My car nissan terrano with no mh02dg9463 had an accident on highway on date 27/12/2015.
As inspected by nissan work shop, car came under total loss category.
So, i claimed for the same.
But after repeated delays from axis bank and tata aig insurance in the end they gave me the letter on 28/01/16 rejecting the claim.
It stated that you have not reported previous claim during taking the policy and thus policy would stand forfeited.

I have shown the previous policy paper to the person of axis bank while taking the policy and also he submitted incorrect policy number of my previous insurer i.E. Bharti axa general insurance company limited.

I have given hard copy and also mailed the policy documents of my previous insurer to both the companies (Tata aig & axis bank)
During conforming with my previous insurer for no-claim issue, they came to know that policy does not exists with the same policy number(Incorrect one)
But they never informed me about incorrect policy number and that policy does not exist
And further there was no notice or information given to me about not reporting the previous claim and no intimation was give to revise or to forfeit the policy or about providing incorrect policy number of previous insurer
There was enough time i.E. From 27/01/15 to 28/01/16 almost a year for them to inform me for this error but no steps were taken by both axis bank and tata aig general insurance company ltd.
When i am demanding for claim at that time they are informing that your policy is forfeit.

This is further to our below email and the subsequent telephonic conversation with the undersigned regarding policy number [protected].

We have reviewed the matter based on your representation and would like to reiterate that your policy was issued in our records as per the details provided on the proposal form duly signed by you, cover note (Gp[protected] and premium received towards issuance of the policy. The cover note stated that you were eligible for 20% ncb on renewal of the policy. Accordingly the policy was issued in our records and the policy document was dispatched to your mailing address on 4th february 2015 through blue dart courier vide waybill number [protected]. As per our records the document was delivered on 5th february 2015. Our records reveal that there has been no concern raised by you upon receipt of the policy document.

As per our records a claim was registered in the policy on 2nd january 2016 with claim number [protected]a. Accordingly, as per the company process, the ncb declaration was reconfirmed with your earlier insurer. Upon being informed that a claim was registered in the expiring policy of bharti axa general insurance company limited, a letter was sent to your mailing address informing that in view of non-disclosure of material facts, your comprehensive cover policy has been cancelled.

Further, we would like to draw your attention to the provision of the india motor tariff, general regulations 27 - no claim bonus. An extract of the same is given below for your reference.

Where the insured is unable to produce such evidence of ncb entitlement from the previous insurer, the claimed ncb may be permitted after obtaining from the insured a declaration as per the following wording:

"i / we declare that the rate of ncb claimed by me/us is correct and that no claim as arisen in the expiring policy period (Copy of the policy enclosed). I/we further undertake that if this declaration is found to be incorrect, all benefits under the policy in respect of section i of the policy will stand forfeited."

In view of the details stated above we once again regret we shall not be able to consider your request for regularization of the policy and processing of the claim.
