Paras Buildtech — Regarding my wrong allotment

Date: 22nd November 2015 To, The Concerned Person Gurgaon Subject : Complaint against Paras Buildtech for Allotting the unit which is not in compliance with the agreed specification Dear Sir/Madam, I Amit Mogha had booked a unit with Paras Builtech on their upcoming project named Paras Dew’s located in Sector -106, Dwarka Expess, Gurgaon, Haryana dated 27th August 2012 in a name of my wife Mrs. Amita Mogha and me as a co-applicant. It was booked at the prelaunch stage, which had no concrete plan on the basis of the Unit and they also not had an approval at that time when they launched this project or I can say collected a booking amount cheque from us. I had always preferred to take unit from Lower Floors (2nd to 7th Floors preferably) since the inception of the project. In spite of acknowledgement given for the preference of the unit, I have been allotted unit no T-C/1804 in December 2012 which is on 18th Floor which is not favorable for my wife as she has an acrophobia (fear of heights) which is a very unprofessional behavior for not considering the Customers preferences of booking the unit. Despite o[censored]nfavorable allotment from Paras Buildtech I have been paying all the Demand received on time without any delay and at the same time I have been contacting the concerned officials (Ms. Anjoo Gogia & Rakesh Arora) for change in the floor of the allotted unit but have never received any revert for the same on time. Being the Customer who has booked the unit with a renowned builder Paras Buildtech for a prelaunch project at the time of inception in 2012 has all the right to demand for the unit of his own preference. Any builder not adhering to the same can be charged on legal basis. I have paid the builder around 72, 09, 321 /- against the property but have not been allotted the unit of my reference. The Builder stresses on the Builder Buyer Agreement which has been duly signed by me but I have been raising the request for the rectification of the unit before the agreement was issued. All the communication trail has been attached for detailed conversation and the builder. Paras group has been intentionally holding the units from the lower floors for their own benefits to sell on a higher rate and are not intimating the availability for the same. Being from the same industry I am aware of all the details of the group as regards to the availability o[censored]nit and other matters in that case. Instead of several reminders and request raised to the builder is not in favor to comply with the raised request as the top authorities of the group as well have not shown any interest to solve the issue raised by me. This leaves with only one option on my side which is the cancellation of the unit as 18th Floor is not at all preferable due to personal reasons as mentioned earlier. The agreement with the group includes a clause stating if the customer fails to pay any demand on time then he will be liable to pay the amount with 24% interest. The same clause applies to the builder as well on the cancellation of the unit, the builder must be liable to pay the amount paid till date which stands out to be 72, 09, 321 /- with 24% interest on the cancellation of the booking. I have already written a mail to Builder for the cancellation of the unit but they are refusing for the same and for interest as well moreover they are saying we will deduct 10% of your Property Value from your amount given to us. Would need a favour from the Government or concerned department to give some help to me as a customer for avoiding such situations and request you to please help me to arrange me funds back with interest. I as customer has all the right and would want to take the issue legally with the legal proceedings against the builder to consumer court and CREDAI and other concerned authorities to get this case resolved.
