Internet Service Providers Must Provide the Promised Speed |
 Complaints against the quality of internet services are legion and consumer organisations are flooded with allegations of over-billing, improper connectivity and slow speeds of downloading. The amounts per month involved are so small that most consumers do not take the trouble of dragging the internet service provider (ISP) to consumer courts or the Telecom Regulatory Authority of India. In worst case scenarios, they just change their ISPs.
A consumer in Kerala however, took an erring ISP to a consumer court in a landmark case - M/s Asianet Satellite Communications Ltd and another vs G Arun Govind in the Kerala State Consumer Disputes Redressal Commission.
Arun is a business executive and paid a sum of Rs4,280 for an ADL high speed internet connection, as directed by the company. Some time after starting usage of the service, Arun noticed that the speed of downloads was quite low and complained to the company. The company promised to look into the matter, but to no avail.
Arun filed a complaint with the district consumer dispute redressal forum which upheld his contentions and ordered the company to refund him his deposit of Rs3,110 with interest at 14.5% and compensation of Rs1,500 plus litigation costs of Rs1,000. The company went in appeal against the order to the state commission.
The commission noted that the lower court had asked an expert, who was a B Tech in Information Technology, to carry out an inspection of the service provided to Arun. The expert had given a clear opinion that the service was 2,738 KBPS slower than what was promised in the advertisement of the company. The company, in response, stated that the speed of the service depended on the number of users and the quality of the instrument being used by the consumer.
The commission then noted that the variation in speed in the transmission was not mentioned by the company by any evidence showing that this was brought to the notice of the consumer, prior to purchase of the service. It also noted that in subsequent advertisements of the same company, it was mentioned that the transmission speed was twice that of any other telephone modem, against its earlier advertisements advertising a 500 times speed.
Finding no merit in the appeal, the state commission confirmed that order of the district forum and dismissed the appeal. |

I have a reliance Broandband+ netconnet for 8 days. executive says me its speed 3.1 mbps but I haven't this speed. this time my internet speed is 30 to 100 kbps. I call to company customer care & Executive and other company's staff but no answer and not my solution.

Sir/Madam,
I wish to state that I have purchased a reliance-cdma prepaid sim card(No.9313677451) from Barola(Noida-201301) a month ago. I submitted a photocopy of my voter ID card & a passport size photo and did all the needful as desired by the vendor. After nearly a week, I received a message from Reliance that my no. will be deactivated soon for address verification reasons. As such,I resubmitted my documents to avoid barring of my services.
Still after 2 days my no. was deactivated. I enquired the reasons of the same from the same vendor for which I was told that there is some strike going on, so no new nos. and even my no. can be activated till the strike continues. After waiting for nearly 10 days, I visited Reliance web world situated at Sec-18,Noida on 8th Jan,2010. There I was told that my documents were submitted but there was some problem in telephonic verification of address. But the same is not a big issue & it can be redressed within hrs. It was not done.I visited the web world again on 10th Jan, when I was told that there was some problem but the no. would be activated maximum by Monday morning. Again the promise failed. Then, again when I called up the executive at the same web world, She replied that there was some problem but it will be sorted by 5PM on the 11th Jan. Again the promise failed. When I tried calling up again, she never received my call. Now on this day, 12th Jan
, I believe she has barred my no. on her cell.
I am facing severe problems as because I have given this no. to my near & dear ones in family and office. The no. was recharged with Rs.249 pack which I could barely use for 7 days as against its validity of 30 days. The no. has even a talktime of nearly Rs.200 but of no use. In such a case,I am forced to use my alternate no.(9333141517) of WB which is on roaming.
Please consider my case and do the needful.
