Allahabad Nagar Nigam — Information about a plot

1. With due respect and humble submission I beg to lay down the following few lines for your kind consideration and favourable please.

2. I have purchase 1 Biswa 4 ½ dhoor plot in Bhoomidhari No 1012 at Mauja Umarpur Niwa Uparhar, Pargana & Tehsil- Chayal, Distt- Allahabad.

3. After some time I was surprised to know that the above plot has been acquired by Allahabad Development authority since 1958. However as on date neither any compensation to that plot has been paid nor any construction on that plot has been made by the Allahabad development authority.

4. As per para 24 (2) of the right to fair compensation and transparency in land acquisition, rehabilitation and resettlement Act, 2013 (photocopy attached as Annexure 1), “It is mentioned that in case of land acquisition proceedings initiated under the Land Acquisition Act 1984, where an award under the said section 11 has been made five years or more prior to the commencement of this Act but the physical possession of the land has not been taken or the compensation has not been paid, the said proceedings shall be deemed to have lapsed and the appropriate Government, If it so chooses, shall initiate the proceedings of such land acquisition afresh in accordance with the provisions of this Act”.

5. Also as per para 174 o[censored]ttar Pradesh Shashan, Rajaswa Anubhag-13 notification No 368/1-13/2015-5Ka(25) 2013 dated 12/05/2015 (Photocopy attached as Annexure 2), “Where any land acquired under the Act remains unutilized for a period of five years from the date of taking over the possession, the same shall be returned to the original owner or owners or their legal heirs, as the case may be”.

6. I have send an RTI to The Public Information Officer, Allahabad Development Authority, 7th/8th Floor, Indira Bhawan Civil Lines, Allahabad (UP) and in reply to our RTI, they have advised me to contact with your good office vide their letter No 605/ / /2016 dated 08/11/2016 (photocopy attached as Annexure 3).

7. In view of the above it is requested that kindly intimate the following information at the earliest :-

(a) Whether the above plot is still required by your organisation.

(b) If yes, than intimate whether the compensation for the above plot will be paid in accordance with para 24 (2) and para 26 right to fair compensation and transparency in land acquisition, rehabilitation and resettlement Act, 2013

(c) If No, than intimate whether the land can be used by me for the purpose either construction of home or sale out the plot, and if so a No Objection certificate may be issued to me at the earliest.
