Sahara Prime City Ltd — Delay in Possession from Sahara City Home, Lucknow Project

Respected Sir/Madam, My Self is Manish Kumar Gupta, S/o Sri Prakash Shankar Gupta, residence of H.N. 286, Sector N/1, Aliganj, Lucknow 226024. I am writing in regard to make a complaint against SAHARA PRIME CITY LIMITD, REGD. Office: Sahara India Centre, 2, Kapoorthala Complex, Aliganj, Lucknow Ph:[protected], 2334799. This company has launched a Sahara City Home Township Project, located at - C14/405, Hardoi Bypass Road, Near IIM, Lucknow, Uttar Pradesh 226201. Myself as consumer booked 2 Bed Room + Study room unit on 18th Sept 2012 and paid upfront Rs. 2, 21, 600.00 which is 5% of total sale price Rs. 44, 31, 906.00. On 9th Oct 2012 company issued me allotment letter having my unit no. floor, folio details etc. and asked to pay another 10% amount of Rs. 4, 43, 185.00 which I paid within given due date on 14th Dec 2012. Later they issued me further payment plan asking 22 equal instalment of Rs. 1, 71, 233.00 each month which will go up to Oct 2014. For future payment I have approached HDFC to get mortgage and HDFC has approved the as well, but when it come to disbursement HDFC rejected Sahara Demand highlighting SAHARA SEBI Dispute case over illegal Fixed Deposit collection by SAHARA. Since HDFC reject disbursement I ended-up finally paying Sahara Instalment from my savings. I paid them 5 instalments of Rs. 8, 56, 165.00 from my saving despite having financial challenges and finished up with my all saving. Then I contacted Sahara official stating my financial position and requested them to put halt on this payment until SAHARA - SEBI dispute get resolved. Sahara official verbally and orally confirmed to that there will not be any late interest would be charged until this dispute get resolved. After that there was pause of 7 months between Apr 2013 to Nov 2013, during this time I was keep liaising with Sahara Official many times. Around Oct 2013 they inform that LIC is still financing to our project and provided all sort of contact details and legal documentation facility to get my LIC mortgage approved to continue keep Paying to Sahara. My mortgage from LIC got approved and LIC clears all Sahara pending dues and paid them of Rs. 13, 69, 869.00 on 6th Jan 2014 and then afterwords LIC paid Sahara every month of Rs. 1, 71, 233.00 until 22 pending instalment got finished. In total I have paid Rs. 15, 20, 950.00 from my saving and LIC paid Rs. 28, 50, 000.00 to Sahara. We both together paid 43, 70, 955.00 almost 98% cost of flat. After this payment as per the agreed terms and condition Sahara was about to offer possession in Dec 2014. However, due to ongoing issue between Sahara and SEBI they stopped complete work on Project site. Now, neither they are offering possession to me, nor they are giving alternate unit to me, nor they are giving 5% late interest as per agreed terms and clause. On the other hand, since I took mortage from LIC of Rs. 30 Lacs I need to repay them using Rs. 33, 000.00 per month. So far I am keep Paying LIC these instalment and already made payment approx 6 Lacs. Now, I am running out of all my savings and do not have any option except getting declared as default in this mortgage as my earlier planning to manage my finance did not work because Sahara is unable to offer possession on my unit. Considering all above situation, I plea to please intervene in this process and advise either LIC to put halt on EMI until I get possession or take action against SAHARA official to provide possession. I am really got frustrated during last 1 year follow-up with Sahara Officials and LIC, because of this I am always in mental stress and start getting migrane pain, my health is getting affected because of this dispute, there is no way seems coming out, project site is closed from last 2 Year. Don't know whether they will kick off project in near future of they will sole this project or whether supreme court will attach this property, everything is un-certain. Please help in this situation or advise what could be suitable way to deal this situation as I am getting stuck between LIC and SAHARA and don't know what to do. Currently, due to some personal reason I am out of country and not able to deal with them easily. Please help me on this matter.
