unnecessarily by Maruti people and exide people. Nirmal Sharma
